You know his outfit is tacky, but his haircut appears regulation.LOL This is more characteristic of Secret Service guys. Maybe there is a position on the Clinton detail. He could be a celebrity guest on Dance Fever. They even had Dick Butkus as a judge, he REALLY cannot dance. There was the story last year of the young FBI agent who was carjacked at a gas station in Chicago. The car was found several days later when it collected a parking ticket. The story then disappeared from the media. I have a feeling this story has more staying power. | |||

It is unlawful to possess a firearm while under the influence of alcohol or controlled substances. Now let's have equal application of the law. Likely while sober this FBI agent thought it was wise to small of the back carry to a crowded dance club, "Mile High Spirits". The decision to have the first alcoholic drink was made while sober and carrying a loaded weapon. The decision to do a backflip while carrying a loaded firearm in the small of the back was likely made while under the influence of alcohol. The decision to retrieve the weapon, while wrapping a finger around the trigger was made while under the influence. So, if you don’t mind, what exactly are the “same charges” that the average citizen would face? Specific statues, please. What are the specific charges, as they apply to this situation that the “average citizen” would be charged with? And the legal justification of why by statue. | |||

It occurs to me the agent's consequences may be even greater than the average citizen. He will likely lose his job and career. He will at least lose his potential in that career. Well, we're all assuming he had a few drinks (assuming because no where in the article did it mention that he was intoxicated or even had a single drink), but given the circumstances that seems a very likely assumption. If you or I had negligently discharged a firearm while intoxicated in a public place causing injury to another person, wouldn't we face at least revocation of our license and even possibly jail time? Cannot imagine a sober guy acting as this FBI agent did. Therefore I believe this is a place to start in regards to illegalities of his actions. C.R.S. 18-12-106 Prohibited Use of Weapons (1) A person commits a class 2 misdemeanor if: (d) The person has in his or her possession a firearm while the person is under the influence of intoxicating liquor or of a controlled substance, as defined in section 18-18-102 (5). Possession of a permit issued under section 18-12-105.1, as it existed prior to its repeal, or possession of a permit or a temporary emergency permit issued pursuant to part 2 of this article is no defense to a violation of this subsection (1). Not a lawyer but, I think this comes into play as well. C.R.S. 18-12-107.5 Illegal discharge of a firearm - penalty 1) Any person who knowingly or recklessly discharges a firearm into any dwelling or any other building or occupied structure, or into any motor vehicle occupied by any person, commits the offense of illegal discharge of a firearm. (2) It shall not be an offense under this section if the person who discharges a firearm in violation of subsection (1) of this section is a peace officer as described in section 16-2.5-101, C.R.S., acting within the scope of such officer's authority and in the performance of such officer's duties. (3) Illegal discharge of a firearm is a class 5 felony. Should have been armed off duty. May or may not have been an "agency approved" bar. Other than the police investigation___there will be a bureau investigation. Either way___ the bureau will "frown" on this. What's all this "anti FBI agent" stuff? For sure his weapon wasn't secured well. Stay safe Poli Viejo | |||

Crap like this is why we have a strict policy on off duty carry. Holsters have to be approved or you can't carry it. It's got to have some type of retention. Can't drink while armed. etc. Not minority enough! | |||

I think if you are fortunate enough to be able to become an FBI agent you should be held to a HIGHER standard than the general public. The behavior displayed by this guy is inexcusable. The politics in Washington do not make things any easier. He shows a lack of basic common sense and judgement. | |||

Yes, jobs come with different levels of expectations. Those jobs with authority over others comes with higher responsibilities and expectations. Likewise jobs with higher risk of injury to others also come with higher expectations. As an FBI agent, this gentleman should have known better. As I noted earlier he was likely sober when he started down the path to this negligent discharge.
