Two things come to mind-

The first is that with each and every theft it requires some intent to deprive the owner of his/her property. And some states even require intent to do so with the intent to commit a crime.

The second is that there would be ZERO appetite to prosecute on this. Z.E.R.O. No cop would touch this. No prosecutor. A jury would deliberate for about 20 seconds to come back with a not guilty verdict. As some have indicated, if the dude is active duty, he will be decorated for it.

I would bet there would be Nevada truck dealerships standing in line to replace the truck for the owner, as well as giving a new truck to this brave Marine. Semper fi, brother. You did good.

Not a conspiracy theory..

This guy lived his whole life normal. The whole time not scratching this itch he had. Maybe he was the kind of crazy that made his daddy, who the FBI called a psychopath look like an alter boy. The attacker was smart, driven and found him self successful in life, but no one knew his name despite him doing everything "right" So he plans an assault on a venue of an unprecedented scale, and completes one of the most horrific massacres in modern US history. He did it as a way to be remembered forever, even if it is as an absolute son of a bitch.

This doesn't seem impossible to me. There doesn't have to be two shooters, medications, ISIS, or ANTIFA. Just a dick with a vantage point and a few rifles.

Neither a lawyer or cop, so I don't know the answer. Would a DA need a complaint? Would the owner have to complain for charges to be filed?

If so, it is hard to imagine the owner being enough of a selfish dude to complain rather than saluting said Marine.

What's the difference between theft, which usually involves intent to permanently deprive the true owner, and conversion, merely the unauthorized assumption and exercise of rights of ownership over personal property belonging to another?
