Appeals Court Questions Judges’ Authority to Review Trump’s Deployment of Troops to LA

California Gov. Gavin Newsom has sued the administration over the deployment.

Members of a federal appeals court on June 17 questioned what role courts should have in reviewing President Donald Trump’s authority to deploy the National Guard and U.S. Marines to Los Angeles.

The three-judge panel of the San Francisco-based U.S. Court of Appeals for the Ninth Circuit is considering the Trump administration’s bid to extend a pause it issued on June 12.

On that day, the appeals court granted a request by the administration to temporarily stay a lower court order issued by District Judge Charles Breyer, directing Trump to return control of the California National Guard to California Gov. Gavin Newsom.

The appeals court did not provide details regarding its legal rationale when handing down that ruling.

The president deployed National Guard troops to the longtime sanctuary city earlier in June amid protests over Immigration and Customs Enforcement (ICE) operations.

Newsom is suing to block the federal government’s deployment of troops, arguing that it is illegal and exceeds the president’s Title 10 authority.

During the June 17 hearing, the members of the judicial panel did not immediately rule on the administration’s request to extend that pause but pressed lawyers on both sides on whether courts could review Trump’s decision.

Ninth Circuit Judge Mark Bennett began the hearing by asking Department of Justice lawyer Brett Shumate whether the department’s position is that the courts have no role in reviewing the president’s decision to call the National Guard.

“There is no role for the court to play in reviewing that decision,” Shumate said. “The statute says the president may call on federal service members and units of the Guard of any state in such numbers that he considers necessary.”

Shumate noted the protests remain ongoing in Los Angeles and said the National Guard is necessary to protect federal officers and buildings.

In a June 7 memorandum, Trump said that he was calling members and units of the National Guard into federal service under a provision of Title 10—Section 12406—to “temporarily protect ICE and other United States Government personnel who are performing Federal functions, including the enforcement of Federal law, and to protect Federal property, at locations where protests against these functions are occurring or are likely to occur based on current threat assessments and planned operations.”

The law allows the president to place National Guard troops in federal service if “there is a rebellion or danger of a rebellion against the authority of the Government of the United States” or if the United States “is invaded or is in danger of invasion by a foreign nation.”

In his earlier ruling, Breyer said that Trump unlawfully took control of California’s National Guard and deployed 4,000 troops to Los Angeles against Newsom’s wishes.
The judge said Trump’s actions both exceeded the scope of his statutory authority and violated the 10th Amendment of the U.S. Constitution.

“He must therefore return control of the California National Guard to the Governor of the State of California forthwith,” Breyer wrote.

His order, before it was stayed by the appeals court, allowed Newsom to take control of the National Guard while the governor’s lawsuit against the administration proceeded.

Trump also ordered 700 Marines to the city after deploying the National Guard. Breyer has not yet ruled on the legality of the Marines’ mobilization.

During the June 17 hearing, Samuel Harbourt, the lawyer representing California, said that blocking Breyer’s ruling would “profoundly injure the state of California and our nation more generally.”

“It would allow defendants to further escalate tensions and the risk of violence in the city of Los Angeles,” Harbourt said. “And it would defy our constitutional traditions of preserving state sovereignty, of providing judicial review for the legality of executive action, of safeguarding our cherished rights to political protest and of keeping the military.”

Shumate disagreed, saying that only Trump has the authority to determine whether the National Guard should be called in. He said his failure to include Newsom in the decision was at most a “technical violation” of the statute.

“The governor is merely a conduit, not a roadblock or a core executive, when the president decides it’s necessary to call out the Guard,” Shumate said.

Agreed on the 9th appellate court taking this one and issuing a no nonsense ruling is a surprise.

Then again, considering they are Federal Judges, in a Federal Building in San Francisco, and are at risk of being targeted and attacked by the paid for rioters.

Imagine they'd like to have the Guard at the courthouse.... and can't trust Newscum to have their backs.

A US Attorney for New York was allegedly chased by a knife-wielding illegal immigrant with a lengthy criminal record who threatened to slit his throat on the streets of Albany Tuesday night, prosecutors said.

John Sarcone, the Trump-appointed US Attorney for the Northern District of New York, was allegedly chased and threatened outside the Hilton Hotel in Albany by Saul Morales-Garcia — an illegal migrant from El Salvador who was previously deported, WNYT reported, citing Albany County prosecutors.

Morales-Garcia, 40, allegedly aggressively advanced toward Sarcone with his weapon in hand — gesturing that he would slit the attorney’s throat as he lunged at him before chasing the US attorney down the street outside the hotel just before 10 p.m. Tuesday, that report stated citing local police.

Sarcone was uninjured, and nearby Albany County sheriff’s deputies picked up Morales-Garcia just moments after the alleged attack, according to local cops.

The alleged attempted slasher was previously convicted of a felony in El Salvador and has been deported from the United States at least once in the past, WNYT reported, citing investigators.

Albany County prosecutors said the incident appeared to be a “random” street encounter.

Morales-Garcia is currently in the country illegally and has a criminal record in at least three other states outside of New York, prosecutors said.

He is charged with attempted second-degree murder and is being held without bail, the Albany Times Union reported.

The Department of Homeland Security (DHS) reported that 250 protesters stormed a U.S. Immigration and Customs Enforcement (ICE) field office in Portland, Oregon, launching fireworks and using lasers to blind federal agents. The incident drew significant attention due to the level of violence involved.

DHS Assistant Secretary Tricia McLaughlin described the event as a “violent targeting” of federal law enforcement.

“Last night, Portland rioters violently targeted federal law enforcement—250 rioters launched fireworks, shined lasers in officers’ eyes to temporarily blind them, and stormed an ICE field office,” she stated. “We won’t sit idly by and watch these cowards,” she vowed.

According to the Portland Police Bureau, arrests were made during the chaos. Eduardo Diaz, 22, was detained for allegedly pointing a laser at officers while wearing a ballistic vest and gas mask. He was charged with Unlawful Directing of Light from a Laser Pointer. Another individual, Mariana M. Rivera-Loza, 19, was arrested for trespassing in a restricted area.

Federal agents responded to the attack using flashbang devices and pepperballs. McLaughlin emphasized the challenges faced by law enforcement, citing a 413 percent increase in assaults on officers. “ICE and our federal law enforcement partners will continue to enforce the law. And if you lay a hand on a law enforcement officer, you will be prosecuted to the fullest extent of the law,” she warned.

This incident is just the latest act of violence by far-left extremists against federal agents—a particular problem in Portland, where Antifa members have been mainly shielded from prosecutions at the local level by leftist officials in recent years.

My gut reaction is that eye laser crosses the line, because permanent blindness can result. (But then throwing rocks can also cause permanent injury). At which point superior violence should be applied against the rioters, protecting the agents and deterring future rioters.

But what a tricky situation. The agitators behind the scenes, i.e. Soros etc, want dead protestors in the hopes it triggers widespread chaos. Yet the government can't allow small events to encourage incrementally larger events that become the same widespread violence the agitators seek. The 2020 riots should never be allowed to repeat, but Kent State didn't settle things down either.

I'm glad I don't have to make the decision on rules of engagement, where reality happens, vs sitting here in my comfy chair.
