Because after being on the court for a very long time they develop a godlike complex where they think the seat belongs to them, and that they are so important the court couldn't function without them. My bet is Breyer will do everything in his power to try and hang on until 2024 when maybe a Dem president will be in place to replace him. Lucky for all of us, health is a real wildcard when you're 82+. I'm quite sure Scalia didn't expect to kick off when he did. Can you imagine the liberal meltdown if Trump got a fourth SCOTUS pick? I was unfortunately unable to watch the proceedings last night but turned in here first this this am. All I can say is how proud I am of Donald Trump for nominating one of the true legal heavyweights in this country and the fact that she didn’t come from Harvard or Yale and has school aged children could bring a sorely needed new perspective to the court. AS I understand it they were following a practice of deferring to the States Senators to provide a list (Blue Slip) of allowable Circuit Judges that set the pool from which to select Justices. Plus there was the filibuster, no one had the guts to go nuclear. Then the practice of Borking a justice candidate was begun by Teddy Kennedy to give notice not to select from outside the approved middle road (liberal justice pool). Also, Harry Reid changed the rules to a simple majority vote to get obamacare through. Before that the pres had to select someone a 2/3 majority could pass. Now just 51 votes are necessary so the nominee can be more purely conservative or Leftist. You’re a lying dog-faced pony soldier | |||

I don't think you have that right. Legislation still requires a 2/3rds vote. Harry Reid did change the rules for federal court judges to a simple majority though. There are some Senate actions (overturning vetos, voting articles of impeachment, etc.) that need a 2/3 majority (67 votes) but passing legislation still just needs a simple majority to pass, once it's put to a vote, as has always been true. Senate rules have come to require 60 votes to end debate (or stop a filibuster) and proceed to a vote. Dems are coy about their intent to get rid of the filibuster altogether, because they fear that if they show their hand before they know for sure they'll have control of the Senate, then they will have given McConnell the moral high ground to do 'hit them back first.' As you note, Reid's "nuclear option" only got rid of the filibuster on court nominees (other than Supremes) and had no effect on passing legislation. What Reid did do to get Obamacare through (slight thread drift - sorry) was to waive rules to rush it through once Scott Brown (R-MA) won the special election after Ted Kennedy passed. It is hard to imagine now, but until Brown got in, that particular Senate was so soaked in blue that the Dems had 60 seats! Brown gave the Republicans 41 seats, and thus a filibuster option, so Reid was bound and determined to get Obamacare through before the Republicans would have a seat at the table. | |||
