Judge Mark Pittman, a Trump-appointee based in Fort Worth, Texas, delivered a remedial lesson in civics to the administration: "The Constitution demands equal treatment under law." While such a statement should be obvious to any American, this was quite a painful blow to the administration. On his first day in office, President Biden declared a "whole of government" approach to racial equity, requiring all his agencies to "affirmatively advance[e] equity." In practice, the equity agenda resulted in a bevy of programs open to some races, but not others. Farmers, restaurant owners, homeowners, small business owners and federal contractors all got billions in federal tax dollars, so long as they belonged to certain racial groups. In court, the Biden administration attorneys vigorously defended this race-based agency, claiming that this type of race discrimination was justified because it was remedying "the effects of past inequities stemming from racial prejudice." According to this narrative, Biden’s attorneys said that redlining, Jim Crow, and a "denial of benefits from the G.I. Bill," give modern-day policymakers a blank check to discriminate against Whites and other nonpreferred racial groups. If this sounds familiar, it should. This is the theory of systemic racism, a modern-day progressive religion, which declares that all present-day racial disparities are caused by past race discrimination, despite clear evidence to the contrary (documented aptly by academics like Thomas Sowell). "The reason why Xi Jinping got very upset in terms of when I shot that balloon down with two boxcars full of spy equipment in it is he didn’t know it was there," Biden reportedly said at a private Kentfield home on Tuesday. "No, I’m serious. That’s a great embarrassment for dictators when they didn’t know what happened." U.S. officials in attendance were surprised by the president's remarks at a campaign event, according to the New York Times, which reported that an anonymous source confirmed Biden's comments were accurate. The president also referred to Xi as a dictator during the event, prompting anger from Chinese officials. When asked about Biden's decision to discuss the sensitive information at a big-dollar fundraiser, the Pentagon referred Fox News Digital to the White House, which has yet to return comment. The testimony revealed that U.S. Attorney David Weiss - the Trump-era holdover who prosecuted the case against Hunter Biden - allegedly asked for special counsel status and was denied by the Department of Justice. Weiss also allegedly tried to bring charges against Hunter in Washington D.C. and California in the fall of 2022 and had that request denied in January 2023. But Weiss said in a letter to lawmakers earlier this month the DOJ granted him 'ultimate authority' on when and where to bring charges. Attorney General Merrick Garland just Wednesday vouched for Weiss, saying he had given him 'full authority' to decide how to handle the situation. 'And that’s what he’s done,' Garland said. The unverified testimony came from two IRS whistleblowers as news broke this week that Hunter Biden had agreed to plead guilty to two misdemeanor tax offenses while dispensing with a gun charge against him, likely allowing him to avoid prison time. Ways and Means Chair Jason Smith, R-Mo., revealed in a press conference that two IRS employees had claimed that the agency sought felony charges against Hunter Biden for attempting to evade taxes and making false statements. According to Smith the whistleblowers said Hunter failed to pay $2.2 million in taxes on $8.3 million in income from foreign entities in Ukraine, China, and Romania. Smith said the testimony also shows the DOJ sought to 'delay the investigation long enough to reach the statute of limitations' and 'divulged sensitive actions by the investigative team to Biden's attorneys.' In one example whistleblower testimony claimed that the IRS was going to search a storage unit in Virginia belonging to Hunter Biden but tipped off his lawyers before doing so. In one revelation a July 2017 text message from Hunter Biden to Chinese business partner Henry Zhao the president's son invoked his father to threaten Zhao for payment. 'I am sitting here with my father and we would like to understand why the commitment made has not been fulfilled. Tell the director that I would like to resolve this now before it gets out of hand, and now means tonight,' the text message read. 'And, Z, if I get a call or text from anyone involved in this other than you, Zhang, or the chairman, I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direction. I am sitting here waiting for the call with my father.' According to Smith, the whistleblowers claimed the DOJ dragged its feet in authenticating the message. They had obtained it in August 2020 after getting the results back from an iCloud search warrant. 'The messages included material we clearly needed to follow up on,' whistleblower testimony said. In the lead-up to the 2020 election, the IRS had 'prepared for when we could go overt' by obtaining further leads in the case. The testimony also revealed that the investigation into Hunter Biden, code name Sportsman, was first opened in November 2018 as an offshoot of an investigation the IRS was conducting into a foreign-based amateur online pornography platform. According to 'whistleblower 1,' believed to be former IRS agent Gary Shapley, one point it became clear to the IRS that they needed to search the guest house of Joe Biden where Hunter had been living for a time. 'Assistant United States Attorney, Lesley Wolf, told us there was more than enough probable cause for the physical search warrant there, but the question was whether the juice was worth the squeeze,' the whistleblower said. According to his testimony, the whistleblower chafed at restrictions and limitations being imposed by DOJ as part of its internal policies on probes that might interfere with an election – although he happened that many of the interactions took place months before the November 2020 elections. He complained to IRS leadership in June 2020 that 'DOJ Tax has made a concerned effort to drag their feet concerning conducting search warrants and interviewing key witnesses in an effort to push those actions to a time frime where they can invoke the Department of Justice rule of thumb concerning affecting elections.' Then-President Donald Trump's election overturn effort stalled things further. 'Because the 2020 election was contested, our original plan to go overt on or around November 17th was delayed. DOJ pushed back against the day of action date because they did not want to approach Hunter Biden while he was in Delaware, potentially collocated with President Biden,' he told lawmakers. Then, the whistleblower said, his team began preparing for a 'day of action' on December 8, 2020, with document requests and a dozen interviews, while seeking a search of Hunter Biden's residence, which he called a 'Hail Mary' idea. It would appear to me that either Brandon divulged classified information, or he declassified it as President's are ultimately entitled to do. So did he declassify it in his head? Or who did he notify that he declassified the information? I know I am dreaming, but would serve that old turd right if it would help President Trump. He confirmed career prosecutors originally intended to charge Hunter Biden with numerous tax violations dating to 2014, but in the end appointees of Joe Biden nixed the plan for a more sweeping indictment. In the end, the charges were narrowed to two counts in 2017 and 2018 that most likely spared the presidential son prison time. Shapley said the denial was unprecedented in his many years as an IRS agent. "So it was off the table. And that was even after the election. So there's many things. Any other case I ever worked, if they were like there's a storage unit with documents from the business and personal documents in relation to the years under investigation -- the risk was zero, because it's on a storage unit, it's not on a residence -- there's no prosecutor I've ever worked with that wouldn't say, go get those documents," he said. Shapley also confirmed prosecutors had evidence that Joe Biden met with officials of his son's Chinese energy client called CEFC, describing an interview that family associate Rob Walker gave the FBI. "Walker went on to describe an instance in which the former Vice President showed up at a CEFC meeting. Walker said: "We were at the Four Seasons and we were having lunch and he stopped in, just said hello to everybody. I don't even think he drank water. I think Hunter Biden said, 'I may be trying to start a company or try to do something with these guys and could you?' And I think he was like, if I'm around and he'd show up," he recounted. "The FBI agent asked: "So you definitely got the feeling that that was orchestrated by Hunter Biden to have like an appearance by his dad at that meeting just to kind of bolster your chances at making a deal work out? Walker answered: "Sure." Additional testimony from Shapley and an unidentified subordinate confirmed Just the News's earlier reporting that: 1) The DOJ allowed the statute of limitations to expire on alleged tax crimes dating from before 2017 involving hundreds of thousands of dollars more in undeclared income, including some from foreign firms such as Ukrainian gas firm Burisma. 2) The IRS criminal investigation team never learned that the FBI had recovered emails from Hunter's laptop showing that the first son was aware by 2017 that he had not paid taxes on at least $400,000 in income from Burisma from 2014. 3) Neither the IRS nor the FBI agents investigating Biden ever saw the confidential human source information the FBI received and documented in a form FD-1023 outlining an alleged bribery deal in which a Burisma executive paid $5 million each to Hunter and another Biden family member. Both Shapley and his unnamed subordinate provided statements that neither they, nor anyone of whom they were aware working on the case ever received the information relating to that alleged scheme and consequently never explored the matter. An affidavit from Shapley references comments from former Attorney General William Barr, who has publicly stated that he referred the information to an ongoing investigation in Delaware. Barr spoke to the Federalist in early June, during which he refuted claims from Maryland Democratic Rep. Jamie Raskin that he had shut down the investigation into the bribery allegation. "It’s not true. It wasn’t closed down," he said. "On the contrary, it was sent to Delaware for further investigation." House Ways and Means Committee Chairman Jason Smith (R-Mo.) said justice can't be "tipped in the favor" of wealthy and politically connected individuals.
