Dumb bitch turned an $80 ticket into an $8K court/attorney fees bill. Plus her bond.

Lets see.....traffic infraction, resist/delay obstruct, felony flee and elude, assault on LEO......$25K Bond if she was in front of me.

After watching it again, there actually was a point where he could have de-escalated the situation.
When she said "Oh, just give me that and I'll sign it". And he said "We're beyond that now... "
He could have said "Now you're being reasonable. I thought I was going to have to take you to jail" and just let her sign the ticket.



He placed her under arrest at 0:33, and she finally said "I'll sign it" at 1:04. By this point, the $80 tail light fine had been overshadowed, and she was actively resisting arrest.

'De-escalation' was no longer a point. Or, was he supposed to ignore her resisting arrest and just let her go?

Is there a provision in the law that indicates I can ignore lawful orders "because I don't want to be arrested?"


...still waiting for a reasonable alternative option to the officer's actions...


Not to mention when you arrest someone (you say those magic words) you can’t just unarrest them and send them on their way. Once a person is in custody, they are the officers responsibility. If he let her go (unarrest) and she goes half mile down the road and runs into a water buffalo, the department will be sued because she was in custody and he let her go when she should have been in custody.

Some people just have to learn the hard way. Just because she is old does not give her the right to decide what laws she will or will not obey. Could you imagine the anarchy that would cause for us as a nation? She then exacerbated the problem by trying to take off. She got what she deserved, plain and simple.

And, as I was led to understand it, if the officer said “those magic words” and then, when the detainee had a change of heart and signed the ticket and the officer doesn’t go through with the arrest, it could be used in court as an example of extortion and not only would the original charge be dropped but the officer could be charged with extorting the defendant.

C'mon man, I didn't miss it when I watched it. I pointed out the time for those who may have missed it. I also read it on the first page as I read through the entire thread as it developed. She earned every bit of her problem.

A quick search for "kick" yields a result on pages 1, 3, and 4 before this page. I guess it was pretty apparent to me in the first few viewings so I was honestly having a hard time understanding how so many of the comments to the videos on youtube and even some here managed to miss it, but it's her last act before he backs up and pulls the tazer out. I guess I was more focused on what she was doing than what he was doing.

It's very hard to see in the video, so here's a screen grab. At 1:44 you can see her foot coming up. In the next couple frames actual contact is made just off screen, but you can tell where it was headed.

Too bad the officer didn't have the benefit of watching frame by frame video before deciding what to do. I'm always amused at the level of scrutiny applied after the fact. Society now requires perfection on demand and anything less is considered incompetent or illegal. No wonder police departments can't hire anyone these days.
