Problem is the jury comes from Asheville. And while most GDC are avoiding the womans march UNC Asheville has the March leader and fan of Farrakhan as a speaker next week.

Everyone's been saying sooner or later these kids are going to pick on the wrong person - there's the result. As far as the girl, a normal 12 year old doesn't stand outside of malls and pick fights with adults. In a situation like that (crowd and out numbered) I would not expect anyone to ask how old you are before defending themselves. Hopefully for him, if it gets that far, a jury finds he was defending himself and his family and the girl walked into a fist at the wrong time.

There's insufficient information in the video. What is seen, however, is the apparent wife and child standing outside the ring of girls (calmly), and a group of very young, small girls laughing at the man. He's heard angrily shouting, then attacking one of the girls. There's no indication of him being hit or struck until he knocks the girl to the ground.

He doesn't hit her with his fist, but with his left elbow. That particular strike is typically learned, not instinctive, and if it comes out that he has any martial training, on top of his size, he's going to fight a losing battle in court no matter what the circumstances.

He had better hope that something other than a shaky cell video emerges, such as a security camera, that can substantiate his position and give more context, otherwise he's getting crucified.

--After reviewing the video several dozen times frame by frame, I can see him slapped twice open palm (from the side and rear) by girls, and the recording appears to pick up the sound of slaps or objects thrown; the camera moves too much and there's too much background noise.

The girl who is struck approaches him with her hand open in a pointing gesture when he shoves her to the ground.

North Carolina, I believe, has no duty to retreat, though clearly some of the girls go back into the building/mall during the encounter, and one is left to wonder if he could have done so or moved away, too. Again, too little information provided.

Of particular interest to me is the woman standing behind the girls with a child next to her. She is not acting particularly concerned nor protective of the child, and the child isn't hiding behind the mother or taking shelter; two items which may become important as the video is broken down.

There are adult witnesses. I'm sure if it's a mall there are cameras. I'm also sure we're only seeing a small piece of the picture, and only a very small part of the story.

From the little bit that shows, however, I don't see a violent street gang. I see a bunch of young girls chirping, laughing and hardly in an agressive posture, and I see a woman and child directly adjacent who don't look frightened. I see a large man screaming at the girls and advancing on them and I see him applying what could easily have been a lethal blow to a girl who's likely a third of his weight, and half his height, if that. She appears to be sassing him when he pushes her, but I see a very large man knock a little girl down, then strike her to apparent unconsciousness.

I bet a jury sees that, too.

That scene reminds me of those from nature where a pack of wild dogs attacks the prey animal.

She cleary came back and raised both fists, squared up to strike, after she had (in this portion of the video)initiated contact. There are 12 year olds at our dojo that can mop the floor with bigger people. He clocked her with his hand (don’t know where the elbow mentioned above was seen- that’s a punch, and not even particularly well thrown) in defense to her threat.

Proves a head shot can disperse a crowd...

I normally don’t condone punching 12 year old girls......but put me on this jury & he walks, maybe with a medal.

I hope he punched her sterile. Ya know, for the health of our country. I'd think that after seeing what happens when you poke a bear the other little dipshits in attendance would learn a valuable lesson but I'd be too optimistic.

She's really lucky he didn't just punch her in the throat. That would probably have killed her.

Some more details in the Asheville paper. Apparently, the guy's lawyer says he was undergoing long-term treatment for a brain injury and PTSD. But the lawyer also went into some detail about what happened.
