I would assume that neither party officially submits the name of its candidate until after the conventions. If that's the case, the Dem convention would seem to be the scene of the upcoming ambush.


Yes, after the conventions, the parties submit the names of their nominees to the various state officials in charge of the elections.
At that point the countdown begins for the states to get ballots printed and election materials printed.
I believe that Texas is first and their cutoff is one week after the end of the convention. Many others follow closely after Texas.

So if it is to be done, it must be done close to the convention end. That is why the pundits say that the convention is the magic cut off.
Similar constraints restrict third party candidates.

No problem. If they miss the cut, they'll just sue, claim the rules are unfair, deprive voters of Constitutional rights, and force Texas, and any other state with the temerity to not bend to their will, to reprint ballots.

If I was Bernie, I wouldn't take this lying down. I'd raise a real stinker at the convention if the DNC try to swap Biden or anyone else in. I'm the runner up. If the witch is disqualified, I should be the one ascending to the DNC throne.


It may be that once the nominee is chosen at the convention, if that nominee is disqualified for any reason, the party is free to replace with whoever they want.

^^^^Only in NJ, seriously, an indictment is not legally disqualifying but it would be a tremendous negative burden to bear and I doubt the Dems would be willing to take the chance .
I seriously doubt that there would be time for a trial and conviction assuming Hillary is indicted in June or July. She would try to stay in, but pressure would be brought to bear and I imagine she would withdraw.

The Dems doubtless would attempt to get state cut-off dates changed, but it would require a lot of state actions in unfriendly courts and be a big distraction at peak election time.

After the State Department's computer spam filters apparently prevented Clinton from sending a message to all department employees from her private server, Abedin suggested that she either open an official agency email or make her private address available to the agency.

Clinton told Abedin she was open to getting a separate email address but didn't want "any risk of the personal being accessible." Clinton never used an official State Department address, only using several private addresses to communicate. Abedin, Mills, Sullivan and Reines all also used private email addresses to conduct business, along with their government accounts.

Two other emails sent to Abedin were cited in the inspector general's report, but also did not turn up among the emails released by Clinton. Those messages to Abedin contained warnings in January 2011 from an unidentified aide to former President Bill Clinton who said he had to shut down Hillary Clinton's New York-based server because of suspected hacking attacks.

In response, Abedin warned Mills and Sullivan not to email Clinton "anything sensitive" and said she would "explain more in person."
