Special Counsel David Weiss on Thursday secured a federal grand jury indictment charging Hunter Biden with nine tax crimes alleging he engaged in a four-year scheme to evade paying federal taxes, adding serious new legal jeopardy for the first son on the eve of a presidential primary season where his father hopes to win four more years in the White House.

"The Defendant engaged in a four-year scheme to not pay at least $1.4 million in self-assessed federal taxes he owed for tax years 2016 through 2019, from in or about January 2017 through in or about October 15, 2020, and to evade the assessment of taxes for tax year 2018 when he filed false returns in or about February 2020," the indictment unsealed in a federal court in California alleged.

The indictment says Biden spent millions on an "extravagant lifestyle" — including membership in sex clubs and more than $188,000 on adult entertainment — rather than paying his taxes.

According to the indictment, Hunter Biden "continued to earn handsomely and to spend wildly in 2018." His "expenditures increased as his income increased," the indictment says.

"In 2018, the Defendant spent more than $1.8 million, including $722,000 in cash withdrawals, approximately $383,000 in payments to women, approximately $151,000 in clothing and accessories, approximately $78,000 in miscellaneous retail purchases and other payments," the indictment details. "The Defendant did not use any of these funds to pay his taxes in 2018."

Special Counsel David Weiss has been using a federal grand jury in Los Angeles to gather evidence of possible criminal tax charges against Hunter Biden.
Earlier this week, House Oversight Committee Chairman James Comer, R-Ky., released subpoenaed bank records showing an entity owned by Hunter Biden had made "direct monthly payments to Joe Biden."

The White House has repeatedly said that President Biden did nothing wrong and had no knowledge of his son's business dealings.

House Republicans, meanwhile, have warned the younger Biden they would move to hold him in contempt of Congress if he didn't appear for a closed-door deposition on Dec. 13.

The indictment is exacting and detailed, discussing Hunter’s various business entities, the millions he received from foreign nationals and/or foreign business entities (such as those in China, Romania, and Ukraine), as well as the income and support Hunter has received from his entertainment lawyer, who happens to have paid “over $1.2 million to third parties for [Hunter’s] benefit” in 2020.

It also makes the case - a case known to the public for this last year or so - that Hunter willingly engaged in this tax scheme. The indictment is replete with examples: he did not report his Burisma income in 2014; he was informed by accountants that he owed taxes; his ex-wife told him that his tax returns were not filed; and there are multiple times where he is discussing his outstanding tax obligations in various communications.

Despite all this, Hunter’s spent like a man who thought he operated under a different set of rules. He had $1,664,004 in “ATM/Case Withdrawals”, spent $683,212 in payments to “various women” (a new euphemism for hookers, apparently) and $188,960 on “adult entertainment”.

Ironically, Hunter’s own words from his memoir, for which he was paid a handsome sum, are coming back to haunt him. As his tax-avoidance scheme went on, he surrounded himself with, and paid for the company of:

"thieves, junkies, petty dealers, over-the-hill strippers, con artists, and assorted hangers-on, who then invited their friends and associates and most recent hookups. They latched on to me and didn’t let go, all with my approval. I never slept. There was no clock. Day bled into night and night into day."

The indictment also details the “office expenses” or other deductions he used to lessen his tax burden, which included a $1,500 Venmo payment to an exotic dancer; $11,500 paid to an escort for two nights; and a $30,000 payment for his daughter’s law school tuition; $1,248 to fly an exotic dancer from Los Angeles to New York.

d. willfully failed to pay his 2016, 2017, 2018, and 2019 taxes on time, despite having access to funds to pay some or all of these taxes;

e. willfully failed to file his 2017 and 2018 tax returns on time; and

f. when he did finally file his 2018 returns, included false business deductions in order to evade assessment of taxes to reduce the substantial tax liabilities he faced as of February 2020
