Biden seeks $47B for Ukraine, COVID-19, monkeypox, disasters https://apnews.com/article/rus...32baa2fab90001a11148 WASHINGTON (AP) — President Joe Biden is asking Congress to provide more than $47 billion in emergency dollars that would go toward the war in Ukraine, the response to the COVID-19 pandemic, the ongoing monkeypox outbreak and help for recent natural disasters in Kentucky and other states. The request, which comes as lawmakers are preparing to return to Washington and fund the government, seeks $13.7 billion related to Ukraine, including money for equipment, intelligence support and direct budgetary support. Shalanda Young, the director of the White House Office of Management and Budget, said that more than three-fourths of the $40 billion approved by Congress earlier this year has already been disbursed or committed. “We have rallied the world to support the people of Ukraine as they defend their democracy and we cannot allow that support to Ukraine to run dry,” Young said in a blog post. The White House request will play into congressional budget negotiations in the coming weeks as financing for federal agencies is set to run out Sept. 30. Both parties will be seeking to avoid a government shutdown in the weeks before the midterm elections, but they will have to work out differences over issues like the COVID-19 aid, which has been a sticking point for many months as the White House has said more money is needed for vaccines and testing and Republicans have pointed to the trillions that have already been approved. In Friday’s request, the White House is seeking $7.1 billion to procure additional vaccines and for replenishing personal protective equipment in the Strategic National Stockpile, among other measures. Another $8 billion would go to accelerate research for next-generation vaccines and therapeutics. Biden is also seeking $2 billion to continue COVID-19 testing programs, including an initiative to distribute free at-home tests that ended on Friday as the government says it is running short on funds. White House officials say they have some tests left in the stockpile, but not enough to provide free tests if cases sharply increase. Congress has not moved forward on similar administration requests for the COVID-19 response amid the partisan stalemate. White House press secretary Karine Jean-Pierre said the White House has repeatedly warned that there would be trade-offs if that money wasn’t approved, and “that is precisely what happened.” The lack of free testing kits, for example, “leaves our domestic testing capacity diminished for a potential fall surge,” she said. The administration is also asking for $4.5 billion to bolster its efforts to fight monkeypox amid the ongoing outbreak. Officials said they have already depleted significant reserves from the national stockpile to provide over 1.1 million vials of vaccine. The money would help ensure access to vaccinations, testing and treatment, and also help fund the global effort to fight the disease, administration officials said. For disaster relief, the White House is asking for $6.5 billion, including money for the Federal Emergency Management Agency’s disaster relief fund, farmers affected by weather events and efforts to increase the resilience of the electric grid. What, in the last 20 months, where's the progress?" asked Fox Business correspondent Edward Lawrence. Obama Appointed Judge Rules in Favor of Biden on Wyoming Oil Lease Pause https://www.theepochtimes.com/...hTXJBlh6TAgK4JGFMO2t A federal judge sided with the Biden administration in a lawsuit related to the government halting oil and gas leases in the state of Wyoming. On Jan. 27, 2021, President Joe Biden issued an executive order instructing the Department of the Interior (DOI) to temporarily pause all new oil and gas leases on federal lands and offshore waters until an assessment is completed to determine the potential “climate and other impacts” of such actions. The DOI secretary postponed most scheduled leases in Q1 2021, and did not carry out any lease sales in Q2. The Mineral Leasing Act (MLA) of 1920 grants authority to the DOI secretary to lease federal land for developing natural resources. The Petroleum Association of Wyoming and the Western Energy Alliance filed a lawsuit against the DOI’s actions on Jan. 27, 2021. On March 24, 2021, the state of Wyoming filed its lawsuit. Both cases were then consolidated into one. Petitioners alleged that the DOI’s actions were not in line with governing law, were arbitrary or capricious, and were an abuse of discretion. U.S. District Judge Scott W. Skavdahl looked at whether the industry petitioners and the state of Wyoming had the standing to challenge the DOI regarding its leasing actions in the first two quarters of 2021. In his ruling (pdf), the judge pointed out that the lease postponement or cancellation decisions taken by the DOI only took place after Jan. 27, 2021, when the two industry petitioners had filed the lawsuit. As a result, the industry petitioners lacked the standing to challenge the DOI’s actions, Skavdahl judged. With regard to the state of Wyoming, Skavdahl noted that the DOI had postponed all March 2021 lease sales as of March 24 when the petitioner filed its lawsuit. As such, Wyoming only has standing to challenge the DOI’s postponement of March 2021 lease sales and not “anything beyond the first-quarter lease sale postponements in this lawsuit.” Blocking Biden’s Oil Lease Pause Skavdahl’s ruling comes weeks after another federal judge issued a permanent injunction against Biden’s temporary halt of oil and gas leases. Terry Doughty, U.S. district judge for the Western District of Louisiana, ruled on Aug. 18 that the White House overreached itself with the ban. The judgment came as part of a lawsuit filed by 13 states. The judge noted that the MLA requires the DOI to hold lease sales on eligible lands. “By stopping the process, the agencies are in effect amending two Congressional statutes. Neither the OCSLA (Outer Continental Shelf Lands Act) nor the MLA gives the Government Defendants’ agencies the authority to implement a Stop of lease sales,” Doughty, a Trump appointee, said in the ruling. The project from the National Institutes of Health was launched in August and will study the effectiveness of "harm reduction kiosks" in rural Appalachia that contain "injection equipment, naloxone, fentanyl test strips, hygiene kits, condoms, and other supplies." The vending machines allow drug users to obtain items such as syringes without interacting with a health professional, in hopes of eliminating the "stigma" that comes with visiting an in-person harm reduction facility, according to the health agency. The White House referenced the project in an August 31 press release on its actions taken "to address addiction and the overdose epidemic." The administration has adopted a wide range of harm reduction policies, which aim to make illicit drug use safer rather than eliminate it. The Washington Free Beacon in February reported that the Department of Health and Human Services was set to fund the distribution of crack pipes through a $30 million harm reduction grant program. The administration backed off the funding plans amid public backlash, and the New York Times reported that the uproar over plans to fund crack pipes "derailed" Biden's drug policy agenda. The White House, however, still appears willing to adopt controversial harm reduction policies—the New York Times reported in July that Biden's drug czar Dr. Rahul Gupta was supportive of legalized injection sites, which allow users to take drugs with supervision from health professionals. The new study, which is conducted by the University of Kentucky, appears to be the first effort from the federal government to deploy harm-reduction vending machines. Harm reduction vending machines have been popularized in Canada, Australia, and other countries. A few U.S. states, including New York, Rhode Island, Ohio, and Nevada, have deployed the machines in recent years. The machines sometimes include smoking kits, which in many cases include crack pipes. The University of Kentucky declined to comment, directing the Free Beacon‘s inquiry to the NIH. The National Institute on Drug Abuse, which heads the project at the NIH, told the Free Beacon that along with drug paraphernalia, the vending machines will include "food kits, water, socks and gloves, feminine hygiene products, wound care, and resources/guides."
