IRS whistleblower identified, will testify Friday to Congress

The IRS whistleblower who alleges there has been political interference in the Justice Department's investigation of Hunter Biden will testify to the House Ways and Means Committee behind closed doors on Friday, Just the News has learned.

Supervisory Criminal Investigative Agent Gary Shapley will be allowed to talk about the specifics of what has happened in the five-year long investigation of the first son.

Before Wednesday, Shapley's name had been protected as part of his whistleblower complaint, but multiple sources confirmed his identity to Just the News and said the agent was planning to do a brief interview with a television network in the next 24 hours.

He first approached the IRS internal watchdog last year with the help of whistleblower attorney Mark Zaid.

Shapley has alleged that federal prosecutors have engaged in "preferential treatment and politics" to prevent charges from being brought against the president's son. He has further filed a formal complaint with the Office of Special Counsel, contending that he was sidelined from the case after he made protected disclosures and was passed over promotion despite being the most qualified candidate.

His current attorneys disclosed to Congress last week that Shapley and his entire team had been formally removed from the case by the Department of Justice in what they described as another act of retaliation.

Shapley is represented by former DOJ lawyer Mark Lytle and former congressional investigator Tristan Leavitt, who now serves as president of Empower Oversight. The pair wrote to IRS Commissioner Daniel Werfel earlier this week, calling his attention to a separate communication sent to him by one of Shapley's subordinates, whom the DOJ also removed from the case.

In that communication, Shapley's subordinate case agent appeared to indicate that the pair's efforts to call attention to pervasive problems affecting the investigation have gone on for much longer, saying "[f]or the last couple years, my SSA and I have tried to gain the attention of our senior leadership about certain issues prevalent regarding the investigation."

"I have asked for countless meetings with our chief and deputy chief, often to be left out on an island and not heard from. The lack of IRS-CI senior leadership involvement is deeply troubling and unacceptable," the case agent told Werfel.

The FBI formally refused Tuesday to turn over to Congress an investigative memo alleging a bribery scheme involving President Joe Biden, prompting the chairman of the House Oversight Committee to begin proceedings to hold Director Christopher Wray in contempt.

Rep. James Comer, R-Ky., the panel's chairman, said he still plans to meet with Wray on Wednesday but declared the bureau's notification of refusing to comply with a subpoena to be unfortunate.

“Today, the FBI informed the Committee that it will not provide the unclassified documents subpoenaed by the Committee. The FBI’s decision to stiff-arm Congress and hide this information from the American people is obstructionist and unacceptable," Comer said.

"While I have a call scheduled with FBI Director Wray tomorrow to discuss his response further, the Committee has been clear in its intent to protect Congressional oversight authorities and will now be taking steps to hold the FBI Director in contempt of Congress for refusing to comply with a lawful subpoena," he added. "Americans deserve the truth, and the Oversight Committee will continue to demand transparency from this nation’s chief law enforcement agency."

Chairman of the House Freedom Caucus Scott Perry (R-Pa.) suggested having FBI Director Christopher Wray sent to the congressional brig if he doesn't cooperate and produce the Biden probe memo to Congress.

"We can't press charges. But we certainly can refer charges," Perry said on the Tuesday edition of the "Just the News, No Noise" TV show. "And if he shows up on Capitol Hill, if he shows up in the House chamber, he can certainly end up in the brig here. I think those are harsh words, but we just can't have this defiance. The information as we understand it is not classified."

"Either he needs to comply or there needs to be severe consequences -- the most extreme competent consequences that the legislative body can provide for," Perry continued. "That's what needs to happen with an individual like him with his defiance about the truth that the American people deserve and own"

Personal observation about certain three letter agencies and the way they are managed. There are conservatives working in the rank and file, but they rarely are promoted into the management levels. If any of these conservatives get "outed" or on the radar of management, they get pushed out the door post haste. Whistleblowers or anyone unwilling to tow the party line get buried by any number of dirty tricks.

Even in more conservative areas in the country, agencies are managed from the ASAC/Territory Manager level on up by hard leftists. There was a huge push during the Obama administration to force out older less politically active managers and install hardline radical leftists into these positions.

The left now has political influence over which cases get worked, and who gets a pass. I also suspect that these managers have ordered subordinates to do case and taxpayer research and served as the conduits with DOJ to leak confidential information to the media.

The only real answer is to clean slate the bureaucracy at the management levels and start over. I hope that Trump gets another chance to try his hand at it.

After Contempt Threat, FBI Director Wray Admits Oversight Whistleblower Report on Shady Biden $5 million Payment Does Exist

An interesting series of updates to the FBI whistleblower case of Joe Biden taking a $5 million bribe payment which now looks to have originated in Ukraine.

The background claim is pretty basic. A whistleblower approached congress stating the FBI had a report, an unclassified FD-1023, detailing a conversation with a ‘confidential human source’ (CHS) that outlined Vice President Joe Biden taking a $5 million payment from a foreign national to affect a U.S. policy decision. The FBI agent responsible for investigating the CHS claim was FBI Supervisory Intelligence Analyst Brian Auten, a sketchy character from the Trump-Russia probe.

The investigative events took place in June and July 2020 during the presidential election year. The claim is that FBI Supervisory Intelligence Analyst Auten reportedly buried the CHS allegation saying it could not be corroborated, and then wrote an assessment that it was Russian disinformation. However, the FBI investigative team didn’t see any effort by any FBI member to substantiate it. Hence a whistleblower, with specific knowledge of the details in the allegation, surfaces and tells congress the FBI is hiding the FD-1023 that outlines the confidential human source allegation of bribery.

Congress requested the FD-1023, the FBI refused to provide it. House Oversight Committee Chair James Comer then set a compliance deadline while he coordinated with Senator Chuck Grassley. The FBI still refused to turn it over, saying they would neither confirm nor deny the FD-1023 existence, and said releasing any information like that would potentially compromise Confidential Human Sources (CHS’s).
