DOJ tries to jail key Hunter Biden witness Devon Archer on eve of congressional testimony

The Justice Department is pushing for Devon Archer to report to prison — just days ahead of the former Hunter Biden business partner’s hotly anticipated congressional testimony, according to new court documents.

Manhattan federal prosecutors on Saturday filed a letter requesting a judge set a date for Archer to start his one-year sentence in a fraud case unrelated to the first son’s various scandals.

The request came after the Second Circuit Court of Appeals affirmed Archer’s 2018 conviction last Tuesday on two felony charges for his role in a conspiracy to defraud a Native American tribe.

Archer — who is set to deliver closed-door testimony to the House Oversight Committee on Monday about Biden — had been challenging the conviction.

His attorney, Matthew Schwartz, said he would be filing a formal response to the request from the US Attorney’s Office by Wednesday — and noted that his client would still testify as planned despite allegations the DOJ letter was an intimidation tactic.

“We are aware of speculation that the Department of Justice’s weekend request to have Mr. Archer report to prison is an attempt by the Biden administration to intimidate him in advance of his meeting with the House Oversight Committee,” Schwartz said in a statement, per Politico.

“To be clear, Mr. Archer does not agree with that speculation,” Schwartz added. “In any case, Mr. Archer will do what he has planned to do all along, which is to show up on Monday and to honestly answer the questions that are put to him by the Congressional investigators.”

This guy ducking the committee three times suggests he's not going to roll over. If he were he'd of testified back in June when his first appearance was scheduled. It's possible he needed the extra time to figure out a way to navigate through while reducing legal exposure. Or, he will just take the Fifth when needed. I don't expect this guy will drop anything big.

Now is Hunter dirty? Yup. Without a doubt. He violated a federal gun law. He has admitted to illegal drug use, and a pension for prostitutes. He violated tax law, and he didn't register as a foreign lobbyist while he was bringing home bags of cash. Is the government trying to protect him? Yes, without a doubt. Is the government unfairly targeting an ex-president? Yes, they are.

Here's where things start to get murky. The Biden family set up a labyrinth of shell corporations to hide or launder those bags of cash. Now if you want to prove illegality on the part of Joe Biden you have to do two things. 1. Account for the money. 2. Quid pro quo. To address Flashlight Boy's point I haven't seen anything close to actual proof yet.

But, we have plenty of political mud to sling. So sling away to the very best of your ability. And may it result in fortune on election day.

Archer’s counsel, according to the DOJ letter, said it was “premature” to set a sentencing date because Archer was considering further appeals and intended to raise an “error” in the sentencing process. Archer’s lawyer plans to file a response to the U.S. attorney’s demands by Wednesday.

Axios.com reported Monday:

President Biden’s team recently split with the Democratic Party’s longtime lawyer, Marc Elias, because of disagreements with Elias’ legal strategies and strained personal relationships, according to several people familiar with the dispute.

Why it matters: The divorce has created a divide in the party’s legal apparatus going into the 2024 election — with Elias representing Democrats’ committees for House, Senate and state legislative races, while Biden’s campaign and the Democratic National Committee mostly get legal help elsewhere.

Axios describes various differences in strategy and style between Elias and Biden lawyer Bob Bauer. It does not mention any of Elias’s past controversial roles.

Elias has long been notorious for challenging election results, dating back to Al Franken’s win over incumbent Republican Senator Norm Coleman in 2008 — a race that tipped the Senate toward a filibuster-proof majority for Democrats. He is also a frequent guest on MSNBC, attacking and mocking Republicans’ election challenges.

In 2017, the Washington Post revealed that Elias, who was then working for the Democratic Party0aligned Perkins Coie law firm, hired Fusion GPS, an opposition research firm, on behalf of Hillary Clinton’s campaign and the Democratic National Committee to prepare the so-called Russia “dossier.” That, in turn, helped launch an FBI investigation and fueled media conspiracy theories that sought to overturn the 2016 election.

Elias split with Perkins Coie shortly before he became a key witness in the trial of former Hillary Clinton campaign lawyer Michael Sussmann. He admitted he had discretion to direct Fusion GPS’s efforts. Sussmann was acquitted by a District of Columbia jury in what some observers called an act of “jury nullification”: Trump is simply so hated inside the Beltway that he and his supporters are presumed guilty, and his opponents are presumed innocent.

In 2020, Elias helped lead Democratic Party efforts to challenge voting laws to allow for universal vote-by-mail, using the coronavirus pandemic to accelerate a strategy the party had begun to embrace in an effort to turn out their voters in higher numbers. Ironically, he also led efforts to challenge election results when Democrats lost, and even claimed in one case that voting machines were to blame.

In 2021, Elias was sanctioned by the Fifth Circuit for filing a nearly identical motion to one that had been rejected and ordered to complete a new course in legal ethics.

Elias isn't stepping out of Democrat politics but rather he's not going to be a front man for Biden. My guess is that he'll be behind the scenes still pushing his shenanigans and BS, all in an effort to get Dems elected or reelected. He can go dark and work it that way.

House Oversight Committee Chairman James Comer said Devon Archer confirmed in his appearance Monday that President Biden "lied to the American people when he said he had no knowledge about his son’s business dealings and was not involved."

Comer’s comments come after Archer, a former business associate and longtime friend of Hunter Biden, sat for hours before the House Oversight Committee in a closed-door hearing Monday.

Archer said that Hunter put his father, then-Vice President Joe Biden, on speakerphone while meeting with business partners at least 20 times. Archer described how Joe Biden was put on the phone to sell "the brand."

"Joe Biden was ‘the brand’ that his son sold around the world to enrich the Biden family," Comer said. "When Joe Biden was Vice President of the United States, he joined Hunter Biden’s dinners with his foreign business associates in person or by speakerphone over 20 times."

"When Burisma’s owner was facing pressure from the Ukrainian prosecutor investigating the company for corruption, Archer testified that Burisma executives asked Hunter to ‘call D.C.’ after a Burisma board meeting in Dubai," Comer continued.

"Why did Joe Biden lie to the American people about his family’s business dealings and his involvement?" He asked. "It begs the question what else he is hiding from the American people."

Archer also testified that "Burisma would have gone out of business if ‘the brand’ had not been attached to it."

Archer said he believed that Hunter Biden being on the board and the "Biden brand" contributed to Burisma’s longevity, according to Comer’s office, and suggested that people would have been "intimidated to mess with Burisma legally because of the Biden brand."

Rep. Andy Biggs (R., Ariz.), a member of the House Oversight and Accountability Committee, said Archer testified that only pleasantries were exchanged when Joe Biden was on the phone with his son during meetings. Still, Biggs said that he was confident that the testimony implicated Biden in his son’s business activities.

“People would be intimidated to legally mess with Burisma because of the Biden family brand,” Biggs said Archer testified.

Yesterday was great! The story has changed from The Big Guy never talked to Hunter's business associates to it would have been rude for him not to say hello to people. I'm hearing Tony Bobulinski is going to testify soon. If you recall, he claims he met with The Big Guy. These are good days.
