Kudos to VA 2nd amendment supporters. I see the VA Senate plans to block another Gov supported anti-gun bill. A few Dems decided they didn’t want it.

I think that rally in Richmond got the attention of a few.

I attended yesterday's Judiciary Committee Hearing. One piece of testimony against SB581 was especially effective. A farmer said, "Here's something from the real world," and related to the committee how his son came home from school to find a pack of wild dogs attacking his livestock. The son retrieved a rifle and shot the dogs. Hard to visualize charging the father with a felony for that.

There were other pieces of good news. Some bad bills were continued to 2021, meaning they are dead for the year:

SB13, banning firearms on Capital Square.
SB15, carrying firearms into buildings owned or leased by the Commonwealth
SB353, onerous restrictions on outdoor ranges. I showed up to talk about this one.
SB490, banning possession following certain convictions

Some bad bills got through:

SB14, trigger activators, basically codifies the current ATF rule banning bump stocks
SB64, penalty for paramilitary activites, was modified so that there is a penalty only if brandishing occurs. So if you have a bunch of guys standing in the street with rifles, no problem. They have to do an overt act, that is, brandish their rifles, for it to be a penalty. Not a win, but definitely better than the original text!
SB71, firearms on school property, extended prohibition to private and religious schools and day cares.
SB436, voluntary do not sell firearms list. Hard to get excited about this one, since I won't volunteer!
SB684, involuntary commitment and restoration of firearms rights.

Two bills weren't heard yesterday for lack of time:

SB67, reporting lost or stolen firearms.
SB543, mandatory background checks at gun shows.

Overall, our side batted .500 yesterday. Not bad, considering the circumstances!

Two bills weren't heard yesterday for lack of time, and will be heard tomorrow afternoon after the Senate adjourns. They are the last of the Senate gun bills for this year:

SB67, reporting lost or stolen firearms.
SB543, mandatory background checks at gun shows.

These could go either way.

The current proposed ban on “large-capacity firearm magazines” in Virginia (proposed section 18.2-308.10) includes an exception for magazines “permanently altered so that it cannot accept more than 12 rounds of ammunition.” Does such a thing even exist today (in other words, how easy is it to convert a 10-round mag sold in Massachusetts, for example, to the standard 15)?

It appeared the great majority were wearing GSL stickers. It was expected to pass committee; now let's wait and see what the full House and then the Senate do with it.

Yeah, i have been trying to parse through it. It seems I was wrong above. So a simple plug is insufficient.

Trigger activators

484 § 18.2-308.12. Import, sale, possession, etc., of trigger activators prohibited; penalty. 485 A. Disposition of Magazines and Trigger activators

492 A. Except as provided in subsection B, any person who legally owns a large-capacity firearm
493 magazine, as defined in § 18.2-308.10, or trigger activator, as defined in § 18.2-308.12, on July 1, 2020,
494 may retain possession of such large-capacity firearm magazine or trigger activator until January 1, 2021.
495 During this time period, such person shall (i) render the large-capacity firearm magazine or trigger
496 activator permanently inoperable; (ii) remove the large-capacity firearm magazine or trigger activator
497 from the Commonwealth; (iii) transfer the large-capacity firearm magazine or trigger activator to a person
498 outside the Commonwealth who is not prohibited from possessing the large-capacity firearm magazine or
499 trigger activator; or (iv) surrender the large-capacity firearm magazine or trigger activator to a state or
500 local law-enforcement agency.
501 B. Any person who legally owns a large-capacity firearm magazine or trigger activator on July 1,
502 2020, and who, on January 1, 2021, (i) is serving outside of the United States in the armed services of the
503 United States, (ii) is serving outside of the United States as a member of the diplomatic service of the
504 United States appointed under the Foreign Service Act of 1946, (iii) is serving outside of the United States
505 as a civilian employee of the United States government or any agency or contractor thereof, or (iv) is a

506 spouse or dependent of any person listed in clause (i), (ii), or (iii) may retain possession of such large-
507 capacity firearm magazine or trigger activator until 30 days from the date such person is no longer serving
508 outside of the United States. During this 30-day period, such person shall comply with clause (i), (ii), (iii),
509 or (iv) of subsection A.
510 C. The provisions of § 15.2-915.5 shall not apply to any large-capacity firearm magazine or trigger
511 activator surrendered to a local law-enforcement agency pursuant to this section.

394 conspicuously beneath the action of the rifle; (iii) a second handgrip or a protruding grip that can be held
395 by the non-trigger hand; (iv) a grenade launcher; (v) a flare launcher, (vi) a silencer; (vii) a flash
396 suppressor; (viii) a muzzle brake; (ix) a muzzle compensator; (x) a threaded barrel capable of accepting
397 (a) a silencer, (b) a flash suppressor, (c) a muzzle brake, or (d) a muzzle compensator; or (xi) any
398 characteristic of like kind as enumerated in clauses (i) through (x).
399 3. A semi-automatic center-fire pistol that expels single or multiple projectiles by action of an
400 explosion of a combustible material with a fixed magazine capacity in excess of 12 rounds;

408 accepting (a) a silencer, (b) a flash suppressor, (c) a barrel extender, or (d) a forward handgrip; or (vii)
409 any characteristic of like kind as enumerated in clauses (i) through (vi).
410 5. A shotgun with a revolving cylinder that expels single or multiple projectiles by action of an
411 explosion of a combustible material; or
412 6. A semi-automatic shotgun that expels single or multiple projectiles by action of an explosion of
413 a combustible material that has one of the following characteristics: (i) a folding or telescoping stock, (ii)
414 a pistol grip that protrudes conspicuously beneath the action of the shotgun, (iii) the ability to accept a
415 detachable magazine, (iv) a fixed magazine capacity in excess of seven rounds; or (v) any characteristic
416 of like kind as enumerated in clauses (i) through (iv).
417 "Assault firearm" includes any part or combination of parts designed or intended to convert,
418 modify, or otherwise alter a firearm into an assault firearm, or any combination of parts that may be readily
419 assembled into an assault firearm. "Assault firearm" does not include (i) a firearm that has been rendered
420 permanently inoperable, (ii) an antique firearm as defined in § 18.2-308.2:2, or (iii) a curio or relic as
421 defined in § 18.2-308.2:2.
422 B. It is unlawful for any person to import, sell, transfer, manufacture, or purchase an assault
423 firearm, provided that a person may transfer an assault firearm to another person if:
424 1. The transfer is a bona fide gift made by or to a member of a transferor's immediate family as
425 defined in § 6.2-1300;
426 2. The transfer occurs by operation of law;
427 3. The person receiving the assault firearm is an executor or administrator of an estate or is a trustee
428 of a trust created by a will, and the assault firearm to be transferred is property of such estate or trust;

429 4. The transferor is an executor or administrator of an estate or is a trustee of a trust created by a
430 will, and the assault firearm to be transferred is the property of such estate or trust;

432 6. The transfer is temporary and occurs within the continuous presence of the owner of the firearm;
433 7. The sale or transfer of an assault firearm is to an authorized representative of the Commonwealth
434 or any subdivision thereof as part of an authorized voluntary gun buy-back or give-back program;
435 8. The transfer is of an antique firearm as defined in § 18.2-308.2:2; or
436 9. The transfer occurs at a shooting range, shooting gallery, or other area designated for the purpose
437 of target shooting, for use during target practice, a firearms safety or training course or class, a shooting
438 competition, or any similar lawful activity.
439 C. A violation of this section is punishable as a Class 6 felony.
440 D. The provisions of this section shall not apply to (i) any government officer, agent, or employee,
441 or member of the Armed Forces of the United States, to the extent that such person is otherwise authorized
442 to acquire an assault firearm and does so while acting within the scope of his duties; (ii) the manufacture
443 of an assault firearm by a firearms manufacturer for the purpose of sale to any branch of the Armed Forces
444 of the United States or to a law-enforcement agency in the Commonwealth for use by that agency or its
445 employees, provided that the manufacturer is properly licensed under federal, state, and local laws; (iii)
446 the sale or transfer of an assault firearm by a licensed dealer to any branch of the Armed Forces of the
447 United States or to a law-enforcement agency in the Commonwealth for use by that agency or its
448 employees; (iv) the purchase by any person of his service handgun pursuant to § 59.1-148.3.


Ownership/possession under the age of 18
quote:
361 § 18.2-308.7. Possession or transportation of certain firearms by persons under the age of 18;
362 penalty.
363 It shall be is unlawful for any person under 18 years of age to knowingly and intentionally possess
364 or transport a handgun or, assault firearm as defined in § 18.2-308.9, or shotgun with a magazine that will
365 hold more than seven rounds of the longest ammunition for which it is chambered anywhere in the
366 Commonwealth. For the purposes of this section, "handgun" means any pistol or revolver or other firearm
367 originally designed, made, and intended to fire single or multiple projectiles by means of an explosion of
368 a combustible material from one or more barrels when held in one hand and "assault firearm" means any
369 (i) semi-automatic centerfire rifle or pistol which expels single or multiple projectiles by action of an
370 explosion of a combustible material and is equipped at the time of the offense with a magazine which will
371 hold more than 20 rounds of ammunition or designed by the manufacturer to accommodate a silencer or
372 equipped with a folding stock or (ii) shotgun with a magazine which will hold more than seven rounds of
373 the longest ammunition for which it is chambered. A violation of this section shall be is a Class 1
374 misdemeanor.
375 This section shall not apply to:

376 1. Any person (i) while in his home or on his property; (ii) while in the home or on the property of
377 his parent, grandparent, or legal guardian; or (iii) while on the property of another who has provided prior

379 written permission on his person while on such property;
380 2. Any person who, while accompanied by an adult, is at, or going to and from, a lawful shooting
381 range or firearms educational class, provided that the weapons are unloaded while being transported;
382 3. Any person actually engaged in lawful hunting or going to and from a hunting area or preserve,
383 provided that the weapons are unloaded while being transported; and
384 4. Any person while carrying out his duties in the Armed Forces of the United States or the
385 National Guard of this Commonwealth or any other state.


Removal of the Concealed Carry Permit holder provisions for certain guns, and equipment

114 § 18.2-287.4. Carrying loaded firearms in public areas prohibited; penalty.
115 It shall be is unlawful for any person to carry a loaded (a) semi-automatic center-fire rifle or pistol
116 that expels single or multiple projectiles by action of an explosion of a combustible material and is
117 equipped at the time of the offense with a magazine that will hold more than 20 rounds of ammunition or
118 designed by the manufacturer to accommodate a silencer or equipped with a folding stock or (b) shotgun
119 with a magazine that will hold more than seven rounds of the longest ammunition for which it is

120 chambered on or about his person on any public street, road, alley, or sidewalk, on any public right-of-
121 way, or in any public park or any other place of whatever nature that is open to the public in the Cities of

122 Alexandria, Chesapeake, Fairfax, Falls Church, Newport News, Norfolk, Richmond, or Virginia Beach or
123 in the Counties of Arlington, Fairfax, Henrico, Loudoun, or Prince William.
124 The provisions of this section shall not apply to law-enforcement officers, licensed security guards,
125 military personnel in the performance of their lawful duties, or any person having a valid concealed
126 handgun permit or to any person actually engaged in lawful hunting or lawful recreational shooting
127 activities at an established shooting range or shooting contest. Any person violating the provisions of this
128 section shall be is guilty of a Class 1 misdemeanor.
129 The exemptions set forth in §§ 18.2-308 and 18.2-308.016 shall apply, mutatis mutandis, to the
130 provisions of this section.
131 § 18.2-308.2:01. Possession or transportation of certain firearms by certain persons.
132 A. It shall be is unlawful for any person who is not a citizen of the United States or who is not a
133 person lawfully admitted for permanent residence to knowingly and intentionally possess or transport any

134 assault firearm as defined in § 18.2-308.9 or to knowingly and intentionally carry about his person, hidden
135 from common observation, an assault firearm.

138 knowingly and intentionally carry about his person, hidden from common observation, any firearm.
139 C. A violation of this section shall be is punishable as a Class 6 felony.
140 C. For purposes of this section, "assault firearm" means any semi-automatic center-fire rifle or
141 pistol that expels single or multiple projectiles by action of an explosion of a combustible material and is
142 equipped at the time of the offense with a magazine which will hold more than 20 rounds of ammunition

The substitute is still bad, but not like the original. Just a reminder for us not to get disheartened, enraged (they'll use this against us), etc. we have to keep plugging away, we're in this for the duration. I'm appalled at the striking of the provisions for Concealed Carry holders and certain magazines personally; after all, we have had enhanced security/background checks and validation by the circuit courts.

479 silencer by a firearms manufacturer for the purpose of sale to any branch of the Armed Forces of the

481 employees, provided that the manufacturer is properly licensed under federal, state, and local laws;
or (iii) 482 the sale or transfer of a silencer to any branch of the Armed Forces of the United States or to a law-
483 enforcement agency in the Commonwealth for use by that agency or its employees.

Can somebody please explain this section? Possession is OK, everything else is illegal, but transfer per NFA is legal. That has ALWAYS been the only legal way to transfer a Supressor! My head hurts reading that.... Roll Eyes

Am I correct that this current version of bullshit is a follows:

-All detachable magazines are capped at 12 or less.

-Centerfire rifles with any “evil” feature must have a fixed magazine capacity of 12 or less rounds or is an “assault firearm”.

-Rimfire rifles can be as evil as you’d like as long as the magazine’s are 12 or less rounds.

-Shotguns with pistol grips and/or detachable magazines of any capacity are “assault firearms”. Where does this leave the Shockwave type firearms that shoot 12 and 20 gauge ammunition?

-Handguns that feed through the grip cannot accept a muzzle device or a suppressor or be deemed an “assault firearm”.

-Suppressors are ok but they can’t be used on handguns?

-No more registration requirements to keep your “assault firearms”, comply with maze of laws or surrender?

Just trying to trace a way through this.

I think you’d have to make a sealed magazine, which means no cleaning and no spring replacement. It also means (I think) that none of the mass-compliant (for example) mags will be legal in VA. Short term, there would be a lot of handguns in VA that would be rendered effectively unusable because there will be no compliant magazines available for them. Maybe that is intentional, but I doubt the General Assembly has any clue that is what it is doing.

I doubt it. Just like I doubt Fairfax normally has at least 6 officers, most of them from SOD, at every board of supervisors meeting. That’s in addition to the buildings regular armed contract security. They’re scared and posturing trying to make everyone believe there’s a real threat at these events when they know there’s not.
