Even if his jail time gets reduced substantially, it's still a major victory. The police could have flubbed the investigation. The jury could have nullified the verdict. The judge could have simply fined him. The charges were dropped, and what if they hadn't been reinstated? There's so much that could have gone wrong and I am not going to listen to people trying to find something bad in all of this. Oh, overturned on appeal? When the judge said 3 years probation and no prison because of the various reasons I was not thrilled. But then the 150 days in county jail as part of the probation and I was surprised. Assume he did this so they couldn't appeal a "prison" sentence, and only the probation? 3 years is a more than reasonable sentence for felony probation so not much to appeal. And the county lockup starts now and will be done by the time any appeal can be heard. Sounds like he wanted mandatory, no excuses, no avoiding it jail time. | |||
