Although the reporters state that he was leaving, the video gives me the impression he was just going back to threaten those at the front of the store again. He turned his back on everyone several times. One time too many.

If I were the lawyer* for the shooter who was charged or sued, the defense seems obvious to me.

How do we know that he was leaving and had stopped his threatening behavior? Merely because he was walking away from the shooter when shot doesn’t prove anything. He walked around in a random pattern and could have turned around at any time or continued circling around, and what if he’d then seen the victim holding a gun. It would be reasonable to assume that he was posing a deadly threat to not only everyone else in the establishment, but directly to the shooter. Even in other parts of the country it’s not always necessary to come under fire or other direct assault to be justified in defending oneself.

That of course is just my take on the situation and there’s no guarantee that a jury would always reach the correct verdict. If the BG was already out the door and running away, then it would be claimed that the threat he posed had entered, but while he was still inside waving the gun around—?

My IDPA club used to go for dinner after our weekly match. We were all at our usual place, about six or seven of us, armed to the teeth, as you would expect. Two armed robbers decided to rob the take-out pizza joint two doors down from the place we were on one of those nights. They don't know how lucky they were.

What would they say in the Armed Robber's defense otherwise: He had already pointed his gun in a threatening manner at each person and every person present in the Ranchito Taqueria, so they ALL shoulda known he wouldn't hurt nobody! Neither of those are anything like this case. In the Lufkin one, the robber shot a customer. The other one was in California.

Maybe it's like around here where the response time is like 30 minutes. Can't wait around forever.

If he had time to return everyone's shit, then he was there for at least a little while. It's not like he ran out of there.

Not sure about Texas, but in some places there just aren't any cops on duty at night.

The perp still had the gun out and was waving it around. He was not out of the store. The threat was still in play. The defender never acted to follow the perp. In fact he never got out of his seat.

This cat got ventilated at close range and from behind, and he had it coming. Judging by the bullet holes in the glass of the entrance, it looks like the shooter kept on the trigger as our hapless would-be robber left this existence.
