I was a pessimist until about a month ago, now I have a lot more optimism that a jury of 12 regular Americans can deliver the right verdict, even in NYC. Justice (and common sense) demands that Penny wins this, and the courts should squash that civil suit, too. | |||

I imagine we may be looking at a hung jury, given that they're still at it. This case is straightforward for any person with common sense. Either you can see that Penny took necessary action to subdue an irrational man threatening a group of people in a confined space, or you're a criminal-loving leftist who disregards the safety of innocent people. Naturally, those leftists who are drawing out the deliberations ignore the fact that they would be grateful for the heroic actions of someone, had they themselves been one of those people confronted with a crazy bastard threatening to do anything which would get him sent to prison for life. This is no surprise, since all leftists are hypocrites; it's an essential part of their nature. The jury should have taken- at most- a couple of hours to acquit Penny, and since they are still at it, I imagine we have two factions among the jury, and neither will budge. Hung jury Daniel Penny jurors tell judge they can't agree on top charge in subway chokehold case NEW YORK – Jurors on the Daniel Penny chokehold trial returned to deliberations for a fourth day Friday for just an hour before telling the court they could not come to an agreement on the top charge, manslaughter, as they weigh the fate of a 26-year-old Marine veteran and architecture student accused of killing a mentally ill homeless man who threatened to kill people on a Manhattan subway car. Around 11 a.m., the jurors sent a note to the court stating, "We the jury request instructions from Judge [Maxwell] Wiley. At this time, we are unable to come to a unanimous vote on court 1 – manslaughter in the second degree." The charge requires prosecutors to prove that Penny acted with recklessness when he grabbed Jordan Neely in a chokehold. Neely had barged onto the train while high on drugs, threatening to kill passengers during a psychotic episode, according to trial testimony. "In this case, I think that they can't move on to count 2 unless they find the defendant not guilty of count 1," Wiley told attorneys for both sides, despite protests from the prosecution. "I have to at least try to ask the jury to find a verdict on count 1." Count two is a lesser charge of criminally negligent homicide, which carries a maximum punishment of four years in prison. At this point the court has not declared the jury hung. If that occurs, the State will be able, but is not required, to retry him. Some jurors want to crucify this man and others know he should be acquitted. I don't think the two factions will budge an inch. The judge will have to call it before too long. | |||

According to Talk Radio, Judge is sending them back to try and "talk about it and try to see it from the other persons perspective to come to a decision" He also said something about the lesser charge wouldn't get applied if the higher charge wasn't agreed on since the jury wouldn't agree to it either. NYC has become a despicable place, without a not guilty verdict on all counts the jury has basically eliminated individuals from intervening to help anyone. | |||
