Judge Orders United Airlines Not to Put Workers Seeking Vaccine Mandate Exception on Leave

A federal judge on Tuesday ordered United Airlines not to place workers seeking an exemption to the company’s COVID-19 vaccine mandate on unpaid leave.

The temporary ruling was issued by U.S. District Judge Mark Pittman so workers who filed for an exemption aren’t unduly harmed before he can hear oral arguments in the case.

Six United workers sued the company last month over its plans to put on leave any employees who requested religious or medical exemptions. The suit said the employees were effectively told they’d be terminated if they sought exemptions and alleged that the company was violating Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act, or ADA.

“United’s actions have left Plaintiffs with the impossible choice of either taking the COVID-19 vaccine, at the expense of their religious beliefs and their health, or losing their livelihoods. In doing so, United has violated Title VII and the ADA by failing to engage in the interactive process and provide reasonable accommodations, and also by retaliating against employees who engaged in protected activity,” the suit states.

United and the plaintiffs reached an agreement that the company would not place exempted employees on leave during a Sept. 24 hearing, Pittman said, obviating the need for an immediate ruling. He planned to hear arguments on a motion for a preliminary injunction on Oct. 8 but United the day before the hearing filed a partial motion to dismiss, alleging the court lacked jurisdiction over some of the claims.

The hearing was reset to Oct. 13. Ahead of the arguments, Pittman said he concluded it was necessary to issue a temporary restraining order that is effective through Oct. 31.

Absent entry of the order, “the parties’ stipulation will expire before the Court can rule on whether a preliminary injunction is warranted,” the Trump nominee wrote.

“If the parties’ stipulation were to expire without temporary injunctive relief in place, nothing would prevent hundreds of workers from ostensibly either: (1) being compelled to take a vaccination in violation of their religious beliefs or medical restrictions, or (2) being placed on indefinite unpaid leave by United,” he added.

United said earlier this month that 320 workers in the United States, or 0.5 percent of the U.S. workforce, were not in compliance with its COVID-19 vaccine mandate.

United told news outlets after Pittman’s order that “vaccine requirements work and nearly all of United’s U.S. employees have chosen to get a shot.”

“For a number of our employees who were approved for an accommodation, we’re working to put options in place that reduce the risk to their health and safety, including new testing regimens, temporary job reassignments, and masking protocols,” the airline said.

Mark Paoletta, an attorney representing the plaintiffs, told The Epoch Times in an email that United’s “refusal to provide reasonable accommodations to its vaccine mandate violates the federal civil rights protections of our clients, the hard working men and women at United,” adding, “We look forward to our clients’ rights being permanently protected.”

I’m chatting with an Intel employee now. He verified that there’s no requirement yet, but they are not recognizing antibody tests as a vaccination substitute. That was discussed in a conference call.

Report – OSHA Sends Worker Vaccine Mandate Rule to White House for Review

Several news outlets (Bloomberg below) are noting the Department of Labor, Occupational Safety and Health Administration (OSHA), has submitted the worker vaccine rule to the White House for review prior to publishing as an ’emergency temporary standard’.

While this may be seen as disappointing by many, the moment the rule hits the federal register, it will be subject to lawsuits before implementation. Until the DoL/OSHA rule hits the books, the mandate is nothing except a statement of intent.

Once the emergency rule is put into the register, then various state attorneys general and private sector employers or employees will be able to seek injunctions and challenge the legality. Florida Governor Ron DeSantis stated yesterday his legal team is awaiting the rule to be published to trigger his state’s legal challenge.

(Bloomberg) […] The standard implements the president’s Sept. 9 order for a regulation requiring businesses with at least 100 employees to mandate workers get fully vaccinated or be tested weekly for Covid-19. Biden also asked for the rule to provide paid time off for workers to get vaccinated and to recover from any side effects.

An emergency standard bypasses what is normally a years-long regulatory process. To do so, OSHA must establish that the vaccination or testing requirement was necessary to protect workers from a “grave danger.”

“The Occupational Safety and Health Administration has been working expeditiously to develop an emergency temporary standard that covers employers with 100 or more employees to ensure their workers are fully vaccinated or undergo weekly testing to protect employees from the spread of coronavirus in the workplace,” a DOL spokesperson said in an email. “On Tuesday, October 12, as part of the regulatory review process, the agency submitted the initial text of the emergency temporary standard to the Office of Management and Budget.”

In my mind once you exempt certain classes of employees (congress, the legislative branch, the postal service union for example) it absolutely cannot be about protecting people from a "grave danger". If it was these people would not be exempted based their job description.

Data out of the UK shows people over the age of 30 who received two doses of the Covid-19 vaccine contracted the Covid-19 virus at higher rates than those who were unvaccinated.



The anomaly appears in data from the UK Health Security Agency’s Covid-19 vaccine surveillance report documenting recent Covid case counts.

According to the data, Covid case counts diverge between the vaccinated and unvaccinated around age 30, with less unvaccinated people being infected with Covid (738.4) than vaccinated people (763.6).

Alarmingly, the Covid infection rate more than doubles around the age of 40, with vaccinated people accounting for 1,281.8 cases, while unvaccinated 40-year-olds only reported 690 cases.

The trend of Covid infections despite double-vaccination continues into age groups past 49, with older age groups showing a similar pattern.

The data, which seemingly disproves the “vaccines work” narrative, caused distress on social media, with many blaming mandatory government vaccination schemes for spreading the very virus they claim to want to stop.

Two Children ‘Accidentally’ Given COVID-19 Vaccines At Walgreens, BOTH Now Suffering From ‘Heart Issues’ – Lawyer

Two young children were “accidentally” given the COVID-19 vaccine instead of flu shots at a Walgreens in Indiana according to local media. Now, both are experiencing “heart issues,” according to their pediatrician.

A family in Evansville, Indiana went to a local Walgreens to have each member, including two young children, receive a flu shot. During the appointment, all members of the party including the two children were “accidentally” given full adult does of the Pfizer COVID-19 vaccine, according to the family’s lawyer. The children, four and five years old, were born in 2016 and 2017, as revealed by the vaccination cards provided to the family by Walgreens.

After the alleged vaccine mix up, both children are now experiencing signs of “heart issues,” according to their pediatrician. The younger child is sick with a cough and fever, according to the report by KWTX.

Myocarditis, a heart condition involving fluid accumulating near the heart, has been found to be a rare side effect of the Pfizer vaccine but seems to grow more common in younger male individuals. Adverse reactions to the vaccines seem to become far less likely the older the person who receives it becomes, according to current medical research.

“The family said they left the pharmacy thinking they had received their flu shots, but a Walgreens employee later called them and said they had made a mistake. The local news agency attempted to get comment from Walgreens regarding the matter, but has not received a response. This comes as the pharmaceutical giant Pfizer is seeking to gain FDA emergency use authorization to vaccinate children ages 5-11, according to multiple reports.

As National File reported, a recently-released CDC data set detailing provisional COVID deaths by age from January 1st, 2020 to September 15th, 2021 appear to show that less child deaths were linked to COVID in that time-frame than would have died from the flu in a typical year.

This article was amended to note both children are now reported to be suffering from heart issues.

You're too far ahead. Back up a bit and consider. If workers were at such 'grave danger', why is this OSHA rule only now being implemented, eight plus months after Mr. Potato Head was sworn in and while Covid cases are trending substantially downward nationwide. Any attorney worth their salt should be able to blow up this mandate on that one item alone. This mandate could have been rushed through and implemented within thirty days of Slo Joe's reign of stupid if it was actually a priority.

After threatening to fire public school teachers who are not vaccinated by this Friday, Chicago’s Democratic-run city government has backed down and will allow those who have rejected the problematic abortion-tainted COVID-19 vaccine to continue employment if they agree to weekly testing.

In August, Mayor Lori Lightfoot announced that all Chicago Public School (CPS) employees would be required to provide proof that they are fully vaccinated by October 15 or face losing their jobs.

While the city promised that those able to obtain medical or religious exemptions would be permitted to continue employment, the city’s Catholic archbishop, Cardinal Blase Cupich, banned pastors from providing religious exemption letters for parishioners, claiming that exemptions are not supported by Church teaching or law.

“Employees will not be barred from coming to work,” said CPS head Pedro Martinez. “We’re going to just work with them to see where they’re at in the vaccination process, what hesitation they might have, what information we can give them … I feel fairly confident that we’re going to be ok.”

Easing of the strict policy came after the Chicago Teachers Union (CTU), joined by the two Service Employees International Union (SEIU) groups representing support staff in the school district, wrote a letter on Wednesday to Lightfoot asserting that it is unfair for her to have relaxed vaccine requirements for other city workers while not doing the same for CPS employees who are “disproportionately Black and Latinx women.”

“This disparate enforcement of the vaccine policy will leave schools dangerously understaffed, and disproportionately impact employees of color within CPS,” wrote the Unions. “Surely, you are also aware of the reluctance to vaccination that exists in Black and Brown communities, which is justified in the context of our nation’s history.”

“Punitive enforcement of the vaccination policy in its current form will be ineffectual and will further destabilize already understaffed schools,” they warned. “Understaffed schools are unsafe schools. We urge you to avert this dangerous situation by refraining from punitive enforcement of your vaccine policy for CPS staff.”

In their letter, the school employee unions — historically aligned with the most progressive elements in the Democratic Party — went out of their way to stir racial discord in their criticism of the city’s police union whose leader has urged members to resist the mayor’s COVID-19 vaccination mandate:

It seems inconceivable that you would move to accommodate some workers, including the predominantly white male workforce at the Chicago Police Department whose union has actively opposed the vaccine policy, while your team at CPS seems intent on simply barring from work Black and Brown workers who confront very different challenges in meeting vaccine mandates. These challenges include concerns about the historic harm that medical mistreatment has caused communities of color, to lack of access to shots and reliable information about the vaccine and how to get it.

Chicago police risk layoffs while standing firm against city vaccine-associated mandates
On Tuesday, the president of the Chicago police officer’s union posted a video advising members not to comply with the city’s COVID-19 vaccine reporting mandate.

Fraternal Order of Police (FOP) head John Catanzara noted in the video that police and other city workers would be forced “into a no-pay status” and be sent home on Friday for not entering required information on the mandated vaccine portal.

“Do not fill out the portal information,” Catanzara told union members,” or “subject to testing thereafter.”

“Once you do that, we can never get that information back,” said Catanzara. “We have no assurances from the city that that is secure,” or “who it can be shared with.”

“I’ve made my status very clear as far as the vaccine, but I do not believe the city has the authority to mandate that to anybody let alone that information about your medical history,” he said.

“Hold the line,” urged Catanzara. “The simple fact that they keep putting out public statements, emails, and having bosses call you means one thing: Our members are holding the line.”

“If we get a large number of our members to stand firm on our belief that this is an overreach, and they’re not going to supply the information in the portal or submit to testing, then it’s safe to say that the city will have police force at fifty percent or less for this weekend coming up.”

“I can guarantee you that no-pay status will not last more than 30 days,” said Catanzara in the video. “There’s no way they’re going to be able to sustain a police department workforce at 50% capacity or less for more than seven days without something budging.”

That just applies to Omaha I would presume. It is possible that a local priest was handing out thousands of letters. I have no way of knowing.
