On August 5, a federal court ruled the NFA unconstitutional. Not the whole thing but as it applies to suppressors, SBRs, and SBSs. Silencer Shop Foundation was the lead plaintiff in Silencer Shop Foundation v. ATF. This is a final ruling, not a temporary one.

What this means for you: Buying a suppressor is as easy as buying a rifle or a handgun. That's the whole reason we built this company, hearing protection should be for all.

Now the catch, the government has 7 days to appeal. Until that plays out, nothing changes. Suppressors, SBRs, and SBSs are still NFA items today, and buying one works exactly the way it did yesterday. So don't change anything on your end. Keep going the way you always have.

Yeah, the government is going to be appealing this one…

Wow! Great news. Now wait a minute. The court ruled it unconstitutional. So, between now and the time the government challenges it, doesn’t it remain unconstitutional? That means, why can’t we go out and buy these for now non-NFA stuff?

Some of the details seem a bit different here.

Jensen vs. ATF in stead of Silencer Shop Foundation vs ATF. Are they just trying to toot their own horn or something? Which is the official case designation?

According to NRA-ILA, the Jensen case was ultimately consolidated with Silencer Shop Foundation v. ATF.

I can see where SBRs are firearms and require 4173s even when the NFA no longer applies in the future. Please explain why suppressors that are no longer subject to the NFA will still require background checks via 4173s considering they’re hardly more than an accessory like a muzzle brake. It’s not like they can do anything unless you have a firearm to attach one to. Guess you could throw it and hit someone with it. Don’t various countries in the EU sell them over tbe counter without restrictions, or is that incorrect?

On Wednesday, a judge for the District Court for the Northern District of Texas ruled that National Firearms Act registration requirements for short-barreled rifles and suppressors are unconstitutional in the case Jensen v. ATF.
Congress recently eliminated the $200 tax on these firearms through the One Big Beautiful Bill, though the mandate to register them with the ATF remained in place.
The Second Amendment Foundation, alongside co-plaintiffs including the Citizens Committee and the Texas Rifle Association, supported the legal challenge, arguing the government lacks constitutional authority to maintain registration without an underlying tax.
This ruling is the first decision rendered among three related lawsuits challenging registration requirements. The Second Amendment Foundation is a named plaintiff in Brown v. ATF and supports Roberts v. ATF.
SAF Executive Director Adam Kraut stated this decision sets a precedent allowing Americans to exercise Second Amendment rights without fear of being placed on a government registry.

Suppressors just got ruled as arms. That's a good thing, otherwise they could just get banned altogether. Since they are serial numbered, it can be recovered and returned in case of theft.

Does the absence of regulation and taxation now mean that the items are subject to the law of supply and demand only?

I can wait for supply to catch up to demand, if that makes the item affordable. At $1K, the item itself seems overpriced.

There’s nothing in the Congressional Record about why silencers were included in the first place. Best guess was to cut down on poaching during the Great Depression; it was never about violent crime

Something doesn't seem right about this. I mean, bang, just like that. One minute, it's a mountain of paperwork and bullshit, and the next minute, it's "Never mind, its cool. Chop your barrels, get your cans and you don't need to do all the other stuff."

As far as I'm concerned nothing has yet changed. Why does it seem like I'm the only one who's suspicious?

I bought my 1st suppressor in Jan, use it on a 6.5 and 243, Howa. I don’t see what the big deal is about them. Yes I shoot full power ammo, still has a report like a 223 or so.

Over the years I’ve used a fair amount of the quieter, low fps 22 ammo, no suppressor. That is all the way down to 325 fps, it’s very quiet. Then one can jump up to 500 FPS and faster.

I think buying a suppressor should be no more of a deal than buying a gun.

Subsonic is fun.

My 300blk Ruger bolt action with a dead air Wolfman is air gun quiet with subsonic.

Firearms silencers are just mufflers, but that is beside the point. They have been heavily regulated. That's the reality, and now, all of a sudden, all the regulation goes away.

I can't be the only one who is wary of this. You guys should be careful about getting your hopes up. Things which are too good to be true, usually turn out to not be true.

Everything remains the same until August 12 which allows the DOJ time to appeal or ask for the stay to be extended.

I believe it all goes POOF on August 12 if the DOJ does nothing.

I have my fingers crossed the DOJ does nothing.

Big Brother isn't going to let this one slip away without a fight, unless President Trump instructs DOJ to just drop it. I expect this will have to go all the way to SCOTUS before it becomes "real".
