Senate Impeachment Trial

Day one recap: A series of 11 rules amendments were offered by Democrat Minority Leader Chuck Schumer. Each proposal was defeated individually during 13 hours of arguments and debate. The final rules package, which passed 53-47 at 01:45am this morning, is almost identical to the original draft presented by Majority Leader Mitch McConnell. The only change was spreading the 24hrs over three days instead of two.

There will be 24 hours of presentation by House Impeachment Managers (over 3 days); 24 hours of presentation by Defense team (over 3 days); 16 hours of Senate questioning; 4 hours of closing arguments, equally divided; and then a Senate debate/vote on further motions to include witnesses.

If there are going to be witnesses, they will first be deposed prior to testimony. No witness testimony will be permitted without first being deposed.

The Senate Trial Begins again today at 1:00pm EST, starting with opening arguments by the House Impeachment Managers.

White House Counsel Pat Cipolline blasted House impeachment manager Rep. Jerry Nadler (D-NY) on the floor of the Senate early Wednesday morning during the impeachment trial of President Donald Trump for making “false accusations” against the president and the Senate.

“The only one who should be embarrassed, Mr. Nadler, is you, for the way you addressed this body. This is the United States Senate. You’re not in charge here,” Cipollone said.

The White House counsel was responding to Nadler’s lengthy speech advocating for an amendment to subpoena former National Security Advisor John Bolton. Bolton has said he would be willing to testify, though the House failed to call him to testify during its own impeachment inquiry. Democrats hope that he will shed light on what impeachment managers called a “scheme” by the president to pressure Ukraine to interfere in the 2020 election.

But Nadler began by accusing the White House counsel of lying — a striking breach that would likely have been disciplined in any ordinary court of law. “They lie,” he claimed. “And lie, and lie, and lie,” he repeated.

Nadler went on to argue that if the Senate voted against the Democrats’ proposed amendment to a procedural resolution — which would only accelerate the decision on Bolton to an earlier stage of the trial — they would be “voting against the United States.” When it was Cipollone’s turn to respond, he had clearly had enough.

He said:

Thank you, Mr. Chief Justice, members of the Senate. We came here today to address the false case brought to you by the House managers. … We’ve been respectful of the Senate. We’ve made our arguments to you. And you don’t deserve, and we don’t deserve, what just happened. Mr. Nadler came up here and made false allegations against our team. He made false allegations against all of you: he accused you of a ‘cover up.” He’s been making false allegations against the president.

Turning to address Nadler, Cipollone concluded:

“The only one who should be embarrassed, Mr. Nadler, is you, for the way you addressed this body. This is the United States Senate. You’re not in charge here.”

As to the issue of Bolton’s testimony, Cipollone reminded Democrats that the House had decided not to call him in its own impeachment inquiry.

He then addressed Nadler again, reminding him that he had once argued that a partisan impeachment would deprive the American people of their vote. “What happened, Mr. Nadler?” Cipollone asked.

“Mr. Nadler, you owe an apology to the President of the United States and his family. You owe an apology to the Seate. But most of all, you owe an apology to the American people.”

Co-counsel Jay Sekulow then stepped in and attacked Nadler for calling executive privilege “nonsense,” and for arguing that “only guilty people try to hide evidence.”

“To shred the Constitution on the floor of the Senate — to serve what purpose?” Sekulow said. “The Senate is not on trial. The Constitution does not allow what just took place.”

Nadler tried to respond, repeating a false claim that President Trump claimed “monarchical powers” under Article II of the U.S. Constitution, alleging Trump believed “I can do whatever I want.” The claim is a misquote that ignores the context, which is that Trump was talking specifically about the power to fire Special Counsel Robert Mueller.

In a sit-down interview with Maria Bartiromo which aired Wednesday on Fox Business Network’s “Mornings with Maria,” President Donald Trump said Virginia is “in play” for him to win in 2020.

Trump pointed to Virginia Gov. Ralph Northam’s (D) push to take away guns, arguing Northam wants to do away with the Second Amendment.

“I think Virginia is crazy where they want to take away guns,” Trump outlined. “You have a governor that’s — I just can’t believe it — but Virginia is very much in play. I think we are going to win state of Virginia. They want to take everyone’s gun away in Virginia. You can’t do it. You can’t do it. People need that for safety. They need it for hunting and … but many people need it for safety, they need it for safety.”

He continued, “They’re playing with our Second Amendment. Frankly, they’d get rid of it. I watched him in the interview. He would get rid of the Second Amendment if it was up to him. And you have many Democrats saying the same thing. They’re saying it quietly, but if they win these elections, they’re going to try to get rid of the Second Amendment. It will never happen as long as I’m here.”

Lead impeachment manager Adam Schiff is doing some damage control on Wednesday. Damage that was done by his own colleague, fellow chairman and fellow impeachment manager Jerry Nadler. Late Tuesday night, as the Senate was debating (and rejecting) the amendments presented by Chuck Schumer, Nadler accused the GOP senators of breaking their constitutional oaths and of engaging in a White House "cover up."

"The only one who should be embarrassed, Mr. Nadler, is you for the way you’ve addressed this body,” White House lead counsel Pat Cipollone said in reply.

The back and forth was so tense that Chief Justice John Roberts had to admonish the teams and urge them to keep it civil.

Perhaps that's why Schiff shielded Nadler from answering any reporters' questions on Wednesday

Dems clearly have a very weak case.

Nadler was touted as the DEMs "constitutional expert". He is a brutish buffoon. That's why weeks ago Pelosi pulled the impeachment lead from Nadler and gave it shifty Schiff.

Lewandowski destroyed Nadler when he testified to Nadler's committee. Word was the DEMs were shocked at how bad Nadler performed

Rep. Zoe Lofgren (D-CA), one of the Democratic impeachment managers, tried to establish her party's case on Tuesday for why they need to hear more witness testimony and read more documentation before the Senate proceeds in the trial against President Trump

The White House documents that Democrats have asked for are "directly relevant to the case," Lofgren said Tuesday in support of Senate Minority Leader Chuck Schumer's amendments to the resolution. Because, she argued, those documents reveal the extent to which the White House agents and President Trump tried to coerce Ukraine into helping his re-election.

Toward the end of her remarks, Lofgren said something that appeared to upend the narrative she had just tried to paint.

The House of Representatives, she said, "did its job."

Okay, the White House defense team shot back, then why the need for more evidence?

"It's remarkable that the first thing the Democrats do at the outset of the Senate trial is to say, 'we need more evidence,'" observed deputy White House counsel Patrick Philbin. It's a "stunning admission" that their case is inept, he added. Even Sen. Mazie Hirono (D-HI) admitted as much.

Although the House Democrats had 17 witnesses and more supposed evidence, they're "afraid" to present what they have, Philbin charged. The Democrats, he added, were admitting that "there is no there there" and they were "just trying to ram this through" before Christmas.

Schiff took the podium back and said that they are ready. But Philbin had a point.

Other Republicans were less charitable.

I enjoyed Chief Justice Roberts calling out the legal teams, more because the impeachment managers forgot their place.

I kinda expected this statement, but was left jaw a gape nonetheless.

Lawyer here (litigator for large law firm for 25 years). I was flabbergasted to see and hear Cippolone assert that no Republicans were allowed in the SCIF, when he knew beyond the shadow of a doubt that this was untrue. Most of use here have been following this matter closely, and we all know that this assertion is not even close to being true. I would have been sternly told by the judge to correct the record immediately, so as to not to let it fester. We call that misrepresenting the record,in legal terms.

Wait, what?

The Republicans absolutely were blocked from the Shifty Schiff’s SCIF meeting and finally had to force their way in there in protest because they were not being allowed in.

What are you doing in this thread anyway? A quick look at your posting history tells me A. You’re a Democrat and B. You have an axe to grind with Trump
