The defense has said that they want this treated like any other low-level felony, but they conveniently forget that there was nothing ordinary about this case. As has been pointed out in this thread, the state incurred great costs as a result of Smollett's false claims, and the Chicago Police Department had 1000 hours of overtime because of Smollett's false claims and an expenditure of 130,000 dollars keeps being mentioned. Everything about this case has been exceptional, so for the defense to say "This is not fair because this is not how crimes of this nature are normally treated" is ludicrous.

I thought it was exceptional that Michelle Obama put a call into the prosecutor Ms. K. Foxx! Eek

Another useless part of trial sentencing IMHO. This particular event should have been over with in 1 minute, not fucking hours.

Maybe I'll revise what I said earlier. These people are so ignorant and aggravating with their bullshit that they may piss the judge off and he ends up giving him some time, lol. But I doubt it.

I think him bringing in BLM, NAACP and big names undercut his mitigation argument. Should've stuck with doing local stuff Chicago and Cook County underprivileged.

If this arrogant asshole had admitted he was lying WAAAY back when they made the accusation, he’d have skated with no felonies, and whatever probation he would have been put on would likely already be over. Like Para said, he may get no jail time but a handful of felony convictions will stay with him forever.

But I’m ever hopeful they’ll stick him in the clink for a little while at least and demand restitution.

He should pay financial restitution for the wasted overtime, do an equivalent number of community service hours the police spent in regular man-hours on his case and an equivalent number of overtime hours behind bars. No way that will happen as there is little justice in the system.

After turning the case into a media circus, Jussie’s attorney seems to be arguing that poor Jussie is the victim of a media circus.

Just look at the extraordinary amount of time this is taking- four hours so far, and we haven't even gotten to the sentencing, so the idea that there is anything normal about this case is preposterous. For the defense to say "It's not fair how Mr. Smollett is being treated" is infuriating, because it was precisely because of his celebrity that he was certain he would benefit greatly from his lies.

OK, here we go. Juicy has declined to speak in his defense or own the fuck up to what he did. Asshole.

The Judge is now speaking.

The judge is lambasting him. "Profoundly arrogant, selfish and narcissistic."

Based upon the judge's comments so far, if Smollett doesn't get jail time, I will be quite surprised.
