Smolette is all set up to win the "Ghetto Lottery" (AKA, A Lawsuit). Guess who's in the crosshairs when it comes to punitive damages? That's right... The Detective. Kim Foxx... Fuck her. Part and parcel of "The Democratic Machine". Who helped her get elected? Toni Preckwinkle, one of the two bad choices this city has for mayor, and the Cook County Board President and Toni lives about a block - block and a half away from obamas Chicago residence on 51st Street. Foxx, along with Preckwinkle, and Cook County's Chief Judge all believe that "there are too many black and brown people in jail". Here, you don't become ANYTHING without connections to The Machine. ANYTHING. Including: Boss on the Police or Fire Dept. Any City job: Streets and San, Electricity, Carpenter, truck driver... Any private business that does business with the City; connected. And a little over 36 hours ago, you, I, and a lot of other people believed that this was going to trial, and he'd be going to jail. How, to quickly answer your question? Taint the Detectives reputations. Remember, Civil trial is Preponderance of Evidence - 51%. A good smoke and mirrors campaign can do that. That's IF it ever goes to trial. His lawyers aren't stupid, and they know how the game is played here. Ask for $25mil in compensatory, $100,000 in punitive damages from each of the Detectives and bosses involved. (Sgt, Lt, Commander of Area Central, possibly the Chief of Detectives as well, a motion to exclude will separate the wheat from the chaff) The City will counter offer with a "fuck you". Lawyers will say "we're going to trial" and give the city a little peak behavior the curtain on their smoke and mirrors campaign, smearing a few good people- some of it may possibly be true... The City will toss out a small amount. The lawyers will then decline, and up the amount on the Punitive Damages, say $250,000 The City then cuts a big, fat check. Why? Because if there's a medium chance of losing, the Detectives and bosses are now on the hook for $100,000 out of pocket. The City doesn't care about settling out of court, because it's not like the check that they are cutting is anyone's money... If the Smollett team keeps attacking the police and saying there was no evidence, the prosecutors can recharge the case. Nolle prosequi means the prosecutor decides not to go forward. It does not mean an acquittal. Double jeopardy does not apply. | |||
