The USSC has not ruled so the claim of 100% could be seen as an opinion. In fact even after the USSC rules, one can have an opinion regarding Constitutionality that differs from the high priests in black. If it is only someone's opinion, then I shouldn't have commented, because then it is simply someone's judgment, and not truth (or fact).
