How many vulnerable dems are there? They will be on record voting not to acquit. And it's not a mid-term. More people will show up at the polls.

I sent the following email to Senator Romney this afternoon:

I realize it is often difficult to find a candidate who is absolutely perfect and without fault and President Trump is no exception. However if the people on the opposite side of the aisle were examined they would fall far shorter of good qualities than he does. As a voter, my choice is often a matter of selecting the lesser of two evils. I think the good he has accomplished in office far exceeds that of his predecessor. I supported you in your run for The Presidency in 2012 and certainly voted for you in that election. Based on your vote today in the impeachment hearings that is a mistake I will not make again.

Although I'm ashamed, I must admit that I was watching MSNBC earlier while Fox was letting Juan Williams speak. Brian Williams delivered the funniest line I heard in a very long time. It was during the break prior to the witness vote. They had a split screen showing the chamber filled with people milling around. When the Chief Justice sat down, everyone rushed off in a different direction. Brian Williams said something like "there's some activity now, their scattering like it's a Raid commercial". If you happened to see it live, it was hysterical. It's was funny on it's own but if you imagine his insider's contempt for these people, it's just hysterical.

Chief Justice John Roberts made crystal clear tonight that he has no intention of intervening in the Senate impeachment trial of President Trump by casting a tie-breaking vote.

Speculation had mounted during the trial whether Roberts would act, as Democrats hoped the chief could help them force the Republican majority to allow witnesses to be called.

A chief justice had previously settled Senate ties in an impeachment trial — back in 1868 — Senate Minority Leader Chuck Schumer, a New York Democrat, noted.

But when asked directly about whether he would get involved, Roberts said he would not.

Here's the exchange:

Schumer: "Is the chief justice aware that in the impeachment trial of President Johnson, Chief Justice Chase, as presiding officer, cast tie-breaking votes on both March 31 and April 2, 1868?"

Roberts: "I am, Mr. Leader. The one concerned a motion to adjourn; the other concerned a motion to close deliberations. I do not regard those isolated episodes 150 years ago as sufficient to support a general authority to break ties.

If the members of this body elected by the people and accountable to them divide equally on a motion, the normal rule is that the motion fails. I think it would be inappropriate for me, an unelected official from a different branch of government, to assert the power to change that result so that the motion would succeed."
