The answer is, it has never been done. And, there is nothing to stop him from doing so. It would be the first test case for the court, if he went ahead and pull that stunt. It was suggested to FBHO that he pardon the illegals, but he never went ahead with it.

I’m not a lawyer, but I would think a person would have to specifically be named for a pardon. No president should be able to essentially side-step the citizen ship requirements of the Constitution with the wave of a pen.






What part of "...Shall not be infringed" don't you understand???

A person cannot be pardoned for future crimes. While one could be pardoned for being in the country illegally yesterday, that person is still breaking the law tomorrow by being here. Just as a person could be pardoned for kidnapping someone yesterday, if they continue holding the victim captive tomorrow then they are still committing a crime tomorrow.

The act of crossing the border or remaining past a visa expiration date could be pardoned. But I don't believe that would confer legal status. Just as being pardoned for bank robbery would not make it legal to hold onto the stolen cash.

I don't know if Carter's pardon of Vietnam War draft dodgers was blanket or named individuals. I can't imagine the Pardon Review Board compiled a complete list of names, but maybe they did.

For that argument, you can still say that the draft dodgers were US citizens. Wouldn't that open the can of worms that a US President can pardon someone anywhere in the world who isn't a US citizen?

It's bullshit, but makes for an interesting debate.

Yes... How sweet it is.

The timing of certification is defined by a federal law originally passed in 1887 and updated as recently as 2022. And they’ve moved it before. In 2013, Congress shifted certification to January 4th since the 6th fell on a Sunday.

I think they wait waaayyyy too long with this inter-regnum period. They could certify within two weeks and have the inauguration in early December. Especially with this Biden regime wreaking havoc during this time.
