LA Police claim: Killing of Paul Kessler doesn't appear to be a hate crime Ventura County DA says killing of elderly Jewish man by anti-Israel protestor does not 'meet the elements of a hate crime.' https://www.israelnationalnews.com/news/380559 Ventura County District Attorney Erik Nasarenko said Friday that the killing of Paul Kessler, a 69-year-old Jewish man who was killed when he was struck in the head with a megaphone by an anti-Israel protestor in Los Angeles on November 6, does not appear to be a hate crime, but his office has not "ruled out" the possibility that it was a hate crime. “Simply put, looking at the statements as well as the words that accompany this act, we cannot at this time meet the elements of a hate crime,” Nasarenko said. “But nevertheless, we will continue to explore and investigate that offense as well as that special allegation.” Last week, Loay Abdelfattah Alnaji, 50, was arrested on charges of involuntary manslaughter for striking Kessler, resulting in his death. Jewish organizations have maintained that the deadly act of violence was motivated by antisemitism. After being struck in the head, Kessler fell to the ground, bleeding, and was rushed to the hospital, where he was pronounced dead due to blunt force trauma. The Ventura County Medical Examiner's Office said that Kessler suffered from skull fractures and swelling and bruising of the brain and determined his death to be a homicide. Jonathan Oswaks, a friend of Kessler and a witness to the incident, said that the two Jews were "stalked" by the man who would go on to assault Kessler. It took more than a week for Nasarenko to be arrested, despite his identity as the one who struck and killed Kessler being known to police the entire time. The case has attracted national attention as the first case in which a Jewish person has been killed in the US in the wake of the Hamas massacre of over 1,200 people in Israel on October 7. The Hamas massacre has inspired a wave of antisemitism, with antisemitic incidents rising as much as 400% following October 7, according to the Anti-Defamation League. The Cabinet memo, sent to senior aides like Secretary of State Antony Blinken and Treasury Secretary Janet Yellen on Friday, orders their agencies “to develop policy options for expeditious action against those responsible for the conduct of violence in the West Bank.” A senior U.S. official read sections of the memo to POLITICO on Saturday evening shortly after Biden published an op-ed in The Washington Post revealing his intentions for such a move. “The United States is prepared to take our own steps, including issuing visa bans against extremists attacking civilians in the West Bank,” he wrote in the op-ed. The directive comes as the Biden administration aims to show that it’s supporting Palestinian civilians in need, even as it staunchly defends Israel’s retaliation against Hamas, and while members of the president’s party seek conditions on military aid to Washington’s ally. The targets for reprimands are broadly defined in the memo. They include people or entities that “have directly or indirectly engaged in actions or policies that threaten the security or stability of the West Bank,” take “actions that intimidate civilians in the West Bank with the purpose or effect of forcing displacement actions in the West Bank,” or make moves “that constitute human rights abuses or violations and actions that significantly obstruct, disrupt or prevent efforts to achieve a two-state solution.” The memo notes that Biden sees the settler-violence issue as a “serious threat” to peace among Israelis and Palestinians and destabilizing throughout the Middle East. The decision to issue the directive came after intense debate on the topic, with national security adviser Jake Sullivan and deputy Jon Finer offering their direct input during a dedicated internal process, the official said. POLITICO has not seen the memo, and the official was granted anonymity to read from a sensitive internal document. The White House declined to comment. Israeli settlers have been moving into the West Bank for years, and incidents of violence were already growing after Prime Minister Benjamin Netanyahu returned to power nearly a year ago. But the intensity of the long-running issue has grown since Hamas attacked Israel on Oct. 7, killing 1,200 people. Yesh Din, an Israeli rights group, reports that 197 Palestinians in the West Bank have been killed by settlers or Israeli forces since Oct. 7. The United Nations reports that, in the same time frame, at least 121 Palestinian households — about 1,150 people, including 452 children — have been displaced by settler violence and access restrictions. Daily incidents of settler violence rose from three a day earlier this year to seven since the attacks, per the United Nations. About 11 Palestinian communities have been completely abandoned in 2023 alone, according to the West Bank Protection Consortium, six of them since Hamas’ assault. Biden has often condemned the rise in violence. “I continue to be alarmed about extremist settlers attacking Palestinians in the West Bank,” he said in October, equating the attacks to “pouring gasoline on fire.” “They’re attacking Palestinians in places that they’re entitled to be, and it has to stop. They have to be held accountable,” Biden added. On Friday, Blinken urged the Israeli government to confront “rising levels of settler extremist violence” during a call with Israeli war cabinet member Benny Gantz. The president initially stood firmly behind Israel, saying it needed to strike back at the militant group in Gaza. Later, the administration faced pressure to alleviate the growing humanitarian crisis, eventually working with regional partners to get aid into Gaza for its 2.3 million residents starved of food, water, fuel and medical attention. That was too little too late for some Biden voters who say they won’t pull the lever for him in 2024 over this Israel-Hamas policy. Pressure from within Biden’s party is also mounting in Congress. Two Democrats on Thursday, Sen. Cory Booker (D-N.J.) and Rep. Dan Goldman (D-N.Y.), sent a letter urging him to do more to curb settler violence. Progressives want the administration to call for a cease-fire in the war that has killed more than 11,000 people in Gaza, according to Hamas-led Gaza health authorities. Jewish voters back Biden over Trump Poll shows approval for incumbent’s performance Marc Ramirez USA TODAY Jewish voters strongly support President Joe Biden’s handling of the Israel-Hamas conflict and would trust him over former President Donald Trump to fight growing antisemitism, a national poll has found. Results released this week by the nonpartisan Jewish Electorate Institute also showed Biden with a considerably higher job approval rating among Jewish voters than among the general U.S. population. While the results weren’t necessarily surprising given that most Jewish voters lean Democratic, 'it is reaffirming of the fact that Jews know and trust that Joe Biden stands with us and stands with Israel,' said Halie Soifer, CEO of the Jewish Democratic Council of America. About three-fourths (74%) of Jewish voters approve of Biden’s handling of the ongoing conflict, according to the poll of 800 Jewish voters conducted from Nov. 5 to Nov. 9. Meanwhile, more than two-thirds (68%) said they would support Biden over Trump, the presumptive Republican candidate – slightly less than the portion (74%) who said they voted for Biden in 2020. About two-thirds (66%) of Jewish voters said they approved of Biden’s performance as president, while a recent USA TODAY/Suffolk University survey showed Biden’s overall job approval at just 40%. 'There continues to be extraordinary support for Biden,' said Jim Gerstein of GBAO Strategies, the Washington, D.C.-based firm that conducted the poll. 'That doesn’t happen in a vacuum: Donald Trump, the likely Republican candidate for president, is extraordinarily unpopular with Jewish voters. I would actually expect that to grow as the election gets closer.' Support for Biden’s approach to conflict The poll, which measured attitudes among the Jewish American electorate about Israel, antisemitism and the 2024 election, found support for Trump at just 22% of Jewish voters, an 8-point decline compared with a pre-2020 election poll. Sam Markstein, national political director for the Republican Jewish Coalition, said the group was 'confident' that the results would not be predictive of November 2024 numbers. Trump, he noted, took 24% of the Jewish vote in 2016 and more than 30% in 2020. 'The trendlines are clear: Jewish voters are moving away from the Democratic Party and toward the Republican Party,' Markstein said. Biden’s strongest poll support came from the population’s largest voting blocs – reform Jews and those not aligned with any particular denomination. Orthodox Jews were the only group not supporting Biden, with just 22% in favor. Orthodox Jews were nonetheless among the most likely to approve Biden’s handling of the Israel-Hamas conflict. And while young voters were less likely than older generations to approve, they nonetheless support Biden over Trump by an overwhelming margin. More than 80% of Jewish voters said they approved of specific actions Biden has taken to support Israel in its war with Hamas, including visiting the country and meeting with Israeli leaders, dispatching aircraft carriers to the East Mediterranean Sea to deter would-be aggressors, and having senior American officials attend Israeli war Cabinet meetings to discuss strategy and offer counsel. Meanwhile, 80% said they supported Biden’s $14.5 billion request to Congress for military aid to Israel, while 68% approved of U.S. calls for a humanitarian pause to enable safe delivery of food, water and medicine to Gaza. 'That level of support supersedes party lines,' Soifer said. 'Jewish voters understand these issues and are following them closely.' ‘Consumed with what’s going on’ The poll results bear that out. Nearly all (97%) of respondents said they were closely following news coverage of the conflict; 75% said they were following very closely. 'Jewish Americans are consumed with what’s going on,' Gerstein said. 'This speaks to the horror of Oct. 7 and how it has drawn them in – plus we have an ongoing hostage situation.' Additionally, the poll found that Jewish voters are more emotionally attached to Israel than in an institute poll taken earlier this year. Four in five (82%) said they felt at least somewhat attached to Israel. While that number was somewhat consistent, the level of intensity climbed, Gerstein said. In June, just 33% of respondents considered themselves very emotionally attached to Israel; in the latest poll, that figure had jumped to 51%. Those stronger bonds with Israel, however, did not translate into favorable views of Israeli Prime Minister Benjamin Netanyahu. More than six in 10 (61%) said they viewed Netanyahu unfavorably, compared to 31% who viewed him positively. 'He has not gotten a bump at all despite the crisis,' Gerstein said. Respondents were also asked about the notion of being 'pro-Israel' and what that entailed. Could a person be critical of Israeli government policies and still be considered pro-Israel? More than nine in 10 (91%) said yes. About three-fourths (76%) said being pro-Israel could include criticizing Israel’s handling of the conflict with Hamas. However, agreement varied widely among groups, with those aged 18 to 35 largely agreeing and Orthodox Jews strongly in opposition. 'They’re (Orthodox Jews) fine being critical of Israeli government policy, but they’re not fine with being critical with Israel’s conduct of the war,' Gerstein said. Concerns intensify over antisemitism As reports of antisemitism in the U.S., including attacks from the far left, have surged along with Islamophobia since the war’s inception, worries over both have grown. More than nine in 10 Jewish voters (93%) said they were at least 'somewhat concerned' about antisemitism in the U.S., and while that share has remained consistent since April 2022, Gerstein said. _________________________ | |||
