| It appears he was advised to 'take the medicine' and get on with putting this behind him; any fight or resistance given the high profile of his family would likely reveal more embarrassing events or, incidents, not to mention more ire against them. He got a pretty standard 1st time DUI sentence. I've heard total monetary cost for a 1st time DUI in CA is about $10,000 total: legal fees, fine/penalties, cost of the interlock, DMV admin fee's, tow fees, impound fees, the court programs, etc. |

I figured that some procedural error would have gotten the case dismissed. But this from Fox News shows that he tried to pull the privilege card game at the scene: Pelosi allegedly handed officers his driver’s license and an "11-99 Foundation" card when they asked for his ID, according to the documents. The 11-99 Foundation is a California Highway Patrol charity that supports officers and provides scholarships for their children

$10K is the estimate I hear all the time for a first DUI.

| For the knowledgeable… How did these alcohol ignition interlock systems work? Couldn’t you just fill a balloon a few hours before you went out with your normal breath? Keep it warm. Or are they smarter than that?

| ^ wrt the interlocks…they can be defeated. I once saw a guy I wrote for dwi in his car. He had a passenger (minor) lean over and blow. I immediately pulled in behind him and began an investigation. Turns out he hadn’t stopped drinking, he figured out how to defeat the interlock. He had his kid blow for him…and he continued to drive drunk-with his kid…unbelievable. The judge got really pissed and sentenced he guy to the max. I don’t know about a balloon or something similar…I do know the intoxilyzer takes a deep lung sample and can sense when you are nearing that threshold…I can only assume the interlock is the same. Also, the person with it has to pay all the upkeep and installation and the visits from the techs who make sure it’s running properly. It’s not cheap. Many people opted to just give the state their license for a year and ride a moped or found other drivers. Or they just drove on a revoked license.

| As a part-time locksporter, I’m always curious on how things work. I don’t think I would try any of those solutions in searching for defeats/vulnerabilities.

The makers of these devices have thought of all of that. They have cameras. They have sensors that ensure the breath is blown at expected pressures and velocities. They have random re-tests - the machine tells you to pull over and retest at some random interval. A photo of you and a balloon, or some other person blowing into the machine will not pass muster.
