A magistrate judge began hearing evidence this morning to determine if accused leaker Reality Winner’s statement to federal agents can be used against her as evidence.

The issue centers over this question: was Winner in custody when she told federal agents on June 3 that she downloaded a classified document while working for national security contractor Pluribus International at Fort Gordon, smuggled it out of the building and mailed it to an online media news outlet?

Winner is charged with a single count of violating the federal Espionage Act. She has been held in jail without bond since federal agents executed a search warrant at her rented Battle Row home on June 3

A federal appeals court has affirmed the decision to deny bond to the former Fort Gordon contractor accused of leaking a classified document.


In the Jan. 31 opinion, the 11th U.S. Circuit Court of Appeal found the magistrate and district court judge in Augusta did not err in finding Reality Leigh Winner could post a fight risk.

Winner, 25, has been jailed since her arrest June 3. She has pleaded not guilty to a single charge of violating the federal Espionage Act by allegedly giving a classified document to a news organization.

The appeals court found Hall did not err in reaching the decision that Winner should be detained pending trial, which is set for March 18

Ms. Winner, who is now 26, has been jailed since her arrest and wore an orange prison jumpsuit and white sneakers to the hearing. Her decision to plead guilty to one felony count allows the government both to avoid a complex trial that had been scheduled for October and to notch a victory in the Trump administration’s aggressive pursuit of leakers.

Moreover, while the F.B.I. did not mention it in court filings, computer security experts noted that the printer appeared to leave barely visible microdots on the printout identifying the serial number of the printer and the date and time of the printing: 6:20 a.m. on May 9, 2017.

SAVANNAH, Ga. (AP) - Prosecutors say a Georgia woman who pleaded guilty to mailing a secret U.S. report to a news organization faces the "longest sentence" ever for a federal crime involving leaks to the media.

Ex-National Security Agency contractor Reality Winner is scheduled for sentencing Aug. 23 by a federal judge in Augusta. She pleaded guilty in June.

Winner's plea deal calls for a prison sentence of five years and three months. The judge isn't bound by that agreement, and the charge carries a maximum penalty of 10 years.

Prosecutors said in a court filing Tuesday their recommended sentence is stiffer than punishments in prior leak cases.

Winner's arrest last year was announced the same day The Intercept published a story on a classified NSA report on Russian hackers and the 2016 election.
