The courts, in the exercise of what is called “equity jurisdiction,” have long excused borrowers from obligations incurred through fraud, duress, and other forms of creditor unfairness.

In addition, federal bankruptcy laws (authorized in the Constitution by Article I, Section 8, Clause 4) offer a path to safety for debtors who get in over their heads.

President Joe Biden’s “student loan forgiveness” measures qualify as neither. Instead, they are classic examples of what James Madison called an “improper or wicked project.”

Under the president’s program, no debtor will have to declare bankruptcy. And far from being victims, they already have enjoyed the benefit of very favorable loan terms at taxpayer expense. The borrowers spent the money for what both they and the federal government thought was a good purpose.

Still, you and I will have to pay their bills.

Conclusion

History demonstrates that attempts to “cure” a problem by exceeding the federal government’s constitutional powers generally lead to more and worse problems. The federal student loan program is a good example.

In an attempt to make college more affordable, the program has had precisely the opposite effect: The flood of federal money has greatly inflated the cost of tuition. It also has created a generation of debtors, and added billions to the national debt.

Now the president’s administration of the student loan program threatens to victimize hundreds of millions of innocent people by imposing on them an obligation they did not incur—and from which they in no way benefitted.

Biden campaign aims to use State of the Union address as reset after damning Special Counsel claims: Report

I even read something to the effect that Biden might try to do some sort of limited executive order regarding the border so that he can then say “look I did something, meanwhile, these Republicans are just sitting around doing nothing while this is going on!” at the SOTU

I wouldn’t put it past that clown’s handlers to try a stunt like that.

I get where you're coming from but I'll give it a shot for a while. I'm wondering if they can shoot him up with enough anti-memory loss drugs that will allow him to make a coherent speech. I have my doubts. He seems to be sliding down at an accelerated rate. I hope he does a good job that will keep him in the race. No friggin' way he can keep up a campaign pace until November. Biden ensures a Trump win IMHO.

The "much vaunted" AP news take on a murder by an illegal alien on campus at UGA. Athens-Clarke County(GA) is a sanctuary county. So are Clayton and DeKalb counties(metro Atlanta).

Jose Antonio Ibarra's wife, Layling Franco, told the New York Post that they came to the US from Venezuela with her 5-year-old son, and entered through El Paso, Texas. The couple apparently married in order to join their asylum cases.

According to police, Ibarra was arrested last August in Queens for driving with the 5-year-old child on the back of a gas-powered moped without a helmet or restraints. Ibarra was reportedly working for delivery services. After the incident, he moved to Georgia to live with his brother Diego and he and his wife separated. Riley was killed in Georgia earlier this week.

Franco told the Post that she found out about Ibarra's arrest from her brother-in-law on Friday. Ibarra’s brother was arrested for drunk driving in September and was working as a dishwasher at UGA under a fake green card.

"We got married so we could join our asylum cases,” Franco said of their relationship. "He was the person I thought I could see through. We’ve known each other our entire lives."

Franco claimed that Ibarra "wasn't aggressive, none of that." She noted, "We had problems as a couple but our problems weren’t physical. We wouldn’t punch but we’d raise our voices."

“I have a lot of faith that this wasn’t him, that there was a misunderstanding somewhere. But if he did, he has to pay for what he did, truly.”

Riley's body was found in a wooded area of the University of Georgia campus in Athens on Thursday. UGA police chief Jeffrey Clark said that there is a possibility her murder was a "crime of opportunity."

"He did not know her at all. I think this is a crime of opportunity where he saw an individual and bad things happened," Clark said. "The evidence is robust. It is supported by key input from the community, physical evidence, and expert police work. Importantly, we were assisted by video footage from our campus security cameras network."

Ibarra was booked into the Clarke County Jail on Friday, and charged with malice murder, felony murder, aggravated battery, and other criminal violations including kidnapping.
