Newsom Files Emergency Restraining Order After Trump Activates Additional National Guardsmen For LA Riots

Update (1521ET): California Governor Gavin Newsom says the state is seeking a temporary restraining order (TRO) to block President Donald Trump from deploying troops to Los Angeles to deal with violent protesters.

"Trump is turning the U.S. military against American citizens. The courts must immediately block these illegal actions," Newsom wrote on X.

Gov. Gavin Newsom’s lawsuit against President Donald Trump over the deployment of the National Guard to Los Angeles is in the hands of a federal judge who is the younger brother of retired Supreme Court Justice Stephen Breyer.

U.S. District Judge Charles Breyer, a former Watergate prosecutor nominated to the bench by Bill Clinton in 1997, was assigned to Newsom’s case Tuesday, a day after California officials sued to reverse Trump’s order.

California Attorney General Rob Bonta filed the lawsuit in the U.S. District Court in San Francisco, citing the presence of his and other state offices in that city as justification for the choice of venue. Breyer is one of 13 judges in that courthouse and was assigned the case through a random process overseen by the court clerk.

Breyer, who attended Harvard before getting his law degree from the University of California, Berkeley, was confirmed by unanimous consent in the Senate and has served as a judge in the San Francisco-based federal court since. Notably, Trump himself nominated Breyer in 2018 for a second term on the U.S. Sentencing Commission.

Breyer, 83, will decide whether Trump had the legal authority to federalize 4,000 California National Guard troops amid street protests over the administration’s immigration raids in Los Angeles. Newsom argues that the move was unlawful because Trump bypassed a requirement to coordinate with the governor’s office and called up the troops over Newsom’s objection.

In a 2023 appearance at the Supreme Court alongside his brother, Breyer recalled that he was a local prosecutor during unrest in the Bay Area in the 1960s and 1970s but pressed on with his day-to-day work.

“I was an assistant district attorney. There were riots in San Francisco, over Vietnam over at San Francisco State, close it down,” Charles Breyer said. “You did your task, which didn’t mean that you weren’t aware of what was going on or not sensitive to what was going on or tried to understand what was going on, but it meant you had a task.”

In 2008, at a public talk alongside other former Watergate figures, Breyer said the Nixon-era scandal proved the value of the Constitution — and in particular, the First Amendment protections for those who “speak out against the government.”

“We were told from Day One, why are you doing this? You’re tearing down the presidency. You’re making it very difficult for the president of the United States to discharge his obligations,” Breyer recalled. “And our answer really was that the Constitution was set up … to allow an examination of the way our government operates. And that’s what happened.”

What exactly is fuckstick doing to stop the riots? If nothing, then I think it is basically good Samaritan, if not outright obligatory, for the feds to step in and help the citizens of LA and quash the riots. Who honestly wants the riots to continue other than the paid soros idiots or illegals?

When I watch the news feeds coming from LA I can't help but shack my head and want to explode inside.
How the hell do they think(police) the answer to being attacked is to hide under the highway over pass while rioters above and along side the over pass are throwing chunks of rock that they have broken off concrete with hammers to be thrown at the police.
Especially since they have hundreds of law Enforcement everywhere this is happening and allowing it to happen to there fellow officers.

I would think they have to same rights as a civilian. I doubt that they were told to go ahead and get beaned by a hunk of concrete or shot with fireworks, or have a unknown substance thrown on you, or beat by a crowd of insurgents.

A civilian should be allowed to use deadly force in any of these situations. "Fear of grave bodily harm or death" is the usual requirement to use deadly force.
Are the Law Enforcement agents involved been told to turn the other cheek?
If so the Cops should stay home and let the shit pile burn while the upper echelon politicians play there games.
One day of exercising the rights of a human being to defend themselves would stop this nonsense.
Rocks thrown, Fireworks fired at police,fire bombs, or a physical assault, or any thing that satisfies the DEATH, OR FEAR OF GRAVE BODILY HARM TO YOU OR SOMEBODY NEAR YOU should be acted upon with the use of deadly force.

That is the only way any of this will end.The battle field should be stacked way above the supposed rights of these walking felons.

The organizers of this insurrection across the country should be ID and prosecuted to the full extent of the law, in federal court.
If we don't already know who is behind this we need new leadership in our intelligence community.

I remember after 9/11 rumors that suspected terrorists were sent away by black ops to undisclosed eastern European countries for interrogation were reported. Might need to try this approach again. Bring them back after a "stay" and of course deny that they were ever there.
Lets see how fast they want to try this insurrection garbage again.
Superior force is the only way to solve this problem.

In Chicago there was a time when this nonsense was NOT tolerated.

The "No Kings" website shows about ten planned protests this Saturday around the greater valley area. Thankfully nothing right near where I live so far. Wife had been talking about going to this museum thing up on the north end, I think we're gonna just stay home. Might fire up the grill.

Made some changes on a few rifles recently, need to head to the range tomorrow and confirm zero, then clean everything. I didn't do everything I wanted to do to prepare for another lawless summer, but we're in a far better spot and better prepared than we were in 2020, that's for damned sure.

I had a few friends in LAPD, they left a long time ago for greener pastures. I gotta say, 90% of the rank and file Cops: LAPD, NYPD, Detroit, Miami, Pigsknuckle Arkansas, and here in Chicago have no problem breaking out the nightstick and going to town on these assholes and doing what needs to be done. There’s still Cops that I know that are going through the long, drawn out and painful investigations for civil rights violations, wrongful arrests and excessive force complaints from the 2020 Riots!
30, 45, 60, 180, 365 day suspensions. Lawsuits. Some facing termination.

Being in the actual RIOT doesn’t bother me. I can deal with the chaos.
Dealing with the bullshit that comes after- THATS WHAT BOTHERS ME!

Do you think Target, Home Depot, Starbucks is going to give me a job, making what I make now, after I get fired and sued for beating the ever-lovin’ shit out of one of those “mostly peaceful protesters” that were fucking up their store?

One fuck-up on the mountain of paperwork related to a “use of force” incident stemming from a “mass arrest” situation like what’s happening now- and that Cop is fucked. I just hope LAPD, Washington DC Police, Boston, NYPD is better…
There’s more than a few Seattle cops that were in the unemployment line after 2020.

I’m not saying that I’m not going to do my job, or let any of my guys not do their job, but I’m going to ask them the important question “Is it worth it?”
All of the Law Enforcement involved in this are nothing more than pawns in a fucked up game.
Trust me, we WANT to go out and beat these fuckers into the pavement, then deport ALL OF THEM- to some shithole, 3rd world country. But reality is much different than “want”.

Dirty little secret is the “average” urban city only has about two sworn police officers for every 1000 residents.

My guess, the farther left the city the lower that average is due to attrition from vax mandates and generalized disgust at liberal policies hamstring officer efforts to go after criminals.


With funding, organization, and sufficient “useful idiots” any city could very quickly be overwhelmed and at the mercy of the hoards of rioters with little to lose and not much expectation of being caught or held accountable.


Sooner the uprising meets substantial force, no mercy mass arrests, and real charges the sooner they will realize it isn’t worth it and scurry off like roaches when the lights come on.

I was in Europe during that little fiasco called the breakup of Yugoslavia, someone I worked with said prophetically that is probably the USA's future. I said yea but on steroids, was really hoping I would never see it. That was horrific on a whole new level and from what I have learned they did not even cover 10 percent of what happened there on the news here. These imbeciles have no idea what they and their unpatriotic BS are steering towards.
