Judge Denies Prosecutor’s Motion to Issue New Arrest and Raise Bail for Kyle Rittenhouse

https://www.theepochtimes.com/...enhouse_3694448.html

Glad the judge didnt give the prosecutor Kyle's new address...you know those assholes would have leaked it.

A Wisconsin judge on Feb. 11 denied two motions from prosecutors to issue a new arrest warrant and raise the bail for Kyle Rittenhouse , the teen from Illinois who is accused of fatally shooting two people during a riot in Wisconsin last August.

Judge Bruce Schroeder rejected the request from Kenosha County Assistant District Attorney Thomas Binger to increase Rittenhouse’s $2 million bond by $200,000 and issue an arrest warrant for him after a prosecutor argued that he had violated conditions of his release.

Prosecutors accused the 18-year-old of violating his bond terms by failing to report to the court the address of a “safe house” to which he’s moved into in November.

But Rittenhouse’s attorneys argued that death threats to him and his family safety prompted him to conceal his whereabouts.

“Most people out on bond, we don’t know where they are,” Judge Schroeder said in a hearing which took place over Zoom.

“To issue a warrant now for a defendant who has appeared at every hearing, that would be breaking the law, and I’m not going to do it,” he added.

Schroeder did require Rittenhouse to register his current address with the court, but it will be kept under seal and only he and the Kenosha County Sheriff’s Department would have access to it.

Binger asked the judge to allow his office access to Rittenhouse’s address, to which Schroeder responded with, “it has nothing to do with you.” (Hah---suck it douchebag!!!)

Rittenhouse had traveled with a weapon on Aug. 25, 2020, from his home in nearby Antioch, Illinois, to racially charged protests in Kenosha, Wisconsin, prompted by the police shooting of Jacob Blake.

He is accused of murdering Joseph Rosenbaum, 36, and Anthony Huber, 26, and injuring Gaige Grosskreutz with an AR-15-style rifle.

He has been charged in Kenosha County with first-degree homicide and five other criminal counts related to the shootings, however, Rittenhouse’s legal team has said their client feared for his life when he fired his semi-automatic rifle, and have indicated they plan to argue self-defense.

Rittenhouse was extradited in late October to Kenosha to face the charges.

Rittenhouse’s next scheduled court appearance is March 10, WISN reported.

If they can't arbitrarily make an example of Rittenhouse or Trump, then the good guys are in a much better position to fight back than the Dems would like them to think they are.

Judge should have given him the address for one of the local leftist politicians. Surely they would have leaked it before actually checking to see who it belonged to. Then perhaps the resident could spend some quality time with their fellow leftists who showed up.

Good for that judge. I am sure the dems will be after him next and try to find something on him until they get the answer they want.

The judge seems fair and measured. Like justice should be. Kinda sad when it's surprising to see.

If the judge really has that little confidence in the prosecution, he needs to... he’ll, I don’t know. But they shouldn’t be lawyers

Prosecutor should have spent a night in jail on contempt for even asking. There is absolutely no need for him to know and he can't possibly want the address for any reason other than to leak or threaten to leak it.

Wrong. JUST PLAIN WRONG.

The gun belonged to a resident of Wisconsin, who loaned it to Rittenhouse.

Actually, I was thinking the judge should have run a simple test. Give the prosecutor 'an' address, and see if it was later leaked. If so, find the prosecutor in contempt and lock him up. It is good to see a judge that appears to have a decent understand of what his job is.

You didn't expect anything approaching accuracy or honesty from the media, did you? The goal is to get Rittenhouse, and everyone in the media is onboard with that goal no matter what lies they have to tell.

Judge in Rittenhouse Case Denies Prosecution and Defense Motions
Ammoland Inc. Posted on October 4, 2021 by Dean Weingarten

"U.S.A. –-(AmmoLand.com)- On August 25, 2020, Kyle Rittenhouse was at the scene of the Kenosha riots. In the next few hours, he scrubbed graffiti, offered first aid, was threatened, was attacked, and shot three people in claimed self-defense. The situation has been covered in depth at AmmoLand. A good summation of the actions that night are here. Kyle was charged by local prosecutors in spite of voluminous video evidence of his self-defense claims. Eventually, supporters raised two million dollars for bond in Wisconsin.

On Friday, September 17, 2021, there was an evidentiary hearing in Kenosha, about what will be allowed as evidence in the trial of Kyle Rittenhouse. Jury selection is scheduled to start on November 1, 2021. The hearing may be seen on YouTube. The video is two hours and 36 minutes long.

The hearing was held by the Honorable Judge Bruce E. Schroeder. The view seen is from the bench. Seated at the table on the left of the screen are the prosecutors. DA Thomas Binger is in a blue suit, wearing glasses. On the right of the screen is the defense table. Defense attorney Mark Richards is on the aisle side of the table in the black or very dark blue suit; defense attorney Corey Chiriafsi is in the grey suit in the center of the table; defendant Kyle Rittenhouse is on the far side from Richards in a blue suit.

Judge Schroeder is considering several motions for evidence to be admissible at trial by prosecutors and defense. Both sides have presented their arguments to the Judge, in writing, before this hearing.

In the video, both sides give a preview of what their case will look like at trial. Several facts are mentioned which this correspondent has not seen in previous coverage."

Men shot by Rittenhouse can be described as ‘rioters’ and ‘looters’ but not ‘victims,’ judge rules ahead of trial
By STACY ST. CLAIR
CHICAGO TRIBUNE | OCT 25, 2021 AT 6:07 PM

Kyle Rittenhouse’s lawyers can refer to the men he shot as “rioters” and “looters,” but prosecutors still may not call them “victims” at any time during the teen’s upcoming murder trial, a judge ruled Monday.

Circuit Judge Bruce Schroeder cautioned the defense team against using pejorative terms during opening statements, but he said they could use them in their closing arguments if the evidence suggested the men engaged in criminal acts.

“He can demonize them if he wants, if he thinks it will win points with the jury,” Schroeder said.

...

Schroeder earlier had ruled the three men cannot be referred to as “victims” during the trial because it would be prejudicial to Rittenhouse. Such rulings are not uncommon in self-defense cases where there is a dispute over who bears responsibility.

I don't know. Judges are political animals, too. He may have to stand for re-election and that would bias voters against him. Lets just see how this circus plays out. My guess is it will be a hung jury.
