It isn't. You can "lose" your military pension, but in most cases it's voluntary or you owe money (alimony, for example). You CAN temporarily lose your pension if incarcerated, but assuming it's not something heinous, it can be reinstated once you're released. And no, you are not subject to the UCMJ if you retired "normally". In certain cases, it is possible. I believe if you retired from the reserves, it doesn't apply. If you retired from active duty, you can be recalled and prosecuted but it's muddy at best. | |||

To get a quick and valid answer to the question, and not just an uninformed Internet guess, I recommend searching for “are military retirees subject to the ucmj,” and the answer is yes, we are. I first learned that some 50 years ago and it’s confirmed by many responses to the question. And it evidently applies to retired reservists once they start drawing a pension. But don’t take my word for it if truly interested. I found at least one citation of a specific individual who had been retired for 10 years before being recalled, tried, and convicted by a court martial. Although highly unlikely, that means a retiree could be charged under the UCMJ for saying disrespectful things about the current President. “I can’t give you brains, but I can give you a diploma.” — The Wizard of Oz This life is a drill.
