Here's an angle I haven't heard yet:

If the ruling stands and suppressors are purchased over the counter after a background check - I think there'll be a huge demand for much larger (say 14 to 18" long) pistol strong boxes. Current ones won't fit a pistol equipped with a suppressor.

And if you have kids / grandkids, you'll want a secure location to store your new defensive weapon of choice. Much handier than having to screw the suppressor on at 2 am after you hear a noise downstairs.

For clarification purposes since GOA is a plaintiff does the ruling cover all GOA legacy members even if they don’t reside in one of the named states.

^ That's the impression I got but it will also depend on if your FFL is ALSO a member of a protected class, and if they are willing to do just a 4473 transaction and your state doesn't classify suppressors as a "dangerous weapon" etc. requiring NFA compliance through a form 4 regardless of recent deregulation. I've also heard ATF wanting 4473 even if a ccw would otherwise allow one to bypass background checks.

4473 is always required, NICS check sometimes.

I'm a Silencer Shop dealer and customer. But I'm pretty sure they're not gonna give me so much as a phone call with a manager if ATF wanted to make an example out of me.

The plaintiff states seem to have been suing on their behalves, not the citizens.

Best I can tell is current and future GOA members or other plaintiff affinity organization are GTG if the state itself doesn't either outright ban suppressors, or mandate them legal only if registered. And ofc if the FFL is willing to proceed.

If it were real, it definitely would be sold in multi packs. The closest gun related item I’ve ever seen at Costco was a range bag and rifle case. Which was really surprising.

To drift a bit more,
I've seen both soft cases and Pelican hard cases, for rifles. The Pelican was a good deal, IIRC it was something like $120.

I've embedded a couple of his videos, I think, but it's because he seems to actually understand and relate the legal stuff and be pretty much on the mark. Definitely the polar opposite of Anthony Miranda, the "Armed Scholar" clickbait clown.

The tl;dw punchline is: common use. The more of us who buy suppressors and SBR/SBS, the harder it is for states like New York and California to argue that these are unusual and especially dangerous arms when their bans get challenged in court. If you live in a state where these are legal, and you've never done so before because you didn't want to ask permission, didn't want to go on a registry, didn't want go through an intentionally punitive and arduous process, then I would like to encourage you to step over the line with us and add to the numbers. I'm not saying slap a stock on your AR pistol, I'm not saying to go out in the garage and fire up the drill press. That all remains to be figured out and being incredibly cautious on that front is advisable. However, if you fit in the category I outlined, I would like to encourage you to go ahead and go through the process and file some Form 1's and Form 4's, and directly add to the statistics the ATF keeps track of for their processes. If you have AR lowers that you filled out 4473's for, they know you have them. Unless you bought all 80% lowers and finished them yourself, you're on a registry already (I know, they're not supposed to, but we all know they are), and the 80% lower guys are already making their own cans and SBR's anyways.

When this all gets settled and if it's the case that you don't need to file, register and engrave, then you can notify the ATF via a printed letter with a hand-written signature that all the Form 1's you filed and had approved were never constructed into an SBR/SBR, the silencers were never built, and they will be removed from the registry. I've done it. Register a pile of lowers and leave them in the safe, forget about them. Register your old 870 you never take out anymore because you have never semis you like better and just let it in the back of the safe. You can sit on an approved Form 1 forever and either make or not make the thing. You can file now, wait for them to figure out the engraving thing, and if it turns out you don't have to engrave if it's filed after the new requirements take effect, send them a letter saying it was never built and re-file. If we drown them in applications and they have to slog through approvals, it will get harder to justify the budget for this stuff in light of these being common use items which they're enjoined from the enforcement and registration of now anyway.

We're in a weird time, legally speaking, as the second amendment and our rights to actually practice it go. I think there's a balance between "become ungovernable" and being "a bootlicker." I think there's a place to be a reasonable, law-abiding citizen who pushes back and makes government processes burdensome to the government through overwhelming numbers, a citizen who adds to numbers and statistics that simply cannot be argued with. Be part of the change.



In his video about buying the first suppressor transferred in this country since 1934 without a tax stamp, Brandon Herrera made a statement at the end that for most of his lifetime, we've only tried to keep our rights, but this is the first time we're starting to not just preserve, but get back some that were taken. I think it's important to keep up the pressure, keep the momentum and move the pendulum in the other direction. You can do this by voting for the right people, yes. You can do this by donating to the right organizations, yes. But do not discount how important it is to help do this by contributing to the numbers for the common usage argument. Silencer Shop didn't have the budget to fight this without the many thousands of people who bought suppressors from them. The suppressor companies getting on their feet during this historic change will have the budgets to help fund these legal battles if you're buying suppressors. I don't care, pick any brand, but let's start making this a common use item that they won't have the legal wherewithal to try to continue to regulate and oppose.

If you think silencers are pointless, I'd like to encourage you to seek out a friend who has one, a range that rents them, or an event where you can try some. It will only take once to change your mind, I'm confident of that. If you think SBR's are stupid and pointless and loud, they make a lot more sense with a silencer on them, and that is a similarly pleasant and eye-opening experience as well. Shotguns are shotguns and they are always going to kick and be loud, but they are another one that for many purposes make a lot more sense in a shorter package than we've ever been allowed.

Vote, donate, write and call your politicians, but if you really believe we shouldn't have to ask, I implore you to put your pride in your back pocket for just a minute and add to the rising tide of numbers and make the argument that these are not common use items look completely absurd. We need millions.

My understanding after carefully reading the ruling is GOA members in free states are good to go. ATF is enjoined from the enforcement of a number of statutes, but specifically 26 U.S.C. § 5822, which covers the "making" of a firearm, which includes silencers. So, no Form 1 necessary for SBR, SBS, and silencers.

You'll want to check your state laws. IANAL, consult your attorney, this is not legal advice, this is all hypothetical, all the disclaimers et al.
