Am really suprised that these types of events have not been happening sooner and with more regularity. And not just high school boys doing the posting but what if the postee was a male.. And would you feel the same if the postee was your daughter or son or someone that you knew. ......................................... drill sgt.

While certainly immoral and just not cool, in all seriousness, is such a thing actually illegal? Is there a NJ statute against this sort of thing?

If they're fake, who cares? What harm was done?

Maybe I'm missing something here, but I'm not really sure why police are involved.

Yeah, and if you're the girl, good luck trying to convince someone (future employer, boyfriend, husband, kids) that it's not actually you, but an AI generated image.

I don't know if it is illegal or not, but the potential harm done is actually quite a lot, in my view.

I don't know if Child Pornography Laws are up to date enough to make it illegal to posses or produce artificial images depicting child porn. The simple answer is to answer the question if someone uses a brush and paint to produce a depiction of a child being raped is Illegal or Art.


I've stopped counting.

This is my first thought.
And then the father has family who have nothing to lose if they confront legally the perp or the school. Then other families show up who have kids there...
I'm hoping families who children attend this school share their voice.

I think ALL of the kids involved should be charged with the manufacture, possession and distribution of child pornography and face the consequences

if they're old enough to use a computer and master the intricacies of the AI program, they're certainly old enough enough to know right from wrong

zero fucks given for the bastards that did this - and I;m sure they won't pay nearly as much as they should but if this is what they do when they're kids (and they get away with it), just imagine what they will be like as adults with the same mindset...

Indeed. And I'll add this, the police better be involved because if they're not, then any real father of a girl falling victim of this depravity is going to serve up justice on his own terms, and that's probably going to end up being a whole lot worse for everyone involved.

The law isn’t settled on this sort of stuff yet, but it is possible that something like this might constitute slander or possibly libel. Depending on the age of the person used, some folks have been discussing if child pornography laws apply or not. The legal systems hasn’t figured out where the lines are with AI generated images compared to photographs, paintings, etc. created by a person.

Imagining someone naked in your head is ok. Taking pictures of someone naked and distributing them without their consent is not. Making a painting of someone you know as you imagine they would look naked is in the middle, and may or may not be ok depending on the details. Having an AI do the artwork instead of drawing it yourself is likely in that same grey area where the details can make it go either way.

It seems to me that there are some ways to minimize this kind of thing:

  • No "free" online software. In order to use it, you must have a paid subscription.

  • Two-factor authentication to log in. When you log in to your account, you must be authenticated with your phone number.

  • VPN and proxy server connections disallowed. No concealment of actual location of users.

  • All AI images encrypted with a unique, embedded signature, tied to the author of images. Of course, making screenshots of these images and distributing them would defeat this, but if there is a repository of all created images, they could be traced back to their author.

    Absent things such as this, we will come to a point where no responsible person will allow images of themselves or their children to be published online, and that would mean the end of Facebook, Instagram, TikTok, SnapChat and all the rest of that crap. Since this would mean a loss of revenue streams, it won't happen, and that brings us full circle for the need to impose restrictive policies on AI image creation.

    Kaczynski was ahead of his time, wasn't he? Not for his killing and maiming of innocent people, but rather, his POV about technology ultimately destroying society.

    Our state law just changed to cover stuff like this under the child porn statute. It doesn't have to be an actual photo, a computer-generated image or a digitized image is enough to satisfy the statute.
