The ninth circuit is an absurd joke. So because some universities in Washington state have students that can't attend class or some such ridiculousness, the national security of the United States which is in jeopardy as deemed by the President must take a back seat.

I'm disgusted.

Because seating him may be months away... nomination <> seating/confirmation.

The next step is a hearing en banc before the entire court, if the court will grant it.

By the time it gets to the Supremes, the EO will have expired by its own terms.

Trump can have his legal guys sharpen their word processors and craft an EO to avoid these perceived injustices and go with that.

While that is going on, one party may ask Justice Kennedy who supervises the 9th Circuit to do something. I'd say likely not on this.

By then Justice Gorsuch will be on the bench and all will be well, eventually, as well as it may get anyway.

And when will that happen? This case could take a year to get to the Supreme Court.

This was originally just a 90 day halt!

Interesting that the temporary order from the court will be moot in a few months.
The court did not rule on the total numbers of refugees already set for fiscal year 2017 and left that unchanged.

That number is 50 thousand for this year. I read recently that about 35 thousand or more have already arrived for fiscal year 2017.

Therefore, the cap will be reached soon and no more refugees will be able come in once the 50 thousand is reached until fiscal year 2018.

Kind of funny actually.

If I were Trump, I would skip en en banc hearing and go straight to the SCOTUS. The rules of the 9th Circuit say that the en banc hearing includes the 3 judges who heard the original case - so it's an uphill battle from the start.

The law is so overwhelmingly clear on this issue that I would not be surprised to see Trump win even in an 8 person Supreme Court. Sotomayor has the IQ of a rock and Ginsburg is so reflexively liberal , but I don't know that Kennedy, Kagen or Breyer would want to stand behind this 9th Circuit opinion that is so contrary to the law. It really is that bad that I could see a 6-2 decision against it.

I agree with this. When it comes to the 'Nutty Ninth" even the SCOTUS has no appetite for BS. There have been a few unanimous overturns of the Obama lawlessness. I do not like Kagen or Sotomayor but occasionally the fog clears.

Neither court must grant a hearing. In any event, the best thing probably is to rescind this order, mooting the cases, redraft an EO with the criticisms in mind, and issue another.

BTW, the acting AG said she wouldn't enforce this order, but we were told it had been vetted by the Office of Legal Counsel before Trump signed it. I would have expected the issues raised in the case to have been dealt with at OLC and drafted around.
