I recently e-filed 3 Form 1 (Individual). Got 2 DISAPPROVAL emails this morning. Nothing yet on the 3rd one. Here is what I submitted.

1. Factory Sig Flux Legion (P320). On the application form, I used the drop down box on Section (Model), selected “P320 Flux Legion”. I only sent a close up picture of the Serial Number.
On the Denial Letter, these are the messages:

WEAPON: ORIGINAL MANUFACTURER, SERIAL NUMBER AND/OR MODEL SHOULD MATCH EXACTLY AS IS STAMPED OR ENGRAVED ON FIREARM

MODEL = P320

PLEASE RESUBMIT WITH CORRECTED INFORMATION. FINGERPRINT CARDS AND PHOTOS MUST BE SUBMITTED WITH YOUR NEW APPLICATION. REFUND IN PROCESS.


NOTE: UPLOAD PHOTOS FOR VERIFICATION: SN/MFG./MODEL (CLOSE-UP).


2. H&R 9mm pistol with brace. On the application form, I used the drop down box on Section (Model), selected “SMG MOD 635”. I only sent a close up picture of the Serial Number.
On the Denial Letter, these are the messages:

WEAPON: ORIGINAL MANUFACTURER, SERIAL NUMBER AND/OR MODEL SHOULD MATCH EXACTLY AS IS STAMPED OR ENGRAVED ON FIREARM

MODEL = 635

A Based on the ATF messages, did I messed up on the “MODEL”? When I resubmit, do I just change that part of the form to what they specified (P320 & 635)?

B. What photos do I specifically send? (I only took a close up picture of the SERIAL NUMBER of the Flux Legion and a close up picture if the information on the receiver of the H&R pistol).


I tried calling ATF this morning and couldn't get through. I am trying to finish these forms before the end of December.

First of all, just because there is something you can select from a drop-down menu, does NOT mean that it is either accurate, or that the ATF has ever approved a Form 1 with that info. That may seem surprising, but I can assure you it is a true statement. This came up during the Pistol Brace Amnesty pursuant to ATF Final Rule 2021R-08F, and I believe eForms was fairly new/evolving at the time. It make NO sense, but that how the .gov works!

They seem to be providing you with some very specific (and surprisingly helpful) information, and they are not kidding when they say 'EXACTLY AS IS STAMPED OR ENGRAVED ON FIREARM'. Give them exactly what they're asking for...UPLOAD PHOTOS FOR VERIFICATION: SN/MFG./MODEL (CLOSE-UP).

MODEL = P320...Flux and Legion are just marketing terms

MODEL = 635...SMG is just marketing


Re: the P320, where are you expected/planning to engrave your Maker's info on that thing?

Just received the 3rd DENIAL on the other 635. The letter specifically said “Corrected Model is 635”.



So is it safe to assume that I just need to change the MODEL to what ATF had indicated?

MODEL = P320
MODEL = 365

For picture, no need to send a photo of the entire firearm?

On the engraving of the P320, there is a blank space on the left side of the FCU. There is also an open window on the same side to display the information (opposite side where the SN is). My local engraver said that is where he engrave the previous P320 he did.

I've never sent a photo of the entire firearm, just close-up photos of the engravings. I have combined more than one engraving in a single photo if it was appropriate and/or unrealistic to photograph them separately. As an example, in the case of an AR-15 Receiver, I've sent two photos; One close-up of the Model & S/N, and one close-up of the Mfr & City, State.

UPLOAD PHOTOS FOR VERIFICATION:

1. SN
2. MFG - Include the mfr's location (City, State) in this photo as appropriate.
3. MODEL

The ATF is just looking to check boxes here. They look at the photo(s) of the engraving(s) you uploaded, and look at what you filled in on the form, and they're like, 'Yup, those match...Check'! Honestly it's refreshing to see the info they sent in their DISAPPROVED response email. It's almost like they're saying 'Just send us this and you'll be all set'! Wink

Never, ever select anything from those drop-down menus. It's all auto-populated with the incorrect crap other people have entered. Only and ever type in exactly what is on your gun.

I recently had two F1s “approved with conditions” for the model designation stuff. The first was an Sig MPX, and I selected “MPX” as the model, because I assumed Sig wasn’t actually part of the model name, even though it was stamped in front of the “MPX”. The approved condition was model=SIG MPX. Next one I sent in was my HK USC. Based on the Sig experience, I selected “HK USC”, because, similar to the Sig, HK was stamped next to USC. Nope, the approved condition was model=USC. I had attached photos of the engravings with the forms. At least they didn’t outright disapprove them, but it’s a bit annoying.

Sorry they didn’t simply approve yours with the correct model “condition”, OP.

I wish they approved mine with condition, like yours. I struck out 3/3. Frown
Now I wait for the $600 refund, so I can re-file.

There used to be an NFA lawyer on the forum, HeavyD, who might be able to help. I haven't seen any posts by him in a while. I've used him several times.

TBH, it’s too late now. They’ve been disapproved and I don’t think they can resurrected. They have to be resubmitted as new submissions. Not sure what a NFA lawyer can do to change it.
