For many years I have substituted the word with "black trash".

Years ago I defended a case where a white guy said to a friend and co-worker who was black, "What's up nigga?" at work. The two of them were friends outside of work but once it was said in front of other employees, the black guy filed a stress claim with all the trimmings.

During his deposition I asked him what he thought of the word in general and the meaning and connotations it invoked. He went on and on about how it was offensive, it made him weepy when he heard it, it conjured images of slavery, and it just shouldn't be said period. And then it got interesting.

I asked him if he'd ever uttered the word and he said he never had. I asked if he had black friends and if ever used it and replied "yes" to both. That was followed up by asking how many times he went to a therapist or mental health practitioner for treatment and medication like he's doing for his case. "Never."

I asked how many times he's spoken out to his black friends and forcefully told them their use of the N word was offensive and they needed to stop using it. "All the time." "Great. I need the names of your friends to verify what you just told me under penalty of perjury." Silence and stares.

I went through more of that with him and the more he talked the more his attorney winced since his client's anger and angst only happened when his white friend said it in public. It didn't bother him when it was said in private.

In the end he bombed in his depo and shortly thereafter his attorney dumped him. We paid him some GTFO/chump change and he resigned his employment.

A verdict has been reached apparently.
