NYC Mayor Announces Performers and Athletes No Longer Subject to Vaccination Mandate, but All Other Residents Remain Under Requirement

New York City Mayor Eric Adams eviscerated the justification for the vaccination mandate because science demanded it – as he presented exemptions for NYC performers and athletes due to ‘fairness.’

As noted by MSM, “Ballplayers and other performers got the green light to apply their skills in New York City even if they haven’t been vaccinated against Covid-19.” however, all other residents are still required to live under the mandate. “Covid is a battle, our economy is a battle,” he told reporters at Citi Field in Queens, home of the New York Mets. “We need to recover our city from crime, from economic devastation, from uncertainty.”

Hopefully, someone, anyone, will file a lawsuit to remove the mandates and cite this economically purposed policy change as the evidence. This is nuts. Two tiers of citizens based on profession? Elite athletes and performers exempt, but ordinary citizens remain under the vaccination mandate?

Regular New Yorkers who lost their jobs to the city’s COVID-19 vaccine mandate gave Mayor Adams a Bronx cheer Thursday over his decision to grant exemptions for pro athletes and star performers — but not for them.

Unvaccinated Harlem resident Elissa Embree, 43, choked back tears while telling The Post how she was sent home last week from preseason orientation for her job as a waitress at the Mets’ Citi Field, where Adams announced his controversial move earlier in the day.

“I’m not as important as a Met is, because a Met will fill Citi Field, which fills the coffers of New York,” she said.

“They don’t care about little ol’ me, who pays middle class taxes. The elusive ‘they’ don’t care that I have been out of work and that I have been at my breaking point.”

The married mom of a 2-year-old daughter said she hasn’t been vaccinated because she’s had two miscarriages and is worried that getting jabbed could increase her risk for another.

Embree also said she’d tested positive for coronavirus antibodies and was looking forward to returning to her job at Pat LaFrieda’s Chop House at Citi Field, where she’s made as much as $500 a game.

“I thought we were all a big team here at Citi Field. This would have been my fifth season,” she said.

Mayor Adams says performers are exempt from vax mandates ⁠— does that include politicians, who are clowns?

Owing to the latest wave of Mayor Adams’ magic COVID wand, unvaccinated Brooklyn Nets star Kyrie Irving will be allowed to play home games at Atlantic and Flatbush. The ushers at the Barclays Center, on the other hand, and the guy who pours the beer and the ticket taker, they still have to get the jab or get fired.

You have to hand it to Hizzoner. His exemption to the workplace vaccine mandate for super-rich athletes and entertainers at least codifies what we have known all along: COVID rules are for the dirty masses, not important people.

Now that the mayor in his merciful benevolence is allowing pre-K students to learn mask free, the workplace vaccine mandate is the last big COVID restriction to remain in place. But why? New Yorkers are now free to roam inside and out around their millions of neighbors except when they go to work?

That obviously makes no sense, which is presumably why Adams says he won’t really bother enforcing the mandate anyway. This week the mayor had this to say about jabs and jobs, “As we stated, the name of the game is that we’re not going to be heavy-handed with the private sector mandate,” adding, “We’re not going to run around the buildings and check vaccine cards.”

Then why have the rule at all?

Meanwhile, police unions are rightfully furious that vaccine-free Yankees and Mets can wear NYPD and FDNY hats to honor our finest and bravest during a ballgame, but anyone refusing a vaccine is banned from wearing the actual uniform. As with so many issues like crime, and vagrancy, Mayor Adams needs to rip the band aid off and make bold moves. His half measures meant to please everyone are tarnishing the promise of his new administration day by day. And if he won’t lift the workplace mandate he should at least have some decent explanation as to why he won’t.

FDA authorizes second COVID-19 booster for people 50 and older

The Food and Drug Administration on Tuesday authorized a second booster shot of the Pfizer and Moderna coronavirus vaccines for individuals aged 50 and above.

The shots are designed to work as short-term immunity boosters as the novel virus continues to morph into new and more contagious variants. The shot is meant to protect recipients against severe illness.

Providers will be given the go-ahead to begin administering the fourth shot once CDC director Rochelle Walensky signs off on the measure.

Immunocompromised people are already eligible for the fourth shot.

"Based on an analysis of emerging data, a second booster dose of either the Pfizer-BioNTech or Moderna COVID-19 vaccine could help increase protection levels for these higher-risk individuals. Additionally, the data show that an initial booster dose is critical in helping to protect all adults from the potentially severe outcomes of COVID-19. So, those who have not received their initial booster dose are strongly encouraged to do so," said the director of the FDA's Center for Biologics Evaluation and Research, Peter Marks.

It is unclear how long protection from a second booster shot will last.

Horowitz: Kavanaugh deals crushing blow to religious liberty in military

One has the right as a convicted murderer to demand his pastor place his hands on his head during the execution, but one does not have the right to object to the religious cult of COVID shots in the military. One can demand gay marriage benefits or transgender surgery in the military but cannot ask for a religious exemption to a poison shot injected into the body. This is the state of the First Amendment and fundamental rights according to Justice Kavanaugh and the 6-3 liberal Supreme Court.

On Friday, March 25, the Supreme Court placed a “partial stay” on a lower court injunction in the case Austin v. U.S. Navy Seals 1-26, which prevented the Navy from taking adverse action against SEALs who filed for religious exemptions from the vaccine mandate. In other words, the careers of these SEALs are now destroyed. The SEALs testified in the Texas federal case that they were being discriminated against for merely filing religious exemptions, and that out of 4,000 filed exemptions, a total of zero were approved.

One thing is clear: Courts have ruled for years that both the First Amendment’s free exercise clause and the Religious Freedom Restoration Act (RFRA) apply to federal workers, including those in the military. Yet Kavanaugh, Barrett, and Roberts, along with the Democratic appointees, have for the past two years consistently turned a blind eye as the government has violated religious and personal liberty in ways that would have shocked us just a few years ago. Now, with the science becoming clear that the vaccines are ineffective against spread of COVID and have serious safety issues, there is no way the government can claim that an ironclad mandate destroying the careers of special operators is the least restrictive means of furthering a compelling governmental interest.

However, that didn’t stop Kavanaugh from reversing a well-articulated injunction from a Texas federal judge and the Fifth Circuit. Thus, not only won’t the three liberal GOP-appointees on the high court intervene when lower courts rule the wrong way, they will even actively reverse good decisions from lower courts protecting liberty. Feigning the judicial minimalist approach, Kavanaugh wrote in a concurrence that “Under Article II of the Constitution, the President of the United States, not any federal judge, is the Commander in Chief of the Armed Forces.”

That would come as news to thousands of plaintiffs in the military suing all sorts of policies for years. Nothing stopped the Supreme Court from ruling in McLaughlin v. Panetta (2011) that the military must recognize same-sex marriages in terms of financial benefits in the military, even though it was in direct violation of the Defense of Marriage Act. Yet here, Biden can unilaterally make everyone take an idolatrous and dangerous shot without a statute, and suddenly there is no concept of discrimination or religious liberty in the military. Good luck waiting on Kavanaugh to somehow agree one day to overturn McLaughlin.

As Justice Alito pointed out in his dissent, just one day prior, these same justices had no problem applying religious liberty protections to a murderer scheduled for execution in Texas who demanded that his pastor be present in the room to place his hands on his head during the lethal injection process. In Ramirez v. Collier, all the justices but Thomas voted to block the execution of John Ramirez, a convicted murderer from 18 years ago because Texas did not allow the pastor to place his hands on Ramirez’s head. This was done with the understanding that the policy of the Texas prison placed a substantial burden on a sincere religious belief, in violation of the Religious Land Use and Institutionalized Persons Act (RLUIPA).

Mind you, Ramirez waited years to assert this supposed “sincere” religious belief in a clear attempt to merely delay the execution. Yet the judges jumped at the opportunity to apply a religious liberty principle. When it comes to our soldiers, however, they can’t even assert the most fundamental rights to not have these SEALs’ religious beliefs be violated on their own bodies in a way that is completely irreversible.

Although the ruling was technically on the injunctive relief stage, Kavanaugh seemed to make it clear that religious liberty does not apply in the context of the vaccine mandate in the military. Plus, the disposition of this case could take years, whereby all these soldiers will have long had their careers destroyed.

It’s truly uncanny how these judges are perfectly fine with inserting themselves into broad political decisions all the time, yet when it comes to the ultimate case of granting relief to those experiencing irreversible and profound personal harms against their most fundamental liberties at the hands of unprecedentedly tyrannical and dangerous government decisions, the courts suddenly become shy.

For years, I have articulated a position in this column that courts do not have the final say over broad public policy decisions. At the same time, someone with an individualized grievance implicating a clear constitutional right affecting his body or speech has the right to seek relief in a court. I could live with a world where the judges shut the door on lawsuits against COVID policies if those same courts would also allow us to live in red states unmolested by lawsuits forcing COVID fascism on us. Yet, these courts are a one-way street with a dead end.

In Virginia, for example, a federal judge ruled the governor cannot ban mask mandates in schools because parents of 12 children in Virginia schools sued to demand that other kids wear masks. So, you don’t have the right to your own bodily autonomy and can’t count on courts to protect you from the executive branch, but when a governor allows you to breathe, then the courts can say that other people have a right to your nose and mouth, even though they themselves are welcome to continue wearing masks and enjoy the amazing protection it supposedly conveys. Don’t count on Kavanagh to rebuke that federal judge for getting involved in a local political decision.

How do I know? In May 2020, Kavanaugh had no problem joining the other liberals in allowing to remain in effect a Ninth Circuit ruling which declared it cruel and unusual punishment to not provide a sex offender in an Idaho prison with access to castration and transgender hormone therapy. A month later, he refused to join Thomas and Alito in overturning a radical Fourth Circuit opinion forcing school districts to allow boys in girls' bathrooms.

In Kavanaugh’s world view, the government is so powerful that it has the right to force you to get an experimental injection that doesn’t work to fight against transmission, but at the same time it does not have a legitimate vital interest in keeping boys out of girls’ bathrooms. Put another way, a person has a legitimate “right” to access the opposite sex’s bathroom, but that same person doesn’t have the right to be secure in his/her body against government coercion. If this is what a conservative court looks like, I’d hate to see what a liberal one is like.

In July 2021, Barrett and Kavanaugh joined with the left and denied an appeal from Barronelle Stutzman, owner of Arlene's Flowers, to assert the private property, free speech, and religious liberty right to decline to service a same-sex ceremony with floral arrangements. So, it’s not just in the military where you have no religious liberty right, but even as a private business. Also, last year the same six justices denied emergency injunctive relief to New York health care workers who were being deprived of religious liberty exemptions to the state’s vaccine mandate.

Thus, it’s quite evident that Kavanaugh doesn’t believe in defending religious liberty anywhere in any context, not just in the military. That is, except for murderers seeking strawmen, speculative, and manipulative religious claims to delay execution at the last minute.

A monthslong dispute over masks in a Chester County school district culminated Tuesday in a judge ordering all five Democrats on the school board to be immediately removed from office.

The order stemmed from a petition a parent in the West Chester Area School District filed in February, asking the Chester County Court of Common Pleas to remove the school board members on the grounds that they had voted in August 2021 to make masks mandatory in the district’s schools.

Kenneth Roos, an attorney at Wisler Pearlstine LLP, which is representing the board members, told WHYY News Tuesday night that a motion to reconsider would be filed with the court.The parent petitioner, Beth Ann Rosica, argued that under the Pennsylvania school code, districts have no authority to require all students to wear masks.

After Pennsylvania’s state of emergency first ended in June 2021, the board opted to continue requiring masks. It stood by that decision while the state reimposed a school mask mandate, and for two months after the Pennsylvania Supreme Court declared that mandate unconstitutional in December.

“Once the Supreme Court declared that was unconstitutional … we implored our school board, we asked and asked and begged and pleaded and made comments to lift the mask mandate, and they refused,” Rosica said. “When they refused, that is when we made the decision to file the petition.”

The strength of Rosica’s argument appears to have had little to do with its success, however.
In his order that the five Democratic members of the board be “removed from office,” Judge William Mahon wrote that his decision came after there was “no response” to the petition by the school district or its counsel.

In the motion to reconsider filed with the court, a copy of which WHYY obtained Wednesday, the attorneys argued that the deadline for a response was actually April 4 and disputed the timeline used, which was based on the March 15 filing date of the petition to remove the school board members. The lawyers argue that the Pennsylvania statute in question gives the school directors no more than 20 days to respond. The motion asks that the court vacate the order, reinstate the school board directors, and allow the respondents until April 4 to file a written response to the petition.

District leaders and the apparently ousted school board members did not respond to requests for comment.

However, in a letter sent out to district parents Tuesday night, Superintendent Robert Sokolowski attempted to downplay any concern that the judge-ordered ousting of the board members would stick.

“The decision states that the removal of the board members named in the petition was a ‘procedural result’ and does not address any of the allegations made in the complaint. Special counsel to the district is in the process of preparing a substantive response on behalf of those school board members named in the petition,” Sokolowski said.

He acknowledged that he didn’t have all the answers but would remain “committed” to education throughout the process. Sokolowski concluded by saying that due to the ongoing nature of the situation, he would be not able to provide any additional comment for the time being.

Judge Mahon gave both parties to the case — Rosica and the district — seven days to submit their recommendations for replacement board members. He will make the final determination about who is appointed.

Rosica is a well-known figure in the world of Pennsylvania school board conflicts, which have mounted in the two years since COVID-19 initially shut down schools.

She serves as executive director of Back to School PA, a PAC funded by a Bucks County venture capitalist that undertook a massive statewide spending campaign in 2021 in an effort to elect mostly conservative candidates to school boards.

Her petition in West Chester isn’t an isolated effort.

Rosica said four other Chester County school districts — Downingtown, Tredyffrin/Easttown, Great Valley, and Coatesville — have also filed similar petitions. Judges haven’t ruled on them yet, but Shannon Grady, a Downingtown parent and the original drafter of the petition language, said she has high hopes.

All the petitions are built on a little-known 1949 provision in the Pennsylvania School Code, which says that if a board of directors “refuse or neglect to perform any duty imposed upon it,” any 10 residents of the district can file for their removal.
Grady, who said she couldn’t find any case law showing that the provision had been used in the past, said she sees her petition as a template for other parents who believe their school boards have overreached by attempting to set public health mandates.
“I’ve shared it with people from around the state already, because all the [relevant] codes are Pennsylvania state codes,” she said. “I’m not trying to ruin school board members’ lives or sue them for money. It’s just, know your place.”

Tensions had been high in the West Chester Area School District for months.

Ahead of school board elections in November 2021, and amid rising tension over parents’ rights to dictate how schools are run, the West Chester district got national attention when the then-president of the board, a Republican, cut a conservative parent’s microphone as she spoke about critical race theory. He eventually called for an officer to escort her out of the meeting as she continued yelling.

The parent, Anita Edgarian, later mounted a write-in campaign for school board. She was one of several conservative candidates running on a platform that broadly reflected national debates, including a push to roll back COVID-19 mitigation efforts, get rid of masks, and bar curricula thought to be related to critical race theory.

That slate of candidates was one of several dozen in school boards across Pennsylvania that got at least $10,000 from Back to School PA — much more than is usually spent in school board races.

In West Chester, the money — and the parents’ choice arguments it supported — appears to have had limited effect. Heading into the 2021 election, Republicans controlled the board, 5-4. But while one GOP candidate snagged a seat, two others on the slate backed by Rosica and Back to School PA lost.

Three Democrats won, flipping the board to 6-3 Democratic control.

On Monday, the board voted, 8-1, during an impassioned four-hour meeting to keep “Gender Queer: A Memoir” on school libraries’ shelves. Privacy concerns in the district had been growing following a February request for data on LGBTQ children in the district. That Right to Know Law request was largely denied by the district.

Masks also remained an ever-present source of conflict.

After maintaining a mandatory masking policy for two months after the state’s school mask requirement was declared unconstitutional, the district ended its mandate at the end of February, citing plummeting COVID-19 case rates.

But for Grady, that’s not a reason to call off the quest to oust board members. West Chester, she noted, always left open the possibility of reinstating masking if cases rose again.

She wants a harder line in the sand than that.

“Public officials have been overstepping their powers,” she said. “I don’t care what the CDC says, I don’t care what the governor says, they don’t have the power to dictate what happens in our schools.”

Hours after the Food and Drug Administration (FDA) authorized a fourth shot of the Moderna and Pfizer COVID-19 vaccines for all Americans 50 and older, an FDA official said a fifth shot may be needed in the fall.

“I don’t want to shock anyone but there may be a need for people to get an additional booster in the fall, along with a more general booster campaign if that takes place, because we may need to shift over to a different variant coverage,” Dr. Peter Marks, head of the FDA center that regulates vaccines, told reporters on a call on March 29.

Why would the Governor of Massachusetts and a top Pfizer executive (or at least some type of Pfizer representative) be having dinner together in Park City, Utah where they were discussing a tit for tat type deal?

Cause a few days ago, that happened at the restaurant my wife works at where she witnessed this first hand.

Judge Blocks COVID-19 Vaccine Mandate for Navy

A judge blocked the U.S. military’s COVID-19 vaccine for all Navy members seeking religious exemptions.

Indeed, the preliminary injunction that previously covered 35 Navy SEALs now covers around 4,000 others, the Epoch Times reports.

U.S. District Judge Reed O’Connor agreed to expand it because all members who applied for religious exemptions “have all been harmed in essentially the same way.”

“Each is subject to the Navy’s COVID-19 vaccine mandates. Each has submitted her religious accommodation request, and none has received accommodation. Without relief, each servicemember faces the threat of discharge and the consequences that accompany it. Even though their personal circumstances may factually differ in small ways, the threat is the same – get the jab or lose your job,” he said in a 27-page order.

As of March 23, 3,320 Navy members have requested a religious exemption, along with 864 reserve members. 630 Navy members have been removed for refusing the vaccine.

With exactly ZERO exemptions issued, it seems logical that the next step would lawsuits against Uncle Sam for clear cases of religious discrimination across the board. I would rather see my tax dollars spent on settlements for patriots than the garbage the democRATs want the money earmarked for.

That's what's happening.
But... lawsuits against Uncle Sam aren't easy for 2 reasons: 1. Uncle Sam has unlimited resources to fight these lawsuits. 2. Justices like Roberts and Kavanaugh don't want to take a stand.

UK reaches record COVID levels; nearly 5 million infected

The prevalence of COVID-19 in the U.K. has reached record levels, with about 1 in 13 people estimated to be infected with the virus in the past week, according to the latest figures from Britain’s official statistics agency.

Some 4.9 million people were estimated to have the coronavirus in the week ending March 26, up from 4.3 million recorded in the previous week, the Office for National Statistics said Friday. The latest surge is driven by the more transmissible omicron variant BA.2, which is the dominant variant across the U.K.

Hospitalizations and death rates are again rising, although the number of people dying with COVID-19 is still relatively low compared with earlier this year. Nonetheless, the latest estimates suggest that the steep climb in new infections since late February, when British Prime Minister Boris Johnson scrapped all remaining coronavirus restrictions in England, has continued well into March.

The figures came on the same day the government ended free rapid COVID-19 tests for most people in England, under Johnson’s "living with COVID" plan. People who do not have health conditions that make them more vulnerable to the virus now need to pay for tests to find out if they are infected.

"The government’s ‘living with COVID’ strategy of removing any mitigations, isolation, free testing and a considerable slice of our surveillance amounts to nothing more than ignoring this virus going forwards," said Stephen Griffin, associate professor at the University of Leeds’ medical school.

"Such unchecked prevalence endangers the protection afforded by our vaccines," he said. "Our vaccines are excellent, but they are not silver bullets and ought not to be left to bear the brunt of COVID in isolation."

More than 67% of people 12 years old and above in the U.K. have been vaccinated and had their booster or a third dose of the coronavirus vaccine. Beginning Saturday, parents can also book a low-dose vaccine for children between 5 to 12 years old in England.

James Naismith, a biology professor at the University of Oxford, said he believed that except for those who are completely shielded or not susceptible to the virus, most people in the country would likely be infected with the BA.2 variant by the summer.
