Incapacitation by taser is far more preferable to taking teeth in a Dixie cup to the oral surgeon.

Agreed. I think she had it coming. No different than some young ruffian pulling the same disrespectful shit.

The bottom line is she was taken to the ground, tased, and arrested incident to fleeing the police and resisting.

Had that requirement not existed, the officer could have given her the ticket and been on his way.
If she didn't appear in court, a bench warrant could be issued at that time.
The situation was escalated beyond what it should have been.
The bottom line as I see it was that an old lady was taken to the ground, tased, and arrested incident to a broken taillight.
Lotsa blame to go around here.

Clearly, he did not believe her.
If he did, he might have given her a warning and told her to get it fixed. He may have pulled the same woman over previously. Who knows?

in the beginning around 14 to 18 seconds he said to her "you've been driving around like that for 6 months" or something like that...

I think she told him that she knew about it and had been driving around like that for 6 months. She even said something about getting a warning because she was honest about it.

No fucking way. It is certainly true that you could have a system where you don't have to sign the ticket, but I have been asked to sign every ticket I ever got in several jurisdictions. And maybe they have learned that making people sign makes them more likely to show up. I don't know why some require signing the ticket, but it isn't important here.

Never in my life have I ever had to sign a traffic ticket.

Seems pretty darn stupid to me and probably everyone else who's ever simply been handed a ticket and then sent on his way.

Y'all think the cop gets to make up these rules? IT'S THE LAW in some areas, probably most. Stupid it may or may not be, but it is the law.

It isn't "probably." She didn't decide, at the age of 65, for the very first time, to get mouthy with an authority figure and simply refuse to comply. I guaranty this has been her mode of behavior for a long time.

And what is the cop to do? Just decide that anyone who doesn't want to be arrested, and then to run, and then to fight with the cops can get away with it? That is the road to anarchy.

I wasn't clear, and that is my fault. It is in this circumstance that I can't entertain that this is a bad rule. It is the rule there, and in the context of this violation I am not going to give her a pass because the sign-the-ticket rule is a bad rule.

If we go back to the legislature, I might be perfectly willing to change the rule. But the roadside is not the place to have that conversation, and at that time and place, I will not listen to complaints that it is a silly rule.

As far as him not cutting her a break because of her age, I think I could see that side of it if she appeared confused or scared due to her age, but that woman appears to be just an ornery bitch who thought she was going to call the shots.

When did people decide that they are in control when the have an interaction with a police officer, and can do whatever the hell they want?

Its time for the courts to start cracking down on these idiots with really creative punishments.

It's time to put order back in law & order.

I don’t usually weigh in on LEO themed threads, but I’m with those who feel the driver got what she deserved in this case. Damn, I wasn’t raised to disrespect LEO’s and I cant imagine my parents ever acting that way in a similar situation.

In just about every state in the union, if there is reason to believe that you won’t show in court you get hooked on the spot. Whether you sign or you don’t need to sign.

What is the big deal about signing the ticket? If it's like Ohio, the area you are signing specifically states that you are not pleading guilty, you are only acknowledging receipt. There is a separate line to sign if you want to plead guilty and mail in your fine, assuming it does not require a court appearance.

Don't care how old you are. If you act like a fucking idiot like this moron did, you deserve exactly what you got. Ooh, I'm so special because I'm elderly. Roll Eyes

The elderly, they always seem so harmless, right? Man, released from prison after being deemed too old to be a threat, convicted in another killing

I get that she deserved it. I guess I am putting it in this reference:
What if it were my mother?
and--I'll bet if it were the officer's mom, she would have been treated differently.
She was unreasonably mouthy and combatative, no argument.
I just think it could have been handled better- and no one supports the police as much as I do, having been one myself.

BTW, can any of you officers confirm/deny whether an arrestee who is given an appearance ticket in lieu of custody signs the appearance ticket? I am not sure how NY handles this.

Good discussion.
