So they issued a BS "apology" for the language in the earlier letter yet what they need to do is repudiate it. They cite no evidence of violence against board members but say "there remains important work to do in this area ". So there is only a hollow apology and no remorse on the topic. Only saying "we misspoke" instead.

A Virginia school board superintendent who denied having 'any record' of a female student being raped by a 15-year-old 'boy in a skirt,' reported the assault to the school board the day of the attack, a newly disclosed email reveals.

Loudoun Schools Superintendent Scott Ziegler had initially told parents during a June school board meeting he had no report of the sexual assault on the 15-year-old girl that took place at Stone Bridge High School on May 28.

However, in an email dated the same day as the assault, Ziegler wrote to the school board: 'This afternoon a female student alleged that a male student sexually assaulted her in the restroom. The LCSO is investigating the matter.'

In June, Ziegler told parents: 'We don't have any record of assaults occurring in our restrooms.'

The school board also released a statement claiming they were 'informed in a general fashion' and were not 'provided any specific information.'

On Oct. 15, Ziegler apologized for 'failing' to ensure the safety of students and prevent the alleged rape.

Parents have been requesting the superintendent resign from his position, but he has yet to do so.

He apologized for 'misleading' them on June 22 when he told a crowded meeting that there had been no sexual assaults on campus by transgender kids, and that predatory transgender people 'do not exist.'

'I regret that my comments were misleading and I apologize for the distress they caused families,' he said.

School boards group that equated parental activism with 'domestic terrorism' owes IRS $20 million

Anational education group that implied some parental activism is tantamount to "domestic terrorism" owes nearly $20 million to the IRS, according to tax forms reviewed by Just the News.

Most of that comes from "accrued pension liability," as disclosed by the National School Boards Association's 2017 and 2018 Form 990 filings. Unlike those two, the 2019 form — the most recently filed — does not include an itemized list under the federal income taxes subheading for "other liabilities."

Its liabilities have exceeded its assets by around two to one in recent years, and up to seven to one in the first half of the 2010s, according to rundowns by ProPublica.

Just the News couldn't find any IRS action seeking recovery of that money. The only federal legal action against NSBA in its own jurisdiction was an employee lawsuit alleging racial discrimination, which a judge dismissed about a year ago.

NSBA director of communications Jason Amos noted it's a tax-exempt nonprofit but didn't respond when told the liabilities are listed on its own federal tax forms.

The financial problems exacerbate the revolt NSBA is facing from at least 21 state members after it asked President Biden to use the Patriot Act in response to "the growing number of threats of violence and acts of intimidation" against school board members, citing both physical altercations and heated rhetoric at public meetings.

Its board of directors issued a memo to members Friday saying "we regret and apologize for the letter ... there was no justification for some of the language" NSBA used. "[T]he voices of parents ... should and must continue to be heard" when it comes to decisions about their children's education, health, and safety."

The board said it failed to properly consult members, which caused them "strain and stress," and promised to launch a "formal review" and announce "specific improvements soon" on consultation and coordination.

Meanwhile, Attorney General Merrick Garland, who promised to get the feds involved in local school disputes following the Sept. 29 NSBA letter, pushed back against claims that he was siccing the FBI on parents at a hearing Thursday.

"The Justice Department supports and defends the First Amendment right of parents to complain as vociferously as they wish about the education of their children, about the curriculum taught in the schools," Garland told the House Judiciary Committee.

So far only the Pennsylvania affiliate has publicly quit NSBA, but the Alabama, Florida, Kentucky, Louisiana and Ohio affiliates said they were reevaluating membership for myriad reasons, according to their responses to Parents Defending Education, a grassroots organization working to resist political indoctrination in classrooms.

Florida and Louisiana said they didn't pay membership dues for this school year, which were due in July. And Florida said it would continue to withhold "until further notice." Alabama's letter to local members said "at least a dozen states" are trying to make "essential changes" to NSBA governance and policy.

Montana School Boards Association Executive Director Lance Melton told Just the News Friday, hours before NSBA's reversal, that his group might have withheld dues if the letter had been sent earlier in the year.

"NSBA kind of went against the collective wisdom of its membership" and now must retract and apologize for the letter as "the first step" to reconciliation with its members, he said in a phone interview. "Right now we need unity."

Melton, Delaware School Boards Association Executive Director John Marinucci and Georgia School Boards Association spokesperson Justin Pauly all told Just the News they weren't aware of NSBA's tax problems.

While the most important figure is how much it costs to service that debt, Melton said, "I can't even fathom" how the national organization owes so much. Clearly "there were warning signs."

The Rhode Island Association of School Committees (RIASC) is also facing a potential revolt from members for promising to cooperate with Garland to "potentially adversely engage with our constituents."

The Glocester School Committee unanimously approved a resolution to withhold dues "until further notice." It also cites RIASC's endorsement of a political candidate and request to Gov. Dan McKee to impose a school mask mandate.

Other school committees can now consider that resolution. Coventry School Committee chair Katherine Patenaude told Just the News it will be discussed at its Oct. 28 meeting. Bristol Warren Regional School Committee chair Marjorie McBride said she hadn't seen the resolution.

The Department of Education earlier this month tapped the president of the National School Board Association to serve on a federal board that tracks student progress, the latest indication of the Biden administration’s collaboration with the group that compared parents to domestic terrorists.

Education Secretary Miguel Cardona on Oct. 13 appointed National School Board Association president Viola Garcia to the National Assessment Governing Board, which develops the tests used to track student achievement across the country. Garcia was behind a Sept. 29 letter urging President Joe Biden to have the FBI monitor school board meetings for potential violence. The Department of Justice formed a task force on Oct. 4 consisting of the FBI and Justice Department’s national security and civil rights divisions, sparking outrage from parents groups who say the administration is trying to stifle parents who oppose mask mandates and left-wing curricula.

Garcia’s position on the board could raise questions about whether the appointment was linked to her advocacy work at the National School Board Association. Emails reported by the Washington Free Beacon show Garcia coordinated with the Biden White House and Department of Education in the weeks before releasing the controversial letter. "These are troubling times. NSBA has been engaged with the White House and the Department of Education on these and other issues related to the pandemic for several weeks now," Garcia wrote in an Oct. 2 email obtained by the group Parents Defending Education.

The National School Board Association apologized for the letter on Friday, saying there was "no justification" for the language comparing parents to terrorists. Other emails showed that some National School Board Association directors were upset with Garcia for issuing the letter without the board’s input. One director said that the letter’s reference to parents as domestic terrorists inflamed tensions at local school board meetings.

Garcia’s tenure on the governing board began on Oct. 1, according to a Department of Education press release.

Congress established the National Assessment Governing Board in 1988 to set policy for the National Assessment of Educational Progress, the so-called Nation’s Report Card. Part of the board’s mission is to draft the questions used on the assessment and to use the results of the test to propose policies to the Department of Education.

The Loudoun County student accused of sexually assaulting a ninth-grade girl in a bathroom on May 28 was found guilty on all charges Monday.

The student, described as a biological male who was wearing a skirt at the time of the incident, sexually assaulted the victim in a girl's restroom at Stone Bridge High School. A judge concluded that the evidence presented was enough to convict the accused but will wait on the sentencing until the student is tried for a separate alleged assault at a different high school earlier this month.

"We are relieved that justice was served today for the Smith’s daughter," the victim's attorney, Bill Stanley of the Stanley Law Group, said in a statement. "This horrible incident has deeply affected the Smith family, and they are grateful for today’s outcome."

The Loudoun County Sheriff's Department said in a statement earlier this month that the boy in question had been charged with two counts of forcible sodomy back in July.

The victim’s father, Scott Smith, accused the school district of trying to cover up his daughter's assault to continue pushing transgender policies during a June 22 school board meeting. He was arrested and ultimately charged with disorderly conduct and resisting arrest following an altercation with a woman who said she doubted the validity of his daughter's rape.

At this board meeting, the superintendent said that "the predator transgender student or person simply does not exist," and, to his knowledge, "we don’t have any record of assaults occurring in our restrooms," according to The Daily Wire, which first reported the assault.

However, in an email dated May 28, the same day as the assault, the superintendent alerted school board members that an assault had been reported.

His punishment will be determined on whether he was tried as an adult ( This is done on serious cases with older juveniles) in Circuit Court or tried in Juvenile Relations Court as a minor.

"We are relieved that justice was served today for the Smith’s daughter. This horrible incident has deeply affected the Smith family, and they are grateful for today’s outcome," the law firm representing the family said in a statement after the judge's ruling.

A second charge against the boy is still pending. He is also accused of forcing a female classmate into an empty room at Broad Run High School and groping her.

Students at Stone Bridge, Broad Run, Riverside and other schools are planning to participate in the walkout on Tuesday. They plan to leave class for 10 minutes in protest, and organizers have asked students and teachers to wear white and make protest signs, WUSA reported.

Loudoun County Public Schools Superintendent Scott Ziegler acknowledged on Oct. 15 that current policies are not adequate in addressing sexual assault cases following the incidents.

"I want to acknowledge that our processes and procedures were not adequate to respond to these recent events," Ziegler said. "It has become clear that our administrative procedures have not kept pace with the growth we have seen in our county."

An email from May 28 and revealed this month shows ​​Ziegler telling the school board about the sexual assault allegation that took place in the bathroom at Stone Bridge. At the June school board meeting where Smith was arrested, however, Ziegler declared that "the predator transgender student or person simply does not exist," and that to his knowledge, "we don’t have any record of assaults occurring in our restrooms."

He later apologized for the system not providing a safe environment for students.

"First, let me say to the families and students involved — my heart aches for you and I am sorry that we failed to provide the safe, welcoming, and affirming environment that we aspire to provide," he said.

The email revelation has since sparked calls for Ziegler and the school board to step down, including from Republican gubernatorial candidate Glenn Youngkin.

"It's outrageous," Youngkin told Fox News on Saturday. He said the email "simply confirms what we know, which is we had administrators at a school board who have been covering this up. I mean, they tried to hide it from parents, they've hidden it from the public, and they actually endangered students by moving this young man – who in fact was being prosecuted for a sexual assault in another school – and enabled it to happen again."

Garland Doubles Down on Targeting Parents

Testifying in front of the Senate Judiciary Committee Wednesday morning, Attorney General Merrick Garland refused to retract a memo, prompted by a complaint from the National School Boards Association, to target concerned parents with federal law enforcement.

Late last week the NSBA apologized for the letter, where parents were classified as domestic terrorists worthy of Patriot Act scrutiny, that prompted Garland's actions. Regardless, DOJ will move forward.

He kept referring to violence. Did I miss something? Which parental violence? The only violence I’m aware of is the dad being arrested because he was upset the school administration was concealing his daughter’s rape. That was violence to a parent, not from a parent.
