From my reading of the articles, the judge feels he is bound by a precedent that was set some time ago, and he doesn't feel he has the authority to overturn that precedent.

This is why we have an appellate system. In fact, the judge indicated in remarks from the bench that he may have a different opinion than the precedent he felt compelled to follow.

While I agree that the particular decision is wrong, we should respect a judge that stays in his lane, and hands a disputed issue off to a higher court. That's what he is supposed to do.

In addition, as pointed out, this works in Trump's favor. He can now, with judicial cover, write rules for the issuance of press passes, rules of conduct for the press in the briefing room, and rules for suspension or revocation of those passes.

Also as noted above, Acosta's act seems to be wearing thin with other journalists. Just give the bastard enough rope...

This is how the President wins.

In the military a lot of the rules are made because someone messed up. The majority are being impacted by the stupidity of a few idiots.

Make the White House rules strict. Then, unofficially, be sympathetic to the rest of the correspondents. “Sorry it’s come to this guys, but people need to behave.” Ideally, Acosta will get told, “Dummy, you messed it up for the rest of us.”

The White House Has Released New Expectations For Press Conferences

1) A journalist called upon to ask a question will ask a single question and then will yield the floor to other journalists;

(2) At the discretion of the President or other White House official taking questions, a follow-up question or questions may be permitted; and where a follow up has been allowed and asked, the questioner will then yield the floor;

(3) "Yielding the floor" includes, when applicable, physically surrendering the microphone to White House staff for use by the next questioner.

(4) Failure to abide by any of rules (1)-(3) may result in suspension or revocation of the journalist's hard pass.

"We have created these rules with a degree of regret. For years, members of the White House press corps have attended countless press events with the President and other officials without engaging in the behavior Mr. Acosta displayed at the November 7, 2018 press conference," White House Press Secretary Sarah Sanders released in a statement. "We would have greatly preferred to continue hosting White House press conferences in reliance on a set of understood professional norms, and we believe the overwhelming majority of journalists covering the White House share that preference. But, given the position taken by CNN, we now feel obligated to replace previously shared practices with explicit rules."

"We are mindful that a more elaborate and comprehensive set of rules might need to be devised, including, for example, for journalist conduct in the open (non-press room) areas inside and outside the White House and for Air Force One," she continued. "At this time however, we have decided not to frame such rules in the hope that professional journalistic norms will suffice to regulate conduct in those places. If unprofessional behavior occurs in those settings, or if a court should decide that explicit rules are required to regulate conduct there, we will be forced to reconsider this decision."

Just heard the new rules tonight on Levin. Basically, you are allowed one question. After that, you have to relinquish the mic. If the President or his Press Secretary feels like you deserve a follow-up question, you're allowed one. If you violate the rules, sayonara. Simple.

I think the President played this correctly.

An interesting alternative might have been having the intern file a restraining order against Acosta...make it so Acosta can't be under the same roof as the intern.
