I’m sorry to say but I believe that this is a disastrous decision of true and the timing couldn’t be worse. I’ve always believed, strongly so, that abortion is a states rights issue, no different than rape or murder. Having said that, not matter how much I disagree with abortion I believe that this could act as a lightning rod which could keep the dems in power in the midterms when the midterms should have been a GOP landslide. I’m sorry but unless SCOTUS also invalidates the NFA, or at least invalidates the 1986 machine gun ban and makes it clear that things like assault weapon bans are unconstitutional, I really have concerns about the consequences of such a decision. I’m not trying to be a Debbie Downer or Chciken Little, but I do believe that a decision to overturn Roe vs. Wade right now, despite how legally correct such a a decision might be, might have horrible election and legislative implications.

Because justices receive lifetime appointments, removing one is harder than just calling up someone and firing them. In order to remove one, you have to impeach them.

The process is the same as impeaching the president of the United States. The House of Representatives would vote on whether to impeach the justice in question. If the justice is impeached, there would be a Senate trial.

The House needs only a simple majority to impeach a Supreme Court justice or any federal judge. To convict and then remove the justice or judge, the Senate requires a two-thirds majority.

I can't believe the DEMs would allow a leftist SC judge to be removed. DEMs don't think "right or wrong"; they think "does it advance the progressive agenda" and does it keep Democrats in power and control.

This exactly. While I firmly agree with this decision, I feel this is terrible timing and will have the disastrous consequence of firing up the left and moving the conversation away from the democrats destruction of this country. This puts the mid terms in jeopardy.

Oh for the love of God. So when the hell is it the right time to protect the life of an innocent human being?

And furthermore, I'm tired of hearing about how this just makes it a state's right issue. Would the federal government stand by if a certain state made murder legal? Abortion is leagues more atrocious and evil as slavery, and frankly, it deserves the same fate in this country.

As long as I can remember abortion has been a devisive issue. The leak makes no difference. I dread the talking heads and the endless analysis and hand wringing. I would imagine that Twitter is blowing up as well. I think Para once said that a thread on abortion is likely to bring more controversy than any other topic.

You may be right, but if you are there will never be a good time to overturn Roe. Lose a majority, or the chance at capturing one, it’s the same result either way. What this proves is the folly of the Court taking on political power - it creates problems when it’s taken, when it’s used (or not), and apparently when it’s surrendered.

Chief Justice Roberts cares very much about the court’s prestige, which he absolutely should, and I expect he will be on the war path about this leak (assuming it was one - any decent lawyer could write the piece at issue). I fully expect the other justices will join him because it was the institution that was the target and that won’t sit well.

The courts have already allowed restrictions on abortions. Some states already have fairly restrictive abortion laws. Forgive me for using a very overused cliche "at the end of the day."

But at the end of the day, I don't think this is going to change much. As we all know, this returns the issue to the states. (Assuming the reporting is accurate) after the decision comes down, in my state, New Jersey, you'll be able perform an abortion on any female at just about any time. In other states, it's going to be very difficult to get an abortion. Not that much different than now.

I've always believed the issue belongs with the states.

As much as some want to make abortion a Democrat/Republican thing, it is only the far left that believe there should be no restrictions. Nationally, last I heard it was over 70% of folks who accept that there should be limitations. Like so many things, the devil is in the details.

Really guys? The court doesn't get to just put this one on the back burner for next year. The case is before them now. I wonder if this same reasoning is what led to decisions like Dredd Scott v. Sanford. Yep, let's have the court get all political and start making decisions based on the politics of the country. Last time, it didn't prevent the war that came four years later. Like has already been said in this thread, there would never be a good time to address Roe from a political point of view. Better just pull the band-aid off quickly and get it over with now. Besides, the sooner is the better time. Babies (people) are dying in the meantime. How many more are required? Politics be damned.

We'll see about the effect on the midterms - there aren't any Supreme Court Justices on the ballot, so none of them can be voted out of office, and the Dems have been waving the abortion flag as hard as they can for some decades now. I wouldn't be horribly surprised if a lot of the noise this generates among the general public (rather than political junkies and "activists") hasn't largely faded away by November.

As an alternative view, perhaps this:

It was leaked by a more conservative leaning person hoping to increase the time between “breaking news” and the election. Maybe the thought was “it’s gonna fire up the dang lefties, so let’s fire them up in May instead of August and hope that they move on and forget, as Americans are apt to do”

I dunno, just a thought. But hopefully the leaked count is accurate.
