Trump Beats Democrats' Emoluments Lawsuit

Trump's 'best week' has just gotten a little better, after the US Court of Appeals for the DC Circuit tossed out Congressional Democrats' third attempt to nail Trump after claiming he is in violation of the Constitution's Emoluments Clause.

In a Friday decision, the court vacated a district court judge's ruling that the Democrats had standing to sue Trump for accepting foreign payments at his Washington DC hotel, according to law.com - adding that the court would not participate in a political debate.

"Because we conclude that the Members lack standing, we reverse the district court and remand with instructions to dismiss their complaint, said Judges Karen LeCraft Henderson, Thomas Griffith and David Tatel in a per curiam opinion.

They found that, after past U.S. Supreme Court rulings on individual legislators’ ability to sue, “only an institution can assert an institutional injury provided the injury is not ‘wholly abstract and widely dispersed.’”

“Here, regardless of rigor, our conclusion is straightforward because the members—29 Senators and 186 members of the House of Representatives—do not constitute a majority of either body and are, therefore, powerless to approve or deny the President’s acceptance of foreign emoluments,” the opinion reads. -law.com

"The Members can, and likely will, continue to use their weighty voices to make their case to the American people, their colleagues in the Congress and the president himself, all of whom are free to engage that argument as they see fit," the judges added. "But we will not—indeed we cannot—participate in this debate."

As law.com notes, the ruling may finally signal the end of a lawsuit that has now stretched into its third year.

Gallup has some fascinating poll data on Americans’ views of their own financial well-being. The headline sums it up: “Record-High Optimism on Personal Finances in U.S.”

Gallup finds that 59% say they are better off than they were a year ago, as opposed to only 20% who say they are worse off. Those are great numbers–interestingly, we are so divided that political affiliation makes a big difference even on a simple question about one’s own finances–but that isn’t the data point I mean.

The most striking finding is this one: 74% say they expect to be better off a year from now than they are today, the highest such finding Gallup has ever recorded

Sure, a lot can change between now and November. But with 74% of Americans looking forward to being more prosperous a year from now, it is hard to imagine a majority thinking that a radical change in the direction of socialism is a good idea. A huge majority of Americans, whatever they may think of Donald Trump, appear to be invested in the direction the country is moving.

Rather than poke the usual verbiage at the wing of the Democratic Party that embraces the label of “democratic socialism,” Trump introduced Venezuelan opposition leader Juan Guaidó, whose quest to unseat his country’s socialist government had the entire Congress on its bipartisan feet. Now Democrats are left to explain why ousting socialists is good policy for Venezuela while electing them — the democratic variety, anyway — is right for the United States.

Viewers were left to wonder: Why wouldn’t Pelosi applaud money for historically black colleges and universities?

What’s her beef with a serviceman who returns from deployment to hug his kids?

Where’s her feeling for the brother of a man killed by an undocumented criminal?

All of these visuals could be explained in policy terms, but as Ronald Reagan once confided to his diary, “If you’re explaining, you’re losing.”
