Before this past governor election, REPs had solid control of the VA House of Delegates.

But DEMs had a tremendous broad victory and it came down that DEMs were one seat away from a tie in the House of Delegates.

The deciding race had an incumbent REP winning by 10 votes (out of over 23,000 votes cast).

After a recount, the DEM candidate won. By a single vote.

11,608 for the DEM
11,607 for the REP

So now the VA House of Delegates is split 50-50.

That is bad.

If it had been 10-20 votes , it would not have sounded so fishy.

But somber day for Va . Republicians and Conservatives.

A three- judge panel declined to certify the recount of a key House race today, saying that a questionable ballot should be counted in favor of the Republican and tying a race that Democrats had thought they had won by a single vote.

The court declares there is no winner in this election ,” said Newport News Circuit Court Judge Bryant L. Sugg, after the judges deliberated for more than two hours.

He said the ballot in question, which was deemed unacceptable during the five-hour recount on Tuesday, contained a mark for Democrat Shelly Simonds as well as a mark for Republican Del. David Yancey but that the mark for Simonds had also been struck out.

The court’s decision leaves the race for the 94th District tied at 11,608 votes each for Yancey and Simonds.

And it leaves the balance of power in the state legislature at 49-51, in favor of Republicans - at least for now.

In the case of a tie in a House race, state law says the winner is chosen by lot – essentially, a coin toss, according to Virginia state law. The state board of elections will conduct that “selection by lot”, within the next week.

But it doesn’t end there. If the loser of the coin toss is unhappy with that result, he or she can seek a second recount.

The Virginia Board of Elections announced on Thursday it would pick the winner of a closely-watched state House of Delegates race, in which the Democrat and the Republican each has 11,608 votes, using slips of paper placed in film canisters.

The board scheduled the drawing for Wednesday, James Alcorn, the board's chairman, said in a tweet.

If Yancey wins, Republicans will hold a slim 51-49 seat majority and retain control of the House of Delegates. If Simonds wins, the allocation of seats will be 50-50; and Democrats will share power with the Republicans. This would end 18 years of Republican control of the lower chamber of the Virginia General Assembly.

These damn democrats are a result of the crap migrating here from DC, Maryland and other northeast states. They ran those states into the ground, get frustrated, move to Virginia and attempt to run our Commonwealth into the ground as well. We should ban all new people looking to migrate here!

The drawing of lots happened after the race between Yancey and Democratic challenger Shelley Simonds ended in tie. The win allows Republicans to maintain a slim majority in the House, though a final tally is still uncertain because Simonds could ask for another recount. Adding another wrinkle: Another close legislative race is in doubt because it's locked in a court battle.

The drawing drew a large, if lopsided, crowd to the Virginia elections board meeting. Many of the people packed into the room were either reporters or Simonds' supporters. Yancey did not attend but did have a few GOP staffers there to watch.


The name of each candidate was printed on a piece of paper and placed into separate film canisters. The canisters were put into a cobalt-blue-and-white ceramic bowl made by a local artist, stirred around and Yancey's name was chosen first.

As Yancey's name was announced by Board Chairman James Alcorn, Simonds sat stoically, holding the hands of her daughter and husband seated beside her. There were no cheers from Yancey's few supporters. The electric mood went suddenly still.

Simonds endured a long moment of silence as the elections officials certified Yancey as the winner. The only sound in the room was the clicking of cameras, most of which were trained on Simonds.

Many state workers and staffers who work for Democratic Gov. Terry McAuliffe quickly left the room disappointed and Simonds addressed the media.

"This is a sad conclusion for me," she said.

However, she did not rule out asking for a recount, saying that her options were still on the table.

House Republican Leader Kirk Cox said shortly after the drawing that Yancey's win had cemented GOP control of the state House when the 2018 legislative session starts next week, even if Simonds asks for another recount.

Republicans currently control the chamber 51-49. If Simonds pursued a recount, if wouldn't be complete before the session starts and Cox said neither Yancey or Simonds would be seated until a winner was finalized. That would still allow Republicans to elect a speaker and make committee assignments based on a 50-49 advantage.

The race between Yancey, a three-term incumbent, and Simonds has bounced back and forth since the November election, when Virginia Democrats — fueled by voter anger directed at Republican President Donald Trump — wiped out a 66-34 advantage held by Republicans in the House. The election has been widely seen as a potential harbinger of the 2018 midterm congressional elections.

Simonds appeared to have lost the November election by 10 votes, but on Dec. 19, she won a recount by a single vote. The next day, a three-judge panel declared a tie based on a previously uncounted vote for Yancey.

At the heart of the dispute is a single ballot on which the voter filled in the bubble for both Simonds and Yancey. The voter also drew a single slash through the bubble for Simonds and picked Republican candidates in statewide races.

The ballot wasn't counted during the recount and was identified after a Republican election official raised concerns the following day.

After the drawing Thursday, election board members asked the public to make sure that they correctly fill out ballots in future contests.

The balance of power in the House could shift again because a lawsuit is pending over the results of another House race in Northern Virginia. Democrat Joshua Cole lost to Republican Bob Thomas by 73 votes in a recount. But voters filed a federal lawsuit after at least 147 ballots were found to be assigned to the wrong districts. A federal court hearing on that election is schedule for Friday.
