When he talked with police, one of whom was a fellow Marine, he did not know that Neely had died. Makes a big difference doesn't it?

I'm surprised there is not more interest here in this case.

We carry to protect ourselves and our families. But if we saw an innocent person about to be harmed or killed by a thug, we would do what we could to protect that victim, even using our weapons if we had to.

Daniel Penny didn't know whether Neely had a knife or a gun. He himself was not armed. But he took down Neely who was screaming "Somebody is going to die today!"

A real lowlife scumbag, who committed serious crimes for money and pleasure, has been pardoned of all crimes-- including those we don't know anything about.

It heightens the travesty of justice plaguing Daniel Penny.

Closing arguments are today.

You'd like to think you could step in to help but if you live where the odds favor that the government will bring charges against you that would financially ruin you, destroy your family and work life is the decision criteria, in that instance, probably engage only for my personal or families protection...

Is it worth the damage that is coming to you to intervene.. They convict this man and nobody will be coming to help anyone in NYC.

I used to think I would always help someone, but now agree with HRK. No one in their right mind would help a stranger in NYC if Neely is convicted.

It will be everyone for themselves, and the criminals will be even more emboldened.

Yes and no:

In today's world of everyone grabbing their cell phone to post shit on X, Tic-Toc, FaceBook, YouTube... As they shout "SOMEBODY DO SOMETHING!"
Because getting a thumbs up or a hit or likes is more important than anything else in today's world.

If Daniel Penny gets fucked on this, it sends a message that no one should do anything, and just take it. Take the robbery, take the harassment from a crazy person, or the homeless et al. Because if they actually DO something, they're going to get fucked.

(And a bet that the Judge references "We can't turn this into 'Death Wish'" somewhere in his ruling, IF Penny is found Guilty)

I haven't written much, but I've been watching this case with great interest. My older brother was a big guy and possessed a very intimidating way. Many was the time he stepped in to help someone who was being mistreated. I see him in Daniel Penny! And, I see a good person being attacked for doing the right thing.

If he is found guilty, it is going to be a travesty of justice. Every person in that subway car should be totally ashamed if Penny is convicted. If I had been a passenger in that car, my voice would have been heard whether it meant I was guilty of contempt of court or not. And, I would be screaming at ANY publication that would write my story. Maybe being found in contempt would make me more interesting to reporters - so be it!

Just the fact he was charged is reason enough. It sucks, but if the thanks you get for getting involved is criminal prosecution, what choice does that leave you?

Jury Recessed for the evening, not sure what that means, pundits speculate that it's not good, but you never know with Juries.

Would have like to have seen them go out, vote not guilty and come right back with it to make a point out of this being a sham trial.

If they convict the guy, Trump should pardon him the day he gets in...

I couldn't imagine living in NYC right now. I used to live 15 miles away and went there occasionally.
When I went there my head was always on a swivel and was on defense. I think most New Yorkers are on the defense as well. My hope that this defensive attitude plays into finding Penny innocent. Maybe not all of them but the Jurors must feel the same way as the victims felt that day on the subway. They need to take a look at their everyday lives as they travel on a NYC subway.

Penny has said, from the very beginning, when he was interviewed by police, that he never had an intention to kill Neely. He was taught the rear naked choke as a Marine, and I'm sure he was taught a lethal version of a very similar hold.

Your left forearm goes under the chin, straight across from shoulder to shoulder. Your right arm grips your left just above the elbow. So your forearms are parallel. Then, with your right forearm, you crank the head over your left forearm. The neck snaps.

Since as a Marine, he was taught the rear naked choke, I'm sure he was taught this lethal alternative. The fact that he went with the rear naked choke, shows that he did not want to kill Neely.

(I was never a Marine. I trained in martial arts all my life.)

Anyone that has been harassed on the subway almost certainly would have wished for something like a Star Trek phaser to instantly disappear the aggressor. Or at least a transporter beam. Will that sentiment persist into the deliberations? A hung jury seems likely to me.
