US attorney in Georgia abruptly resigns

The top federal prosecutor for the Northern District of Georgia abruptly resigned on Monday.

U.S. Attorney Byung “BJay” Pak previously signaled that he would stay in his position until Jan. 20, Inauguration Day, but that changed after a recording made public on Sunday revealed President Trump complaining of a "never-Trumper U.S. attorney there" during a phone conversation with Georgia Secretary of State Brad Raffensperger.

Trump did not specify whether he was talking about Pak during the conversation that was largely focused on election fraud claims.

In an internal email reported by Talking Points Memo, Pak said "unforeseen circumstances" prompted his decision to resign early, although he did not elaborate.

A statement released publicly only expressed gratitude to Trump and others.

"It has been the greatest honor of my professional career to have been able to serve my fellow citizens as the U.S. Attorney for the Northern District of Georgia," Pak said in the statement, according to the Atlanta Journal-Constitution. "I have done my best to be thoughtful and consistent, and to provide justice for my fellow citizens in a fair, effective and efficient manner. I am grateful to President Trump and the United States Senate for the opportunity to serve, and to former Attorneys General (Jeff) Sessions and (William) Barr for their leadership of the department."

Pak was nominated to the position by Trump and confirmed by the Senate in 2017. He previously served as a Republican Georgia state representative.

Jenna Ellis, senior legal adviser to the Trump campaign, floated the idea Monday afternoon during an appearance on the Just the News television show The Water Cooler with David Brody.

"What Mike Pence could do, and what he should do, in fact, is to direct a question back to the state legislatures when there are two competing slates of delegates from these six states, he can ask that question to the states and say, 'well, state legislators, you know, I have an oath to the Constitution to uphold the Constitution as written in Article II Section 1.2 which says the state legislatures direct the manner in which electoral delegates are selected. So you tell me which of these two slates was selected in the manner that your state general assembly has designated,'" Ellis said.

"And that's a fair question. That's not exercising discretion. That's not setting up any sort of bad precedent. That's actually returning the authority to the constitutionally vested entity and just simply directing that question I think would then require a response from these very timid, to put it lightly, state legislators that haven't been willing to act, and it would in fact then give a very clean outcome to this election," she added.

The six states she cited are Wisconsin, Michigan, Pennsylvania, Georgia, Arizona and Nevada. In all six states, the governments have declared Biden the winner and sent electors to Congress supporting the Democrat. But Trump supporters and some legislators in each of those states have said they don't trust the results because of irregularities and changes to election processes that weren't approved by the Legislatures. Courts have steadfastly refused to intervene despite numerous lawsuits challenging the results.

While as many as 100 GOP lawmakers in the U.S. House and a dozen GOP senators are expected to contest the results, congressional leaders say they have the votes to approve Biden's electors.

Ellis suggested that Pence could take the action at the beginning of Congress' electoral review proceedings Wednesday, "before even opening any of the certificates that are sent," based on publicly stated objections raised by several legislators in each of the states.

It is unclear whether Pence would support doing so, or if the vice president, a strict constitutionalist throughout his career, believes the Constitution to empowers him to take such action.

Pence over the weekend issued a statement through his chief of staff Marc Short saying he supported the efforts of GOP House members and senators to contest the results.

In a follow up email to Just the News, Ellis described the steps she believed could be taken lawfully:

Pence should not open any of the votes from the six states, and instead direct a question to the legislatures asking them to confirm which of the two slates of electors have in fact been chosen in the manner the legislature has provided for under Article II, Section 1.2 of the U.S. Constitution.
The Vice President should open all other votes from states where electors have been certified and not contested, and count accordingly.
The question would then require a response from the legislatures, which would then need to meet in an emergency electoral session.
Pence should require a timely response from each state legislature and set a deadline of Jan. 17. If any state legislature fails to provide a timely response, no electoral votes can be opened and counted from that state. The Constitution provides that if no candidate for President receives a majority of electoral votes, the Congress shall vote by state delegation. This would provide two and one-half days for Congress to meet and vote by delegation prior to January 20 at noon for inauguration.
Pence would not be exercising discretion nor establishing new precedent, simply asking for clarification from the constitutionally appointed authority in each of the six states.

I feel like I'm watching Lets Make a Deal and Monty Hall is offering a new car, or whats behind door #3 or, a toaster (biden) on door #1. As smart as many people should be, there is always some stupid people, (Dems) that will go for the toaster. Im going with the toaster I can hear them say. This is agony.

One thing I have learned is to never underestimate Trump, when he first got into office they pretty much stayed clear of him, figuring he would not last, as usual they were wrong. He is a true leader, not a politician, what he has done is shown us who is the weak knee pols that don’t care about us, and need to be removed in the primaries. Unfortunately it seems to be most, but if we want to bring the GOP back to what it was they need to go.

Who is certain of anything in the face of the pure evil we are seeing? It honestly all comes down to Pence. If he doesn't stand up and do what is right, then what paths are left? I'm hoping the intelligence report finally gets released and he can invoke the Insurrection Act as a last resort, but we haven't heard anything more about that for weeks. Has anyone heard from Ratcliffe since? All of this is unreal. I'm praying for a miracle and haven't lost hope yet, but we are almost out of time.

Packing a day bag as I type this. I have decided to jump in the truck and drive down to DC tomorrow and attend the Wednesday rally.

I know it is late, but if anyone from Ohio or Pennsylvania want to meet up and ride along, I am game (food and lodging are on me).

I would only ask that you get within a couple of miles of I-70 as I will be taking that all they way into Frederick, Maryland. I will stay the night there and then head into DC early, jumping on the metro at Shady Grove Metro Station.

I just cannot sit at home and not do something, even if it is just symbolic.

I think it's safe to say we need a miracle because our backs are against the East River and only a thick fog rolling in will save us. Maybe Pence will have a road to Damascus moment...

The good news is God has protected this country before and I'm putting my trust in Him to do it again. Hopefully, it will be a story we pass down through the generations.

Beach says that he is concerned about the integrity of the election. “People are saying yeah there is something here, there’s something that just doesn’t pass the smell test—that there was some irregularities, there was some impropriety going on in the voting process,” he said.

Ballots and voting machines need to be forensically audited, especially in Fulton county, said Beach. The biggest concerns he has relate to the State Farm Arena’s vote-tabulation center in Atlanta. It appears that a state election monitor was absent for a part of the counting process and that Republican poll watchers were led to believe the counting was over when it in fact wasn’t.

Coincidentally, Jenna Ellis, a senior legal adviser to the Trump campaign and one of Trump’s campaign attorney suggested on Monday that Pence delay certifying the votes on Jan. 6 and instead ask legislatures in the six contested states to clarify which candidate’s slate of electors should be approved.

“What Mike Pence could do, and what he should do, in fact, is to direct a question back to the state legislatures when there are two competing slates of delegates from these six states.

“He can ask that question to the states and say, ‘Well, state legislators, you know, I have an oath to the Constitution to uphold the Constitution as written in Article II Section 1.2, which says the state legislatures direct the manner in which electoral delegates are selected, so you tell me which of these two slates was selected in the manner that your state general assembly has designated,’” Ellis told Just the News television show The Water Cooler.

When Beach was asked if they had discussed anything relating to certifying the state’s electoral votes, he said: “If the Vice President is able to take our letters to postpone, then we would be in session and we could discuss what we could maybe do as a state senate in a state house.

“Right now, we can’t do anything because we’re not in session,” he added.

Georgia’s governor Brian Kemp previously refused to call a special session to consider claims of election fraud and other irregularities.

Other state senators in Georgia, including Beach, recognize it is highly unlikely for a special session to be called in the state as things stand now.

“Since Congress meets Wednesday regarding the electoral college vote, a special session before they meet is not an option,” state Senator Kay Kirkpatrick told The Epoch Times via email. “But I will continue to fight for the truth.”

“I am working every day to get to the facts of any and all fraud reports,” she added. “It is critical that we can trust our election system. I have been dividing my time between looking into all aspects of the Nov. 3 election and trying to get our two U.S. Senators re-elected.”

Beach said he and other senators called for the delay so they “can continue to have more time to investigate and scan these ballots.” The senator said he also wrote an individual letter to Pence as a member of the state’s judiciary subcommittee.

State senators in other states have also started a similar push, according to Beach.

“I think several senators from Pennsylvania, Wisconsin, and Arizona also wrote letters sent to the Vice President, [telling him] we want the vice president to at least delay it 10 to 12 days.”

Under the Constitution, Jan. 20 is the date where officially, “The terms of the President and the Vice President shall end … of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.”

Beach said he is doing all of this because he wants to get to the bottom of it.

“I’ve had my cell phone on my website and on my senate sites for eight years, I have never received any calls,” he said. “I may have gotten a call here now and then but after this—my phone has blown up, my email has blown up, my text messages have blown up.”

“People are angry, they’re mad, they feel disenfranchised,” he added.

Seems like middle ground where Pence can avoid making the choice on his own and the states can finally be in session and have a say. I'm really hopeful over this one.

The first, is understood as each individual's walk through life. And some of the Jewish persuasion, took issue with the second rendition, because it "strayed" from the intent and meaning of the first.

But! As many know, 2 Jews 3 arguments... The second recognizes, that all of the individuals, on their individual shaky bridge, that each must cross, has become the whole world that is, together, on the bridge, and that none should fear...

The lesson for us, today?

Each of us, as individuals, in America, have the freedom, (and must, because we are free) to walk the bridge in life. Knowing that it is very narrow, but important that we not fear is at all.

And as a nation, the second version applies, "We the People..." are all on the very narrow bridge, together, and thatno one is to fear.

The distinction?
If one, alone, on the narrow bridge, is facing the most daunting task of crossing the bridge and to not be fearful. (A great journy and burden for one, but...)

Being on a very narrow bridge, with a great number of people, the observer of the first, might think that the lone person had a greater task of being "brave", because he is alone and facing such fear.

But, the greater understanding is the second, a person (and many other persons, each a similar individual in the same circumstance) have a greater responsibility of being "brave" or "steadfast", as their fear will not only affect them in their trepidation, but that their fear (and the many fears of the many others) will be more than any one individual can bear.

Therefore. It is easier for one man to carry and battle his fear alone, for he and it are equal.

Yet to have many individuals and their collective fears, become a collective burden upon each individual.

Yeah. Jewish algebra word problems suck. But remember, if you play, you gotta show your work.
