I just wish the judge had ruled on the funding aspect. If she found Smith lacked duly appropriated funding, it would follow Smith would have violated the Anti-Deficiency Act. As it is, since Smith’s appointment was illegal, he should be required to repay his entire compensation package, as he received it when he was NOT a federal employee.
