Gov. Michelle Lujan Grisham on Friday announced a new public health order that, she said, will ban people from carrying firearms, either open or concealed, in Albuquerque and throughout Bernalillo County for the next 30 days, regardless of whether they have a permit.

Lujan Grisham, a Democrat, issued an executive order Thursday evening declaring gun violence a public health emergency.

During a news conference Friday, she said she expects legal challenges to the public health order and expressed uncertainty about whether the order would prevail in court.

The order states "no person, other than a law enforcement officer or licensed security officer, shall possess a firearm ... either openly or concealed, with cities or counties averaging 1,000 or more violent crimes per 100,000 residents per year since 2021."

The order applies only to the city of Albuquerque and Bernalillo County, Lujan Grisham said, and can only be enforced by New Mexico State Police, whose presence in the state's largest city would be "significant" over the next month.

Violating the order would likely be a misdemeanor, Lujan Grisham said, and it will have no bearing on private property or at a licensed gun dealer.

The declaration came after a shooting in which an 11-year-old boy was killed near the Isotopes Park in Albuquerque. Police said the incident appeared to be a case of road rage, the fifth such fatal incident in 2023.

Wonderful. Could the 30 days be to limit the legal challenges? Could a challenge be mounted in less than 30 days?

I’m curious what would be required for a challenge. Wouldn’t someone have to attempt to prove they were harmed by the executive order?

Others have pointed it out and I’m beginning to agree, these abuses will not stop until the individuals committing them are held personally accountable. For example, if her executive order fails legal challenge, then the money spent defending it should come out of her pocket, not the taxpayers’.

I would guess that someone would get cited for having a gun in the gun free zone, and then they can spend years of their life and hundreds of thousands of $$$ trying to prove it was an infringement on their rights.

Below the shooting that sparked the "health order".
Thugs.

ALBUQUERQUE, N.M. —Albuquerque police say a road rage shooting left an 11-year-old boy dead Wednesday night after he and his family left Isotopes Park.

As the boy and his family were driving away from the park, their vehicle pulled in front of another vehicle, according to APD Chief Harold Medina.

That vehicle made a U-turn and confronted the family on Avenida Cesar Chavez, Medina said. Then, someone in the suspect vehicle fired 17 shots at the family’s vehicle before reportedly leaving the area.

While there were police officers in the busy area, they were on foot.

At the scene, officers found the vehicle facing westbound next to the median with 14 gunshots, mostly on the passenger side.


In the vehicle, they found the 11-year-old boy dead and his aunt – a woman in her 20s – critically injured. The boy’s mother was also in the car.

Police are also processing shell casings found at the scene and working to learn more about the gun and where it came from.

On Thursday afternoon, police released the following photos of the suspect vehicle. It’s believed to be a newer model Dodge Durango SRT.

Another overzealous politician who doesn’t understand the problem or chooses to ignore it.

As far as the order, I expect concealed permit holders will remember that “concealed means concealed” and that if anything happens where they have need and are outed that the old judged by twelve rather than carried by six will apply.

This is what pisses me off. If you don’t believe it will pass muster, or think it might not, why are you enacting it???


Absolute abuse of power and criminal charges should be brought against her for 18 U.S. Code § 242 - Deprivation of rights under color of law.


F’in rats have become way to brash and cavalier with using the constitution to wipe their asses.






What part of "...Shall not be infringed" don't you understand???

As has been said before, there need to be material penalties for authorities who violate the constitution. For example, in this case, if the order is found to be in violation of the constitution, even after the order expires, she should be immediately removed from office and barred from holding any public position of authority for life, anywhere.
