Agree.

A gunowner that is going to try and intimidate people with their gun when their life is not being threatened needs to have a conversation with the LEOs on responsible gun ownership.

Just another example of why you should never engage people like this, no matter how tempting at that instant. You already had all the proof you needed that he was not in control of his actions and emotions before you decided to tailgate him. As you proved, you simply cannot predict the response. This time, it was brandishing, next time....?

Let's look at a possible statement he might give when the police come to talk to him.

I got a late start for work and the traffic was really bad this morning. I was driving behind this guy and he had a couple car lengths of space ahead of him. I knew I was running late and I was grabbing every chance to move ahead that I could. I had a chance so I passed this guy and pulled back into the fast lane. I look in my mirror and I see this guy waving his hands like he is really pissed and he starts tailgateing me. I was afraid he might do something stupid so I wave my gun that is in my holster in hopes that it might deter him. I've got a permit for it and I know it was a stupid thing to do, but I was almost at my exit and I didn't want this guy following me to work.

I think the call was enough. I wouldn't make a trip to the police station. They'll follow up on the call, if that is what they do.

You could call again and ask what steps were taken.

The DA wouldn't issue charges here.

Also, you escalated the situation.

Best you might get is a mutual summons to court for road rage or peace disturbance.

You are in Missouri, Kevin -- correct? Mr. Dunbar is in Ohio. I do not know what the law is in either of those states, as I am in Florida. Deliberately displaying a gun (as opposed to accidental, unintentional, exposure) here in Florida is a violation. I am not certain whether the term used here is "brandishing," but if you show a gun, on purpose, in a situation like this, you have violated Florida statute(s).

I mean, let's not got too high and mighty. A little bit of closeness to show him how unreasonable he was being is not me trading paint and flailing my arms all about.

And if that was his statement, he would be admitting to a crime in the state of Ohio.

If the police contact you, answer the questions truthfully. But don't worry about it.

I'd leave it with the report you already made. I think that was the right thing to do, but I'd leave it there.

Hopefully they'll follow it up and charge him. There was no excuse for what he did, IMO.
