You shouldn’t have to be a lawyer to exercise your 2A rights…

Congress needs to pass HPA and SHORT, or nullify the whole NFA, so Americans do not have to worry about confiscations, fines, and/or jail time over mufflers and barrel lengths.

Smoky Mountain Guns and Ammo, one store sits inside Smoky Mountain Knife Works, just began selling cans on 4473’s. They have a huge store not far from Sevierville that is is bigger than Bud’s.

Sounds like Sporting Systems down in Vancouver is gonna start selling on just the 4473. They're pretty on the ball about this stuff, been leading a lot of the action against the grabbers these last few years, so it's not just some kook deciding "fuck it".

^^ Interesting...According to Silencer Shop, Washington requires the NFA process due to restrictions/requirements in Washington state law.

Like I said, sounds like they're going forward starting today, I reckon we'll find out for sure in a few hours when they open.

I stopped in my local gun store Spring Guns and Ammo yesterday as they sent an email that they were now moving to 4473 on suppressors.
They had a good selection in the case. I got to thinking, with my other suppressors I keep a copy of my NFA paperwork in my range bag. Under this new paradigm what are you keeping nearby in the event the local authorities see you at the range or if stopped in traffic?

Thanks for your insights.

Until Oct. 5th, the true end date of any appeals from DOJ, I just keep my form 4s like I did before.
They are in my truck, range bags and safe.
My second can I picked up post injunction but it has a form 4 even though I belong to one of the “protected groups”.

Why? Because traveling cross country may mean passing through a state that requires it despite the NFA being castrated on this issue.
Guidance from ATF is coming and should clarify what it all means.

I'm not keeping anything around anymore than I would for (say) a rifle bought off a 4473. I do have GOA status and archive the e-mails JIC I want to get something from other than my LGS where they know me. But it's not in case I'm pulled over.

What AI Gemini has to say about it:

General Enforcement Power: Under federal jurisprudence, state and local police officers can make arrests for federal crimes (such as federal felonies or offenses committed in their presence), even if the state lacks a matching criminal statute. Because federal law is the supreme law of the land within the state, officers acting on probable cause of a federal felony are generally acting within constitutional limits.

But:

Federal Civil and Regulatory Laws
No Inherent Power: Local police have no inherent authority to enforce federal civil or administrative codes (such as civil immigration violations, SEC rules, or federal tax codes).

Regarding local authority, though, there may be controlling statutes. In Colorado for example, suppressors are “deadly weapons” whose possession must be specifically permitted, such as with an approved Form 4. A local officer could evidently therefore demand proof of proper registration/permission because without it, possession would be a felony.

And this is one of many reasons why I don’t fool with AI!!!!!!
It’s either flat out wrong or a jumbled mess of things to try to sort out.

In most instances NO State or Local LE CANNOT arrest you on Federal charges.

I was hoping for LEO input (and no one else responded to the question before I did. Wink ), but where would I go to confirm that local LE may not arrest anyone on Federal charges—and contrary to this?

“The general rule is that local police are not precluded from enforcing federal statutes.” (II Authority to Arrest)
LINK:

That was not AI except that it was found via an Internet search which, of course, is a type of AI. Unless we have a complete annotated and indexed law library at our fingertips, any such question will require the use of some sort of artificial search help to find the answer.

And I am not referring to local departmental policies, but rather controlling statutes or case law.
You do, however, say “most”; can you think of a Federal offense that local LE could arrest on without having a concurrent state/local charge?

I can think of none but me experience is with one state.
However, there are Local and State LE like myself that are or have been deputized by a Federal Agency and are capable of doing such.
But they would be acting under their Federal powers and not their local.

I have never heard of a non Federally deputized local LE arresting or placing strictly federal charges.
Here we do not have a way for that to actually happen. A local LE can’t just place Federal charges then take him to a local jail.
One needs a Federal warrant and our local jail will hold them on that but no way would they take a local charging document for a Federal charge.

That also does not mean the local officer can’t detain someone while they contact the Feds.

Just because something is legal to do doesn't mean it is the smart thing to do.

I thought that police officers take an oath to enforce all the laws of local, county state AND FEDERAL.
Isn't the law banning a felon from possessing a gun a federal law? If it is don't local LEOs arrest for it?

In most states Felon in Possession is a state charge as well so they will charge that. In many instances if a Federal law also applies the state and federal prosecutors will sit down and see which venue will likely get the best outcome and decide which venue.

Enforcement does not always mean physically placing one into custody, placing charges, and taking to jail. Enforcement can also entail notifying the proper authorities.
Jurisdiction comes into play as well. I swear to enforce all state laws but that does not mean I can do it anywhere in the state. I am bound by my jurisdiction and my jurisdiction only allows me to take someone into custody in my own county.
I take 2 steps over the county line I can’t enforce state laws because I do not have jurisdiction in their courts, nor do most local LE have jurisdiction in Federal court.

Black for the win.

Policing seems to be a topic that people try to paint with a broad brush but there are many, many nuances. I can’t make a probable cause arrest for anything in 18 USC. Now the nuance part. The 5 years I was assigned to the feds I had the same sworn authority as a Special Agent. And i carried a bunch of cases every year. And out of the 30 cases a year I brought before a US Attorney to prosecute.,,…I made 1 probable cause arrest. The fed system here hates it. So the way it usually went was to lodge them on state charges that were applicable and either complaint warrant them or take them to the next grand jury.

Being a fed and enforcing federal laws is NOTHING like being a street cop.

Here’s the peace officer oath for KY.

Faithful to the office? Check.
A whole lot of shit about fighting duals? Check
Enforcing local, state and FEDERAL laws? Meh

Forgetting state laws for a second, is NFA tax law? Who enforces that?

If you live in a state that has no laws with respect to silencers, would you need to worry about local law enforcement at the range or during a traffic stop?

ATF enforces it.

Yes local LE can ask to see your stamp. Where it gets murky is if the state has mirror laws to the USC. No you don’t have to produce it in a state with no mirror laws.

However, using good judgement keeps problems away.

An AZ state trooper buddy told me AZ has a law specifically authorizing state and local police to enforce federal gun laws. I doubt it ever happens unless it's a chance to stack charges on a real crime. But he said they can ask to see your stamps at the range.
