First off I don't know if the Gateway Pundit is a creditable news source or not.

But the title of the story was "If You Saw What I Saw, You Wouldn’t Release It Either” – Judge Napolitano on What President Trump Said to Him About Releasing JFK Files.

Just kind of peaked my interest, if there is any truth to the story. Of course no details are presented.

Is there a DeSantis presidential campaign?

The Hill ran a story yesterday headlined, “Trump-Allied Super PAC Files Ethics Complaint Against DeSantis Over ‘Shadow Presidential Campaign’.”

Make America Great Again Inc., filed a 15-page complaint with the Florida Commission on Ethics alleging that the pro-DeSantis super PACs, state-level political contributions, and the governor’s “personally lucrative book tour” adds up to an improper, un-filed presidential campaign.

The key is Florida’s “Resign-To-Run” law, which requires any officeholder seeking a new office to resign from their current job if the terms of the two offices would overlap. DeSantis’ current term overlaps the next presidential term by two years. So Trump’s PAC is arguing that DeSantis is violating the law by running for president (without declaring it), and should have resigned first.

They are off base. The relevant statute, § 99.012, says that:

No person may qualify as a candidate for more than one public office, whether federal, state, district, county, or municipal, if the terms or any part thereof run concurrently with each other.

The statutory key word is “qualify.” If the statute applies, DeSantis must resign to run for president ten days before “qualifying” for president, which is the formal process of filing. He hasn’t filed yet, and the deadline is way off. Even publicly announcing his intent to run would not trigger the statute. And even if DeSantis does submit his resignation, it would not be effective until the first day of the new presidential term.

But there is a serious question about whether the statute even applies. DeSantis has a solid legal argument that the law doesn’t apply to him. In State ex rel. Davis v. Adams, 238 So.2d 415 (1970), the Florida Supreme Court held that offices defined by the U.S. Constitution (in that case, the House of Representatives), have their own Constitutional qualification requirements to run for office, and state laws cannot willy-nilly pile new state requirements on top of the Constitutional requirements.

I’m not the only one suspecting presidential campaigns are excepted from Resign-To-Run, as you can see from this excerpt from the Division of Election’s website — which was posted in 2018, long before DeSantis had a whisper of a clue of running for President:

Here’s the link. The statute doesn’t reference the Office of the President at all, so the statutory citations on the DOE’s website don’t make a lot of sense to me. Maybe I’m missing something. But the Florida Supreme Court’s holding in State ex rel. Davis v. Adams seems pretty compelling.

I believe all this explains why the Trump PAC filed an “ethics complaint” instead of a lawsuit, which would’ve gone nowhere. Instead, they’re arguing it might not be illegal, but DeSantis is still violating the spirit of the law by not resigning to run, and is therefore acting unethically. They bizarrely asked for the Ethics Commission to promptly remove DeSantis from the Governorship.

The Ethics Complaint is going nowhere.

First of all, five of the Ethics Commission’s nine members were appointed by DeSantis. So. Beyond that, in my experience, it’s hard to get the Ethics Commission to do ANYTHING even in clear cases of abuse. This is not a clear case; if anything it’s a stretch. Significantly, Trump’s PAC has to know that. So this complaint poses no real threat to DeSantis; it’s just a political stunt or a way to generate headlines.

It’s regretful that the primary seems headed toward a negative campaign. More than anything, I wish the two men would not attack each other and would just focus on presenting their own best cases to the voters.

Former President Donald Trump said Saturday he expects to be arrested Tuesday by New York prosecutors in a case over hush money to a porn star and called for Americans to protest and "take back our nation."

Trump made the announcement on his Truth Social platform, slamming Manhattan District Attorney Alvin Bragg in a post that used all capital letters for trying to indict a former president rather than focus on rising crime in America's largest city.

"Now illegal leaks from a corrupt & highly political Manhattan district attorneys office, which has allowed new records to be set in violent crime & whose leader is funded by George Soros, indicate that, with no crime being able to be proven, & based on an old & fully debunked (by numerous other prosecutors!) fairytale, the far & away leading Republican candidate & former president of the United States of America, will be arrested on Tuesday of next week," Trump wrote.

"Protest, take our nation back!" he added.

If Trump's prediction is correct, the nation is headed to a moment never before experienced, not even under Richard Nixon or Andrew Johnson. No former president has ever been prosecuted in American history.

Political experts have predicted a Trump indictment would galvanize an already bitter divide in America between liberals who see Trump unfit to lead and conservatives who see the 75-year-old former president as a successful leader who has been unfairly tarred by "banana Republic" smear tactics from Democrats and ideological bureaucrats in the law enforcement and intelligence world.

Law enforcement officials began quietly making security arrangements for an indictment later this week.

Danielle Filson, a spokeswoman for the district attorney, told The Associated Press that Bragg's office “will decline to confirm or comment” on questions pertaining to Trump’s post.

Trump has said he will continue to run for president in 2024 even if he i charged and has steadfastly denied any wrongdoing, calling the probe a "witchhunt" by a Democrat prosecutor.

A grand jury in Manhattan has been soliciting testimony from witnesses, including disgraced former Trump lawyer Michael Cohen, who alleges he aranged payments in 2016 to two women to silence them about sexual encounters they claimed to have with Trump a decade earlier.

Cohen -- who has pleaded guilty to crimes, served prison time and was disbarred -- alleges he arranged payments totaling $280,000 to porn actor Stormy Daniels and Playboy model Karen McDougal. Cohen claims the payments were hush money to buy the women's silence as made his first run for office in 2016.

Legal experts like Harvard law professor emeritus Alan Dershowitz have raised concerns about the legal merits of the case. Prosecutors would also face questions about a case built upon the testimonies of a porn star, and the work of two disgraced lawyers. In addition to Cohen, Daniels' former lawyer, Michael Avennati, also has been convicted of crimes.

One of the challenges for prosecutors is that Cohen, who has admitted in federal court to false statement to Congress, played a central role in the payments.

Joe Tacopina, Trump's lawyers in the case, signaled a likely defense strategy in a TV interview last week, suggesting that Daniels demanded "extortion" money from Trump and that Cohen advised the strategy to use.

Cohen is a "fraud, a liar" and "was his lawyer at the time and advised him that this was the proper way to do this to protect himself and his family from embarrassment. It is simple as that," Tacopina told MSNBC recently.

The raid on Mar-a-Lago was bad enough, but this--arresting a former President and current Presidential candidate--is on another level. Trump has truly broken something in these people's minds.

Are the two attacking each other though? All of the attacks seem to come from Trump.

Asking for DeSantis to be removed as Governor is a real dick move on Trumps part.

All this arrest stuff is nothing but BS. It’s a NY state misdemeanor charge that has already run past the statute of limitations..if for some reason or way the DA gets it upped to felony charges it’s still past the SOL.

And because it’s a state charge all President Trump needs to do is not go to NY. No way is RDS gonna issue a Governors warrant for extradition of Trump. It would be the end of his political aspirations.

Unless Trump goes and turns himself in on it. Then Trump will be a martyr. And he will win bigly, bigger then they can cheat.
